Prioritarianism itself is not committed to any particular claim about how moral importance decreases. It could decrease quickly or slowly, for example, and at a uniform or a variable rate. The defining feature of the view is just the claim that, somehow, moral importance decreases with the increasing advantage of the recipient.

There is a kind of power no one should have over anyone else, even if they don’t do anything with this power, or even if they only use this power for good. The republican tradition of political philosophy calls this kind of power domination. Here, I develop a theory of domination, and use this theory to advance our understanding of political legitimacy and justification. My account of domination refines recent neo-republican attempts to identify dominating social power with the capacity to (...) interfere arbitrarily with the choices of others. I argue that this capacity is not sufficient for domination. Instead, domination requires that one agent possess “impositional” power over someone else: power enough to make their refusal to cooperate more costly than cooperation across a wide range of forms that cooperation might take. But not all impositional power is domination; impositional power is domination to the extent that those wielding it do so in “deliberative isolation”—in accord only with their own sense of what’s best. The nature of domination, what it takes to minimize it, and its connection to deficits in political values like freedom and equality, are the subject of Chapter 2. The remainder of the dissertation uses the results of that chapter to construct a non-voluntarist alternative to the standard liberal account of how to reconcile political power with freedom and equality. Chapters 3 and 4 show how consent—actual or hypothetical—is not necessary to legitimize political power. What is necessary is that such power enable us to fulfil our duties against dominating others, while remaining accountable to us so that the state does not itself become a source of domination. How duties against domination can legitimize states is the primary subject of Chapter 3. Chapter 4 turns to the question of what we owe our fellow citizens as we cooperate together in the task of holding the state accountable. En el presente trabajo abordo el problema de la incompatibilidad normativa entre dos principios ampliamente aceptados entre los liberales igualitarios -el principio de igualdad de oportunidades y el de autonomía familiar- en el marco de la teoría de la justicia de Rawls. Luego de hacer explícitas las diferentes vías por las cuales la autonomía de la familia inexorablemente conduce a la desigualdad de oportunidades entre los individuos, me dedico a explorar dos soluciones al problema sugeridas por Rawls en Una teoría (...) de la justicia y a mostrar por qué las mismas son fallidas. This essay analyzes the problem of the normative incompatibility between two principles which are widely accepted by liberals -the principle of equality of opportunities and that of family autonomy- and this within the framework of Rawls´s theory of justice. After specifying different ways in which the autonomy of the family necessarily leads to inequality of opportunities between individuals, I examine two different solutions suggested by Rawls in A Theory of Justice and I intend to demonstrate why they are wrong. This thesis situates recent tensions in debates about history over epistemology within their historical and social contexts. It explores the possibilities for developing historical understanding across epistemologies by considering the role ideas of justice can play in contemporary historical praxis. By considering historical praxis in relation to ideas of justice I have identified a nexus in which to explore different ways of knowing the past that is at once responsive to difference whilst also situating the ethical as an essential regulator (...) in determining meaningful, responsible and valid representations of the past. Psychopharmacological cognitive enhancements could lead to a higher quality of life of healthy individuals with lower cognitive capacities, but the current regulatory framework does not seem to enable access to this group. This article discusses why Sen’s Capability Approach could open up such access, while two other modern social justice theories – utilitarianism and Rawls’ Justice as Fairness – could not. In short, the utilitarian approach is proven to be inadequate, due to practical reasons and having a low chance of (...) real-world success. Rawls’ Justice as Fairness seems to be problematic because of conflicting stances that follow from his First Principle of Justice. The Capability Approach has the greatest chance of success in the context of these substances, because of arguments that can be identified under the banners of agency/self-respect and the way the public views those who take the capability path out of their poor situation. The article also discusses general and practical problems with psychopharmacological cognitive enhancement that should be addressed when writing new policy on this topic. (shrink)

In The Order of Public Reason, Gerald Gaus defends an innovative and sophisticated convergence version of public reason liberalism. The crucial concept of his argumentative framework is that of “social morality”, intended as the set of rules apt to organize how individuals can make moral demands over each other. I claim that Gaus’s characterization of social morality and its rules is unstable because it rests on a rejection of the distinction between the normative and the descriptive. I argue that such (...) rejection is motivated by certain practical aims Gaus wishes his theory to achieve. His method and his idea that morality needs to be understood both as the dictate of impartial reasoning and as a social and historical fact come from the need for his theory to perform the task of settling the problem of order. I discuss Gaus’s philosophical attitude and, finally, distinguishing between “therapeutic” and “evaluative” approaches, I present some points of discussion for understanding the role and scope of political philosophy in general. Central planners and citizens, conservatives and reformers, 19th-century liberal statisticians and today's advocates of sustainable development all draw on statistics for the elaboration and communication of political visions. Yet, this striking phenomenon has so far largely escaped the attention of political philosophers in the English-speaking world. As politics has come to be informed and shaped by statistics, there is a need to scrutinize omnipresent statistical accounts for their political vision. Taking as its political vision the idea of society as a (...) fair system of co-operation, this thesis offers a series of essays towards a political philosophy of statistics. To this end, the thesis retrieves the statistical macro-scopic point of view in the vision of co-operation as spelled out by John Rawls and contrasts this uptake of statistics with the one in Martin Heidegger's phenomenology of everydayness. The goal is to make explicit the implicit role of statistics in the philosophical reflection of these thinkers. This thesis then argues for the place of statistics in a system of co-operation in terms of accountability institutions. It also engages the contemporary political issue of sustainable development, which has seen the rapid development and use of statistics. It argues that the Index for Sustainable Development is not a measure of sustainable development, but rather a debunking index. As such, it is a stepping stone for more systematic accounts, such as the eco-space proposal. For these proposals to make a positive contribution to sustainable development, they must be situated within a vision of large-scale political society. (shrink)

Communitarians and liberals have long held vigorous discussions about the status of the self. The former argue that we do not actively choose our ends, but that they come to the fore through self-discovery. This implies that the self is encumbered and that the liberal self—one capable of choosing his ends—is unrealistic. In this article, we consider these two paradigms and especially Will Kymlicka’s position within this debate. Kymlicka defends a liberal theory without relying on an unencumbered self, and may (...) therefore have rescued liberalism from communitarian attacks. In the first part of our article, we argue that Kymlicka’s theory can only be sustained if it involves an unencumbered self that is prior to its ends. Ultimately, this means that the communitarian critique on liberalism can no longer be refuted. In order to support our argument, we introduce a distinction between the metaphysical depiction of the self as an unencumbered chooser and the psychological depiction of the self, which draws upon people’s understanding of themselves as being constitutively bound to certain ends. In the second part of our article, we invoke Jacques Lacan’s psychoanalytical theory in order to assert that neither communitarians nor liberals are entirely able to explain what is at stake when individuals describe being bound to ‘extimate ends’—ends they feel they did not choose, yet cannot relinquish. Although both philosophical paradigms cannot fully account for the ‘extimate subject’, in the policies they respectively defend, liberalism is the one that should be preferred. (shrink)

This dissertation is intended as an intervention in the interminable and apparently antinomical philosophical exchange between political theories of radical democracy descended from Ernesto Laclau and Chantal Mouffe and liberal democracy descended from John Rawls. Radical democrats have deployed the friend-enemy distinction of Carl Schmitt to criticize liberal democracy as hypocritical and ultimately undemocratic in its refusal to critique its own ground; liberal democrats have riposted by characterizing radical democracy as dangerously anarchic. In this project, I read Immanuel Kant in (...) dialog with the work of Ingeborg Maus to show in a novel way that contemporary radical democratic theories ultimately fall to the very critique upon which they indict liberal democracy, that they degenerate into the valorization of mere war, and that it was in fact in full recognition of this dynamic that Kants theory of liberal democracy begins. Kants theory of countervailing liberalism is ultimately discovered to be a politics of love over barbarism. The project ranges over a wide ground, from a close reading of Kant, to the 19th Century Pantheismusstreit, to works by Arendt, Hardt and Negri, Žižek, and Strauss. (shrink)
