This paper considers the use that Plato makes of the Principle of Non-Contradiction in his engagements with eristic refutations. By examining Plato’s use of the principle in his most detailed engagements with eristic—in the Sophist, the discussion of “agonistic” argumentation in the Theaetetus, and especially the Euthydemus—I aim to show that the pressure exerted on Plato by eristic refutations played a crucial role in his development of the PNC, and that the principle provided him with a much more sophisticated means (...) of demarcating philosophical argumentation from eristic than he is generally thought to have. In particular, I argue that Plato’s qualified formulation of the PNC restricts the class of genuine contradictions in such a way that reveals the contradictions that eristics produce through their refutations to be merely apparent and that Plato consistently appeals to his qualified conception of genuine contradiction in his encounters with eristics in order to demonstrate that their refutations are merely apparent. The paper concludes by suggesting that the conception of genuine contradiction afforded by the PNC did not just provide Plato with a way of demarcating genuine from eristic refutations, but also with an answer to substantive philosophical challenges that eristics raised through their refutations. ABSTRACTThis paper is concerned with the reasons for the emergence and dominance of analytic philosophy in America. It closely examines the contents of, and changing editors at, The Philosophical Review, and provides a perspective on the contents of other leading philosophy journals. It suggests that analytic philosophy emerged prior to the 1950s in an environment characterized by a rich diversity of approaches to philosophy and that it came to dominate American philosophy at least in part due to its effective promotion (...) by The Philosophical Review’s editors. Our picture of mid-twentieth-century American philosophy is different from existing ones, including those according to which the prominence of analytic philosophy in America was basically a matter of the natural affinity between American philosophy and analytic philosophy and those according to which the political climate at the time was hostile towards non-analytic approaches. Furthermore, our reconstruction suggests a new perspective on the nature of 1950s analytic philosophy. (shrink)

This paper reconsiders the debates around the interpretation of Parmenides’ Being, in order to draw out the preconceptions that lie behind such debates and to scrutinize the legitimacy of applying them to a text such as Parmenides’ poem. With a focus on the assumptions that have driven scholars to seek clarity within the notoriously ambiguous verse of the poem, I ask whether it is possible to develop an analysis of Parmenides’ Being that is sympathetic both to his clear interest in (...) argument, logic, knowledge and truth and to his ambiguous expression and cultural and literary resonances. This thesis seeks to engage with and give answers to the fundamental question of rights interpretation confronting the British judiciary under the Human Rights Act 1998. As a premise, it recognises that the textual openness and consequential semantic uncertainty of the requirements of the Convention rights necessitates their interpretation. In determining the approach the courts should apply, this thesis takes as its structural foundation an analysis of the current approach of the domestic courts and the European Court of Human Rights (...) to the five pivotal questions of interpretation: who has rights, the substantive nature of those rights, how rights are to be weighted and balanced in cases of conflict, whether they are rights under a will or an interest conception, and against whom the rights are held? From this basis, the thesis builds upon the existing knowledge to apply Alan Gewirth’s Principle of Generic Consistency to the current judicial position, to critique its compatibility with this principle’s requirements. Through analysis of core settled characteristics of the Convention rights, the substance of the courts’ judgements and the ECtHR’s jurisprudence, and supported by both dialectically necessary and contingent arguments, it is ultimately argued that it is, theoretically and practically, both necessary and possible for the domestic courts to be guided by the PGC in their interpretive approach. Finally, an improved understanding of the principle of human dignity will be advocated as a means through which the domestic courts can apply the PGC’s requirements. By this means, this thesis ultimately proposes an interpretive approach to the Convention rights which gives compelling guidance in answering the fundamental questions of rights interpretation and, by encouraging direct principled engagement with these questions, increases the public understanding of the fundamental nature of rights and the acceptability of the HRA and judgements under it.
