En este artículo me preguntaré por las razones que hicieron a Foucault, Castoriadis y Rancière ocuparse por la democracia antigua, básicamente a principios de los años 80 del siglo XX. Para dilucidar tales razones los vincularé con una tradición del helenismo francés–la Escuela de París–, con una trayectoria biográfica específica a cada uno de ellos y con los desafíos que representa la crisis del marxismo. Our aim is to defend the Precautionary Principle (PP) against the main theoretical and practical criticisms that it has raised by proposing a novel conception and a specific formulation of the principle. We first address the theoretical concerns against the idea of there being a principle of precaution by arguing for a distinctively political conception of the PP as opposed to a moral one. Our claim is that the rationale of the PP is grounded in the fact that contemporary societies (...) wish to avoid morally unacceptable risks while at the same time pursuing other goals, aspirations and values. Following this political conception of the PP, we propose a specific formulation in terms of an argumentation scheme—the Argumentation Scheme for Appealing to Precaution—which is meant to solve, in turn, the main practical concerns that the PP has raised. We explain the advantages of our proposal by analysing appeals to precaution in the cases of (1) the European restrictions on the free movement of persons during the COVID-19 pandemic and (2) the discharge of nuclear wastes into the Irish Sea. In this paper I unpack a realistic conception of politics by tightly defining its constitutive features: conflict and order. A conflict emerges when an actor is disposed to impose his/her views against the resistance of others. Conflicts are more problematic than moralists realize because they emerge unilaterally, are potentially violent, impermeable to content-based reason, and unavoidable. Order is then defined as an institutional framework that provides binding collective decisions. Order is deemed necessary because individuals need to cooperate to survive, but (...) groups cannot spontaneously secure collective decisions and are prone to conflicts. Particularly, the fact that potentially violent conflicts emerge unilaterally means that order requires coercion. I conclude that mischaracterizing conflict and order leads to undesirable normative principles, and that this criticism can be leveraged not only against Rawlsian liberals who moralize conflicts away, but also against some agonists who underestimate the need for order and some communitarians who underplay both circumstances. In this paper, we argue that solutions to normative challenges associated with autonomous driving, such as real-world trolley cases or distributions of risk in mundane driving situations, face the problem of reasonable pluralism: Reasonable pluralism refers to the fact that there exists a plurality of reasonable yet incompatible comprehensive moral doctrines within liberal democracies. The corresponding problem is that a politically acceptable solution cannot refer to only one of these comprehensive doctrines. Yet a politically adequate solution to the normative challenges (...) of autonomous driving need not come at the expense of an ethical solution, if it is based on moral beliefs that are (1) shared in an overlapping consensus and (2) systematized through public reason. Therefore, we argue that a Rawlsian justificatory framework is able to adequately address the normative challenges of autonomous driving and elaborate on how such a framework might be employed for this purpose. The idea of a distinctively political normativity came under sustained fire lately. Here I formulate, test, and reject a moderate and promising way of conceiving it. According to this conception, political normativity is akin to the kind of normativity at play in all-things-considered judgments, i.e., those judgments that weight together all the relevant reasons to determine what practical rationality as such requires to do. I argue that even when we try to conceive political normativity in this all-things-considered way, and even (...) when we do not concede from the get-go that moral reasons necessarily trump or override normative reasons of a different kind, political normativity is still reducible to morality, because the peculiar content of all-things-considered political oughts can be explained by the interplay of general moral principles and contextual facts that do not obtain exclusively in political scenarios. If my arguments are correct, I provide political realists with one more reason to withdraw from the metaethical battle over the idea of a distinctively political normativity and show that the moralist approach is defensible against a prima facie promising, but ultimately untenable, alternative. How should automated vehicles (AVs) react in emergency circumstances? Most research projects and scientific literature deal with this question from a moral perspective. In particular, it is customary to treat emergencies involving AVs as instances of moral dilemmas and to use the trolley problem as a framework to address such alleged dilemmas. Some critics have pointed out some shortcomings of this strategy and have urged to focus on mundane traffic situations instead of trolley cases involving AVs. Besides, these authors rightly (...) point out the political nature of the most interesting debates involving AVs. However, in our view, they do not offer an adequate account of the distinction between ethics and politics and still see their proposals as contributions to the ethics of AVs. We argue that many of the interesting questions about how AVs should behave, both in emergency and other situations, are of political, and not moral, nature. This view is based on a conception of politics and political normativity that we have developed elsewhere and that we call “political minimalism.” Additionally, we show that this proposed perspective has significant consequences for the design, management, and regulation of transport systems. First, this article defends an original normative source: functional normativity. Second, it advocates a substantive functional standard: political institutions ought to be assessed by their capacity to select and implement collective decisions. Drawing from the ‘etiological account’ in philosophy of biology, I will argue that functions yield normative standards, which are independent from morality. For example, a ‘good heart’ (...) is one that pumps blood well, and a good army is one that it is effective at exerting military force. I then interpret realism’s naturalistic conception of politics as an etiological function of social groups: namely making binding collective decisions under persistent disagreement. I conclude that political institutions should be evaluated realistically by how well they perform this task. Finally, I assess trade-offs between this functional political normativity and other moral values. I conclude that justice, fairness, freedom and equality remain obviously important concerns, but only once the basic political function is secured. (shrink)

In Western democracies, people harbor feelings of disgust or hatred for politics. Populists and technocrats even seemingly question the value of politics. Populists cry that they are not politicians and that politics is necessarily corrupt. From the opposite side, technocrats view politics as a pointless constraint on enacting the obviously right policies. Are Western democracies facing a rejection of politics? And is politics worth defending? This paper offers a vindicatory genealogy of politics, vindicating the need human beings have for this (...) practice and clarifying the extent of its contemporary rejections. To achieve these contributions, the paper connects the literatures on pragmatic genealogy and on political realism, revealing how they can complement each other. Following pragmatic genealogy, the practice of politics is vindicated, because it meets an inevitable functional need for collectively binding decision‐making. However, and importantly, political realism allows us to see that the functional mechanisms through which politics fulfills this need vary contextually and thus require careful empirical scrutiny. The paper thus dispels confusion about seeming rejections of politics by clarifying what is unavoidable, and what is revisable about politics. (shrink)

The main goal of this paper is to show that politics constitutes a normative domain of its own. To this, a concept of political value that explains why the politically good provides reasons for actions is indispensable. I shape this concept by adopting the framework of political minimalism and developing one of its central tenets, namely, that politics, as a constitutively normative practice, specifies objective standards for evaluating political phenomena. I characterize the notion of political value in these terms to (...) offer a non-moralist foundation for political normativity. In this endeavor, the work of Bernard Williams plays two opposing roles: while his metapolitical ideas exemplify the shortcomings of substantialist accounts of political normativity, his criticism of the morality system and his conception of practical rationality as all-things-considered practical deliberation are fundamental, to the point that the conception of political normativity endorsed here can be seen as an extension of Williams’ ideas on normativity in general. Finally, I draw some consequences from this account of political minimalism to show that this conception of political normativity can hardly be considered a variety of political realism. (shrink)
