The contrast between the normative functions of political parties in representative democracies and their empirical working is stark and rapidly increasing. This article starts from a sober, realist account of the empirical state of affairs and from structural problems of democracy and participations – in terms of limits of time, information, qualification and relevant expertise – that have to be acknowledged by any realist–utopian proposal of alternatives beyond the exclusive alternative of ‘thin, realist democracy’ or emphatic ‘strong, participatory, direct, or (...) mass democracy’. We can do better. My search for institutional alternatives looks not for the replacement of political parties but for their relief. Many, not all, of their normative tasks can be shared with other functional networks, associations and organizations. In exploring such a new division of political labour I draw on older debates and designs of associative democracy and on recent discussions to democratize expertise and to expertise democracy in order to address urgent societal problems of high-risk decisions under conditions of extreme complexity, contingency, unpredictability and uncertainty and deep contestedness of our knowledge, problems that turn out to be unmanagable by party politics and representative democracy. The article deals with some implications of radical uncertainty for participatory democracy, and more precisely for Participatory Technology Assessment. Two main forms of PTA are discussed. One is aimed at involving lay citizens and highlighting public opinion. The other is addressed to stakeholder groups and organisations, not only in terms of interest mediation but also of inclusion of their insight into a problem. Radical uncertainty makes 'intractable' many environmental and technological issues and brings into question traditional and new approaches to (...) policymaking. Its consequences are explored from the viewpoint of new science, deliberative democracy, and network governance. Radical uncertainty calls for a rethinking of the aims of public deliberation, and a reinterpretation of the divide between opinion- and position-oriented PTA. To look for a public opinion, understood as a shared principled view, can prove misleading, as can thinking of stakeholder participatory arrangements in the usual way. When facts and values overlap, and are deeply controversial, the only opportunity for mutual understanding may be to look for practical, 'local' answers, based on different positional insights. Moreover, radical uncertainty also affects interest determination and pursuit, and may enhance the opportunity of joint, inclusive, non-strategic issue definition and solution-devising. This vision of public deliberation is consistent with the idea of network governance. However, fragmentation can affect the effectiveness and legitimacy of participatory policies. Trying to handle fragmentation from the top, as many suggest, is unlikely to be successful. A more promising endeavour is to foster deliberative settings which, although positioned at the level of 'local' and often contingent networks and commonalities, are open to include 'Otherness' – other contexts, other problem definitions, other concerns. Structures of employment in low-wage industries, a diminished wage and hour inspectorate, and an unworkable immigration regime have combined to create an environment where violations of basic workplace laws are everyday occurrences. This article identifies four “logics” of detection and enforcement, arguing that there is a mismatch between the enforcement strategies of most federal and state labor inspectorates and the industries in which noncompliance continues to be a problem. In response, the authors propose augmenting labor inspectorates by giving public interest (...) groups like unions and worker centers a formal, ongoing role in enforcement in low-wage sectors. In three case studies, the authors present evidence of an emergent system—one that harkens back to a logic proposed by the drafters of the Fair Labor Standards Act but never implemented—of empowering those closest to the action to work in partnership with government. This article explores the interface between public deliberation and interest politics. It empirically examines how and when actors with vested interests support and oppose processes of direct citizen deliberation, such as citizens’ juries. An analysis of four cases finds that interest groups and activists respond to citizen deliberation in a variety of ways from cooperative engagement to disruptive disengagement. The research suggests that partisan actors are most likely to support citizens’ forums when the ideational and political context offers instrumental reasons (...) to go public. The article explores what this strategic approach to public deliberation implies for the practice and theory of deliberative democracy. (shrink)

In the light of a renewed interest today in forms of direct political participation, this paper explores the contributions of Sartre and Arendt to defending direct political action as an intrinsically valuable form of human freedom. Both thinkers note, however, that such forms of action and the 'spaces of freedom' in which they become possible are always fleeting and transitory. The paper argues that Sartre's account of the ways in which human action is always mediated and alienated by materiality is (...) important in accounting for this phenomenon. (shrink)

As some thinkers have sought in the concept of global civil society an ethically driven site of deliberation and even resistance, so others have criticized global civil society for its lack of legitimacy and representativeness. This article attempts to answer these criticisms ? at least in part ? by invoking a moral commitment to the value of justification. I argue that the idea of justification, when examined, offers us a particular understanding of legitimacy which would be attainable for global civil (...) society actors. The article begins by setting out the case for concern about the legitimacy of global civil society. I then outline a certain understanding of justification, showing how a commitment to this conception provides both a response to critics of global civil society and an ethical baseline for humane actors within global civil society. I move on to trace the significance of the moral relevance of justification for actors' strategies. Lastly, however, I highlight the difficulty of justification in a diverse world. This is to say that the issues of legitimacy and strategy facing global civil society are only made more tractable, not dissolved, by an appeal to the importance of justification. (shrink)

Associative Democracy has been developed as a specific response to statist socialism and neoliberal capitalism, drawing on older traditions such as associationalism, democratic socialism, and cooperative socialism. As the ‘real third way’, it is distinct from neoliberal privatization and deregulation in the Blair–Schröder varieties of social democracy and in the conservative Reagan–Thatcher–Cameron varieties. This article summarizes what seemed to make AD an attractive realist utopia: its combination of economic, societal and political democracy; its focus on democratic institutional pluralism in all (...) these regards; its considered moral/political minimalism; and its practical experimentalism. It recapitalizes some of the important economic, societal and political changes during the last decennia that seem to make AD plainly utopian again. It focuses on an outline of basic principles and institutions of socio-economic alternatives to capitalism because, if neoliberalism rules supreme, no viable alternatives can emerge and grow. Even if there is not one institutional design that fits all countries and contexts, we can show what the basic tenets of such alternatives are and how such a colourful democratic socialism relates to and can integrate other approaches such as ‘circular economy’, ‘foundational economy’ and ‘radical social innovation’. The hope is that AD’s broad institutional pluralism and its emphasis on practical experimentalism show new ways of thinking which are urgently needed for sustainable and socially fair economic development and for renewing representative democracy.
