In the Statesman, Plato seems to be advocating that in the absence of a true king who will rule independently of laws, the next best thing as far as just rule is concerned is to ad here rigidly to existing laws, whatever they are. The rule of the true king is given as an example of virtuous rule in the sense that virtue politics or jurisprudence holds that laws cannot always deal justly with particular cases. But Plato’s view of what (...) we must do when there are no true kings forthcoming seems to preclude a virtue theoretical understanding of politics and laws. In this paper I will investigate the view that the image of the true king, who relies on written laws for convenience only, provides a model for a more realistic appeal to virtue in jurisprudence, that is, a respect of laws that is compatible with equity, in the sense understood by Aristotle.Čini se da Platon u Državniku zagovara shvaćanje prema kojemu u odsutnosti istinskog kralja koji će vladati neovisno o zakonima druga najbolja stvar, što se tiče pravedne vladavine, jest strogo pridržavanje postojećih zakona, što god oni bili. Uloga istinskog kralja navodi se kao primjer vrle vladavine u tom smislu što politika ili jurisprudencija koje se zasnivaju na vrlini drže da zakoni ne mogu uvijek pravedno izlaziti na kraj s pojedinačnim slučajevima. No čini se da Platonovo shvaćanje toga što moramo činiti kada ne postoje istinski kraljevi sprječava razumijevanje politike i zakonâ koje se zasniva na teoriji vrline. U ovom članku ispitujem shvaćanje prema kojemu slika istinskog kralja, koji se na pisane zakone oslanja samo iz praktičnih razloga, pruža model za realističnije pozivanje na vrlinu u jurisprudenciji, to jest poštivanje zakonâ koje je spojivo s nepristranošću u onom smislu u kojem to razumije Aristotel. Platonic dialogues are self-concealing, presenting ideas by indirection or in riddling form, often exploring a difficulty or aporia without arriving at a solution. Since philosophers have begun to see Plato's work as imbued with irony, double meaning, and ambiguity, literary techniques that accommodate such layered meanings become a necessary adjunct to interpretation. The dialogue Politicus explores through an aporetic process a central Platonic concern, the relation between ideal and real. Close analysis of the important section dealing with law and constitutions (...) reveals some of the complexity. By his wayward conduct of the argument, the Eleatic stranger repeatedly forces reevaluation of earlier arguments or conclusions. At the close of the cosmic myth , the Stranger warned against confusing the divine monarch, a true shepherd, with his mortal counterpart, the best ruler, whose discovery is the aim of the dialogue. The distinction that was made then is simple in context, but complex in view of the conclusion at 303b8-c5 that the participants in all governments except the ideal monarchy are supreme wizards and fakers. The truly real statesman thus recedes into a distance remote from the world of practical politics, while the familiar regimes are marked as irretrievably flawed and inauthentic. The ability of the fake statesmen to deceive by impersonating the true king also means that it may be impossible to make the crucial distinction between king and tyrant, since either may disregard the laws. The strange fable of legalism run wild confirms the ludicrous and destructive results of rigid obedience to law, but concludes that rigidity is necessary to the false regimes. The corollary is that seekers after truth, like Socrates or even the Stranger himself, must always be rejected by law-based societies. (shrink)

This dissertation is a study of the relation between Aristotle’s ethics and the crafts (or technai). My thesis is that Aristotle’s argument is at key points shaped by models proper to the crafts, this shaping being deeper than is generally acknowledged, and philosophically more problematic. Despite this, I conclude that the arguments I examine can, if revised, be upheld. The plan of the dissertation is as follows – Preface: The relation of my study to the extant secondary literature; Introduction: The (...) pre-Platonic concept of technē, as evidenced in Greek philosophical and literary sources, in particular the early Hippocratic corpus; Chapter one: The Platonic concept of technē, followed by an investigation of whether Plato affirms a virtue-technē in the Protagoras and Republic; Chapter two: Aristotle’s concept of technē, followed by scrutiny of his arguments in NE VI.5 against a virtue-technē, and of his analyses of slavery and deliberation; Chapter three: An exposition of Aristotle’s function argument, followed by a dominantist interpretation of it, and an explanation of dominantism as in part a technē-influenced doctrine; Chapter four: An examination of Aristotle’s ethical mean and its problems, with a diagnosis of these in terms of influence by the Philebus, and by paradigms derived from the crafts; Chapter five: Argument that Aristotle’s theory of habituation suffers from two significant opacities, these being a function of influence both by the Republic, and by models of craft-learning; Conclusion: Response to key objection; Aristotle’s ethics revised, defended. Després del centre de El polític, dedicat a la justa mesura, el diàleg imposa el «retorn al polític» i ja no se separarà més d’aquesta comesa. Es procedirà, en primer lloc a depurar les arts concausants; després se separaran les diferents menes de servidors de la ciutat, per tal d’arribar a veure que els rivals del polític conformen un conjunt de difícil separació. Caldrà, abans de prosseguir amb la divisió, atendre als tipus de règim polític per veure quin paper hi (...) juga el saber polític. El resultat d’aquest primer moment del retorn al polític pren la figura de la descoberta dels fonaments de la ciutat. (shrink)

Llegados al final del periplo para definir al rey y al político, el Forastero y el joven Sócrates se encuentran en un callejón sin salida; no han podido determinar el perfil de cada uno de ellos. La narración del mito será la enmienda del método utilizado hasta ahora, i.e. la diéresis o división, que los ha llevado a una situación aporética. El Forastero muestra que se han cometido dos errores a lo largo del recorrido: el primero ha sido confundir lo (...) humano con lo divino; el segundo, de más envergadura, no establecer claramente la manera cómo el rey y el político podían ser el gobernante de la ciudad entera. Éste es uno de los pasajes más relevantes del Político de Platón, pues en él se realiza una reflexión sobre la naturaleza del error cometido. (shrink)
