Since conflicts of human rights can be translated into conflicts of values, this article looks into the sources and extension of value pluralism for a better understanding of the sort of conflicts of human rights that women face in multicultural contexts. Furthermore, a proper understanding of personal autonomy as a founding value underlying individual rights can contribute to an interpretation of women's human rights that takes account of both their untouchable core as well as their contextual meaning. As conflicts of (...) fundamental rights most often take place in a scenario of strong pluralism, the article considers cases of conflicts of rights in multicultural societies focusing on the overlapping values to be balanced. Religious freedom, education, neutrality, equality or toleration are some of the issues to be addressed: all of these are important and should be evaluated considering their further implications for women as well as for the other individuals involved. This article offers an alternative approach to multicultural theories, called ‘caring multiculturalism’. It argues that, despite good intentions, multicultural theory reproduces rhetoric that constructs groups as substantive entities, which leaves little room to accommodate changing power relations. Caring multiculturalism, drawing on caring ethics, feminist critiques of multiculturalism and discursive social psychology, advocates instead the contextualisation of groups’ claims to diversity and of governments’ practices of multiculturalism. As a framework rooted in discursive psychology, caring multiculturalism sees individual and collective identities as (...) relational, negotiated and political, and therefore non-totalising and changeable. As a feminist approach to multiculturalism, it analyses and attempts to change gendered power asymmetries embedded in intra- and intergroup relations by advocating an attentive and responsive approach to the needs and claims of minority groups and of the individuals within them. The article outlines the main tenets of caring multiculturalism with illustrations from multicultural practices in three European municipalities. (shrink)

Access to public healthcare services for Belgium’s undocumented migrants is regulated through a parallel, administrative procedure within the legal framework of Urgent Medical Aid. This imposes several constraints on their access to healthcare services. Drawing on empirical-ethical methodologies, we show how this procedure impacts on the relationship between patients with undocumented status and healthcare workers. We use the concept of relational autonomy to show how the imposed legal constraints reduce the formal treatment options available to healthcare workers, but simultaneously lead (...) to informal care practices, and how the latter increase the discretionary power of the healthcare workers. We argue that in this context, provision becomes unpredictable and arbitrary, with undocumented migrants tending to value strong personal relations with one particular, trusted healthcare worker. Although this leads to increased dependence, it also increases patients’ options and autonomy by providing access to wider professional networks attached to that healthcare worker. (shrink)
