Libertarians often rely on arguments that subordinate the principle of liberty to the value of its economic consequences. This invites the question of what a pure libertarian theory of justice—one that takes liberty as its overriding concern—would look like. Grotius's political theory provides a template for such a libertarianism, but it also entails uncomfortable commitments that can be avoided only by compromising the principle of liberty. According to Grotius, each person should be free to decide how to act as long (...) as her actions do not violate the equal liberty of others. According to this principle, however, people are free to enter any contract and alienate any rights, permitting even contracts of slavery or the alienation of rights of bodily integrity. Libertarians can escape this commitment to absolute freedom of contract only by adopting ad-hoc amendments to the principle of liberty. (shrink)

This paper reconstructs the conceptual foundations of Locke’s unilateralist theory of original appropriation through a critical comparison with the rival compact theories of Grotius and Pufendorf. Much of the normative and conceptual framework of Locke’s theory is common to theirs. Integrating his innovative doctrines on labour and natural self-proprietorship into this received theoretical framework logically required Locke to make several conceptual amendments. I highlight three all but overlooked revisions: (i) an unusually broad conception oflabour; (ii) a reduction of mere use-rights (...) toproperty rights; and (iii) a novel non-self-preservationist interpretation of thedivine authorizationto use natural resources in common. The reconceptualization of ‘labour’ is theoretically the most fundamental, underpinning the other two. My contextual reconstruction enhances our grasp of the structure of Locke’s theory of original appropriation. It also reveals Locke’s main objection to compact theories to be an external one, hinging on idiosyncratic conceptualizations of key notions. (shrink)

The paper contrasts Kant's conception of original common possession of the earth with Hugo Grotius's superficially similar notion. The aim is not only to elucidate how much Kant departs from his natural law predecessors—given that Grotius's needs-based framework very much lines in with contemporary theorists’ tendency to reduce issues of global concern to questions of how to divide the world up, it also seeks to advocate Kant's global thinking as an alternative for current debates. Crucially, it is Kant's radical shift (...) in perspective—from an Archimedean ’view from nowhere‘, to a first-personal standpoint through which agents reflexively recognise their systematic interdependence in a world of limited space—that provides him with the more thorough and ultimately convincing global standpoint. This standpoint does not come with ready-made solutions to shared global problems, but provides a promising perspective from which to theorise them. (shrink)
