Drawing on work from Marina Sbisà’s “Ideology and the Persuasive Use of Presupposition” (1999), Rae Langton has developed a powerful account of the subtle mechanisms through which hate speech and propaganda spread. However, this model has a serious limitation: it focuses too strongly on individual speech acts isolated from their wider context, rendering its applicability to a broader range of cases suspect. In this chapter, I consider the limits of presupposition accommodation to clarify the audience’s role in helping hate speakers, (...) and claim the necessary mechanisms are much more active and social than Langton suggests, with effects not capturable in the analysis of isolated speech acts. I revisit Sbisà’s work on presupposition and develop an alternative model that (1) improves upon the Langtonian model for explaining the power of hate propaganda, and (2) is more in line with Sbisà’s original approach to ideology and the normative aspects of presupposition. This paper advances an approach to relevance grounded on patterns of material inference called argumentation schemes, which can account for the reconstruction and the evaluation of relevance relations. In order to account for relevance in different types of dialogical contexts, pursuing also non-cognitive goals, and measuring the scalar strength of relevance, communicative acts are conceived as dialogue moves, whose coherence with the previous ones or the context is represented as the conclusion of steps of material inferences. Such inferences are described (...) using argumentation schemes and are evaluated by considering 1) their defeasibility, and 2) the acceptability of the implicit premises on which they are based. The assessment of both the relevance of an utterance and the strength thereof depends on the evaluation of three interrelated factors: 1) number of inferential steps required; 2) the types of argumentation schemes involved; and 3) the implicit premises required. Uptake and Conventionality in Illocution The aim of this paper is to put forward a new way of conceiving of the conventionality of illocutionary acts, grounded in a new look at Austin's original ideas. While the indispensability of uptake has correctly been deemed to be a hallmark of illocution, it has also been taken as evidence of the intention-based nature of illocutionary acts as opposed to their alleged conventionality. After discussing the readings of the "securing of uptake" offered by Strawson (...) and Searle and commenting on the consequently established divide between "communicative" and conventional speech acts, I claim that illocutionary acts are conventional, first of all, because they have conventional effects. I show that Austin took such effects to be essential to illocution and argue that the bringing about of conventional effects is bound up with the indispensability of uptake. (shrink)

I argue that the debates over which norm constitutes assertion can be abandoned by challenging the three main motivations for a constitutive norm. The first motivation is the alleged analogy between language and games. The second motivation is the intuition that some assertions are worthy of criticism. The third is the discursive responsibilities incurred by asserting. I demonstrate that none of these offer good reasons to believe in a constitutive norm of assertion, as such a norm is understood in the (...) literature. Others who have made similar arguments conclude that assertion does not exist at all—that there is no such thing as assertion. I disagree: we do not have to relinquish the category of assertion just because it is not normatively constituted. There are alternative ways to understand and individuate assertion that do not rely on a constitutive norm. (shrink)

In this paper, I develop a speech-act based account of presumptions. Using a score-keeping model of illocutionary games, I argue that presumptions construed as speech acts can be grouped into three illocutionary act types defined by reference to how they affect the state of a conversation. The paper is organized into two parts. In the first one, I present the score-keeping model of speech act dynamics; in particular, I distinguish between two types of mechanisms—the direct mechanism of illocution and the (...) indirect one of accommodation—that underlie the functioning of illocutionary acts. In the second part, I use the presented model to distinguish between the unilateral act of individual presumption, the point of which is to shift the burden of proof by making the hearer committed to justifying his refusal to endorse the proposition communicated by the speaker, whenever he refuses to endorse it, the bilateral act of joint presumption—‘bilateral’ in that it is performed jointly by at least two conversing agents—the function of which is to confer on the proposition endorsed by the speaker the normative status of jointly recognized though tentative acceptability, and the indirect or back-door act of collective presumption, the purpose of which is to sustain rules and practices to which the conversing agents defer the felicity of their conversational moves. In this paper, I present two tools that help shed light on deep disagreements and their epistemological consequences. First, I argue that we are best off construing deep disagreements as disagreements over conflicting understandings of certain concepts. More specifically, I suggest that deep disagreements are disagreements over how to understand concepts that play what Michael Friedman calls a “constitutive” role for speakers. Second, I argue that we need a better understanding of what speakers are doing when they engage in deep (...) disagreements—what speech acts they are carrying out. I show that we are best off not reducing the relevant speech acts to more familiar speech act kinds, such as assertions or imperatives. I argue that when a speaker articulates an understanding of a concept, they are in part carrying out an act of stipulation. I provide an account of the pragmatics of stipulation and apply the account to examples of deep disagreement. Focusing on the stipulative dimension of deep disagreement opens up, in turn, a novel approach to defusing the epistemological challenges such disagreement seems to pose. (shrink)

Generic claims like ‘women stay home and raise children’ and ‘boys don’t cry’ are normative generics: generic claims that express a norm. The truth conditions of normative generics are even harder to account for than those for more descriptive generics like ‘ducks lay eggs.’ Until recently, such generics were treated as deviant and thus not accounted for in standard accounts of generics. But recent work on the semantics and pragmatics of normative generics has changed that. In light of this recent (...) work, I propose that a speech act analysis of normative generics as instructions will shed light on normative generics. I end by discussing the ways in which this might allow us to use generics to counter harmful speech. (shrink)

The aim of the paper is to explore the interrelation between persuasion tactics and properties of speech acts. We investigate two types of arguments ad: ad hominem and ad baculum. We show that with both of these tactics, the structures that play a key role are not inferential, but rather ethotic, i.e., related to the speaker’s character and trust. We use the concepts of illocutionary force and constitutive conditions related to the character or status of the speaker in order to (...) explain the dynamics of these two techniques. In keeping with the research focus of the Polish School of Argumentation, we examine how the pragmatic and rhetorical aspects of the force of ad hominem and ad baculum arguments exploit trust in the speaker’s status to influence the audience’s cognition. What type of speech act is a norm of action, when the norm is agreed upon as the conclusion of an argumentative dialogue? My hypothesis is that, whenever a norm of action is the conclusion of an argument, it should be analyzed as the statement of a norm and thus as a verdictive speech act. If the context is appropriate, and the interlocutors are sincerely (or institutionally) committed to their argumentative exchange and its conclusion, then this verdictive motivates and institutes (...) a new one with the force of an exercitive. The interlocutors’ recognition and acceptance that the new illocution has been performed lends the norm its exercitive force. (shrink)

Internalism and Externalism in Speech Act Theory Internalism and externalism are related doctrines in the philosophy of language and mind, mostly centered on the role of reference in the individuation of propositions. This debate has recently been extended in speech act theory from content to force. But here the landscape becomes more complicated. It has been recently argued that speech act theory got off the track after Austin by internalizing Austin's "felicity" conditions. In reply it is noted that the issue (...) of internalism and externalism is more nuanced—there are internal and external elements in many theories, and a preliminary categorization is attempted here. Furthermore, internalism also has its virtues, which are largely overlooked, and we attempt to redress that imbalance. (shrink)

Speaker authority can spring into existence via accommodation mechanisms: a speaker acts as if they had authority and they can end up obtaining it if nobody objects. Versions of this claim have been advanced by Rae Langton, Ishani Maitra, Maciej Witek, and others. In this paper, I shift the focus from speaker to hearer authority. I develop a three-staged argument, according to which (i) felicity conditions for illocution can be recast in presupposition terms; (ii) just as certain illocutions require speaker (...) authority, there are also illocutions requiring hearer authority; (iii) accommodation may provide a way to confer authority to one’s audience, rather than gain it for oneself. Speakers sometimes act as if their hearer had authority, and the hearer can end up obtaining it solely by playing along. In closing, I pause on the potentially problematic interplay between informal authority conferral and social norms of female deference to men. (shrink)

In this chapter I deal with indirect reports in terms of language games. I try to make connections between the theory of language games and the theory of indirect reports, in the light of the issue of clues and cues. Indirect reports are based on an interplay of voices. The voice of the reporter must allow hearers to ‘reconstruct’ the voice of the reported speaker. Ideally, it must be possible to separate the reporter’s voice from that of the reported speaker. (...) When we analyze the language game of indirect reporting, we ideally want to establish which parts belong to the primary voice and which parts belong to the reporter’s voice. In this paper I apply considerations on language games by Dascal et al. and I explore the dialectics between abstract pragmatics principles and considerations about situated uses that are sensitive to cues and clues. The aim of this paper is to explore the viability of accounting for presumptions as a subtype of verdictives, within the framework of the Austinian approach to speech acts. The available set of felicity conditions is examined and worked out, in order to try and account in particular for a main feature of presumptions, namely, their function in shifting the burden of proof. Speech Acts, Criteria and Intentions What makes a speech act a speech act? Which are its necessary and sufficient conditions? I claim in this paper that we cannot find an answer to those questions in Austin's doctrine of the infelicities, since some infelicities take place in fully committing speech acts, whereas others prevent the utterance from being considered as a speech act at all. With this qualification in mind, I argue against the idea that intentions—considered as mental states accomplishing a (...) causal role in the performance of the act—should be considered among the necessary conditions of speech acts. I would thus like to deny a merely ‘symptomatic’ account of intentions, according to which we could never make anything but fallible hypotheses about the effective occurrence of any speech act. I propose an alternative ‘criterial’ account of the role of intentions in speech acts theory, and analyse Austin's and Searle's approaches in the light of this Wittgensteinian concept. Whether we consider, with Austin, that speech acts ‘imply’ mental states or, with Searle, that they ‘express’ them, we could only make sense of this idea if we considered utterances as criteria for intentions, and not as alleged behavioural effects of hidden mental causes. In my paper, I present two competing perspectives on the foundational problem (as opposed to the descriptive problem) of quantifier domain restriction: the objective perspective on context (OPC) and the intentional perspective on context (IPC). According to OPC, the relevant domain for a quantified sentence is determined by objective facts of the context of utterance. In contrast, according to IPC, we must consider certain features of the speaker’s intention in order to determine the proposition expressed. My goal is to offer (...) a plausible and fair reconstruction of IPC. Drawing a parallel between quantifier domain restriction and standard cases of context dependence as indexicality, I argue that the speaker’s intentions can play a semantic role only if they satisfy an Availability Constraint: an intention must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective context (words, gestures, relevance or uniqueness of either the quantificational domain or of the referent in the context of utterance). An intention satisfying the Availability Constraint must be something that a hearer in normal circumstances is able to work out by relying on the physical surroundings of the utterance situation, on utterances exchanged during the previous conversation, and on background knowledge shared by speaker and addressee. Within the Gricean framework in pragmatics, communication is understood as an inferential activity. Other approaches to the study of linguistic communication have contended that language is argumentative in some essential sense. My aim is to study the question of whether and how the practices of inferring and arguing can be taken to contribute to meaning in linguistic communication. I shall suggest a two-fold hypothesis. First, what makes of communication an inferential activity is given with its calculability, i.e. with the possibility (...) to rationally recover the assigned meaning by means of an explicit inference. Secondly, the normative positions that we recognize and assign each other with our speech acts comprise obligations and rights of a dialectical character; but this fact does not entail nor presuppose an argumentative nature in language or speech. Both inferring and arguing are needed, however, in the activity of justifying and assessing our speech acts. (shrink)

Interpreting the force of an utterance, be it an assertion, command, or question, remains a task for achieving this goal. But it is not an easy task. An interpretation of force depends on a speaker’s use of words for a hearer at the moment of utterance. Ascribing force relies on grammatical mood, though not in a straightforward or regular way. We face a dilemma: on one hand, deciding force requires an (...) understanding of the speaker’s words; on the other hand, word meaning may shift given the force in which the words are spoken. A precise theory of how mood and force relate helps us handle this dilemma, which, if met, expands the use of argumentation schemes in language processing. Yet, as our analysis shows, force is an inconstant variable, one that contributes to a scheme’s defeasibility. We propose using critical questions to help us decide the force of utterances. (shrink)

This dissertation fits within the literature on subordinating speech and aims to demonstrate that how language subordinates is more complex than has been described by most philosophers. I argue that the harms that subordinating speech inflicts on its targets (chapter one), the type of authority that is exercised by subordinating speakers (chapters two and three), and the expansive variety of subordinating speech acts themselves (chapter three) are all under-developed subjects in need of further refinement—and, in some cases, large paradigm shifts. I also examine cases that have yet to be adequately addressed by philosophers working on this topic, like the explosion of abusive speech online (chapter four) or the distinctive speech acts of protest groups (chapter five). I argue that by considering these alongside the ‘paradigm’ cases of subordinating speech that inform most models, we are better able to capture the lived realities of this phenomena, as described by members of groups targeted by such speech. I develop a novel account of speaker authority to explain the variety of pragmatic effects subordinating speech generates. Instead of seeing this authority as reducible to either a formal position or a merely local, linguistic phenomenon, I argue for a conception of speaker authority that is a richly contextual social fact, distributed unevenly among members of different social groups. I also develop an account of collective authority that explains how a group of speakers can join together to subordinate in a way that no individual speaker is capable of doing. This account, I argue, is better able to explain the social reality of subordinating speech than individualist models. Overall, I show how a more fine-grained account of subordinating speaker authority gives us a more accurate picture of the different subordinating speech acts available to different speakers, along with how these may harm their targets. My aim in this paper is to provide a conceptual elucidation of the notion of constitutive normativity, which is central to Constitutivism as a first-order theory of agency, as well as to its metanormative ambitions. After introducing and clarifying the origins and scope of Constitutivism (Section 2), I focus on Christine M. Korsgaard’s version thereof (Section 3), which provides an explicit articulation of the notion of constitutive norms. Despite Korsgaard’s explicit acknowledgement that the concepts of action and agency come in (...) degree, one problematic consequence of her account is the tension between the simultaneously descriptive and normative character of constitutive norms (their double nature), and another component of Korsgaard’s constitutivist account (her Authorship View). Cases of a specific variety of “disorders of agency” are used to show that while an agent’s individual actions might fail to display Korsgaard’s required pattern of consistency, self-reflection, and self-unification (and often, morality), her agency does not fade nor is disrupted (Section 4). After discussing those cases, I suggest that Korsgaard’s acknowledgement that the notions of action and agency come in degree and her relational notion of responsibility be strengthened via the adoption of a thorough interactionist and scalar approach. While for Korsgaard the constitutive norms governing agency amount to the norms governing practical reasoning and morality, I contend that the constitutive normativity pertaining to human agency is not ‘homogeneous’ in kind: there are more norms governing agency than just the norms for practical reasoning—and, in particular, that agency necessarily involves social norms distinct from any notion of practical reasoning. I draw on a theoretical framework on the metaphysics of normativity developed within the philosophy of biology to distinguish two varieties of constitutive normativity (socially-generated and non-practice-based) (Section 5), and provide a preliminary articulation of the socially-generated constitutive normativity inspired by the speech-act-theoretical account of the performative dimension of language (Section 6). The thesis that law necessarily claims authority is popular amongst legal philosophers. Some distinguished legal philosophers, including the late John Gardner, Joseph Raz and Scott Shapiro, have suggested that support for this thesis is found in legal officials’ use of deontic language. This article begins by considering the merits of this suggestion. I discuss two unpromising arguments for the claim thesis based on the use of deontic language in law. I then suggest that a more plausible basis for the claim (...) thesis lies in the felicity conditions of the speech acts that legal officials perform. In the absence of an explicit claim to authority, legal officials make a presupposition to authority over their subjects. The presupposition arises from interaction between the felicity conditions of legal speech acts and basic norms of cooperative communication. I consider some implications of this conclusion for our understanding of legal authority. (shrink)

The many faces of speech act theory — editorial to special issue on speech actions.

[ENG] The aim of this paper is to analyze the „possibility puzzle” presented by Shapiro (2011) in the context of the debate between conventionalism and non-conventionalism in speech act theory. Conventionalism claims that for every speech act there is a pattern (convention) which determines its illocutionary force. To perform a felicitous speech act is to fulfil necessary and sufficient conditions for this particular speech act. Non-conventionalism criticizes the view that for every speech act there is a conventional pattern and hidden (...) conditions, which are to be fulfilled. This view maintains the conventional thesis for the so-called strict conventional speech acts (e.g. performatives), but negates using universal quantifier for so-called communicative speech acts whose aim is, in short, to express an intention and force someone to act by virtue of this intention. As in (Shapiro 2011), Phil said: in order for someone to have the power to make, change and apply rules, there has to be a rule that empowers someone to do so. This objection concerned „The First Legis- lator” only from the conventional perspective on speech acts. If it can be maintained that The First Legislator’s speech acts may be non-conventional, then Phil’s argument misses the point. Finally, I will emphasize that only lawyers analyze „the very first speech acts” whereas for philosophers, the problem of e.g. „the very first question” is less absorbing. -/- [PL] Celem niniejszego artykułu jest przedstawienie tak zwanej Aporii Phila (possibility puz- zle) przedstawionej przez Shapiro (2011) w kontekście sporu konwencjonalizm–nonkon- wencjonalizm w teorii aktów mowy. Konwencjonalizm utrzymuje, że dla każdego aktu mowy istnieje konwencja, która determinuje moc illokucyjną aktu. Wykonać w pełni for- tunny akt mowy to spełnić wystarczające i konieczne warunki określone dla danego aktu mowy. Nonkonwencjonalizm krytykuje pogląd, że dla każdego aktu mowy istnieje okre- ślona konwencja oraz ukryte warunki, które należy spełnić. Ten pogląd utrzymuje kon- wencjonalną tezę dla tak zwanych stricte konwencjonalnych aktów mowy (na przykład performatywów), ale neguje użycie dużego kwantyfikatora dla tak zwanych komunika- cyjnych aktów mowy, których celem jest, w skrócie, wyrażenie pewnej intencji i zmusze- nie kogoś poprzez jej wyrażenie do określonego postępowania. Phil, bohater historii z książki Shapiro (2011), podkreślił, iż zawsze musi istnieć reguła upoważniająca do two- rzenia prawa. Ten zarzut dotyczący „Pierwszego Legislatora” jest zasadny tylko z per- spektywy konwencjonalizmu. Jeżeli można utrzymywać, że akt mowy Pierwszego Legislatora może być nonkonwencjonalny, wtedy argument Phila jest nietrafny. Na końcu scharakteryzowany jest następujący fenomen: tylko prawnicy analizują „pierwsze akty mowy”, natomiast dla filozofów problem „pierwszego pytania” nie jest tak absorbujący. (shrink)

In this paper, I claim that even though the conventional account of illocution (Sbisà, in Lodz Pap Pragmat 5(1):33–52, 2009a; In: B Fraser, K Turner (eds) Language in life, and a life in language. Emerald, pp 351–357, 2009b) makes an attempt to theorize social relations in illocutions, the attempt is unsuccessful. Sbisà's conventional account fails to describe the ways in which a fair social agreement can be established. A fair social agreement is a key element for the idea of social (...) relations in the conventional account of illocution. However, considering the role of gender and power relations embedded in social construction, it is difficult to accept the possibility of such an agreement. Since Sbisà fails to provide a probe into power relations, her attempt to establish the point of social relationships remains insufficient. The main argument here is that in the unjust social milieu, the kind of social agreement essential to illocution is difficult. Moreover, what may look like a social agreement might be a result of the systemic oppression done to one particular group. In what follows, I claim that the problem of theorizing the social relation in illocutions remains unresolved. (shrink)

Speech acts and the autonomy of linguistic pragmatics This paper comments on selected problems of the definition of linguistic pragmatics with a focus on notions associated with speech act theory in the tradition of John Langshaw Austin. In more detail it concentrates on the relevance of the use of the Austinian categorisation into locution, illocution, and perlocution in locating a divide in between pragmatics and semantics, and especially the distinction between the locutionary act and the illocutionary act and its implications (...) for the definition of pragmatics and its separation from the semantic theory.The relation between form and meaning is further briefly reviewed against dichotomies including the Gricean and neo-Gricean ‘what is said’ versus ‘what is implicated’ or meant, between what can be ‘locuted’, but not said, and what can be said, but not asserted. These dichotomies are related to the theoretical commitments as to the accepted operative forces in speech acts, primarily convention and intention. It is suggested that, roughly, the development of the speech act theory can be viewed as a process by which the theory moves away from its originally sociolinguistic orientation towards a more psychologistic account, which in turn leads towards diminishing the role of semantics and the subsequent juxtaposition of pragmatics and syntax rather than pragmatics and semantics.
