Using persuasive definitions and persuasive language generally to put a spin on an argument has often held to be suspicious, if not deceptive or even fallacious. However, if the purpose of a persuasive definition is to persuade, and if rational persuasion can be a legitimate goal, putting forward a persuasive definition can have a legitimate basis in some cases. To clarify this basis, the old subject of definitions is reconfigured into a new dialectical framework in which, it is argued, a (...) definition should be evaluated in light of its purpose as a speech act. But if persuasive definitions are so often thought to be suspect, misleading, or even fallacious, how can individual cases be judged on some objective basis? In this paper, a new dialectical method of evaluating such definitions on a case-by-case basis is proposed, showing how abusive as well as reasonable uses of persuasive language can properly be identified, analyzed and evaluated. “Is every definition persuasive?” If essentialist views on definition are rejected and a pragmatic account adopted, where defining is a speech act which fixes the meaning of a term, then a problem arises: if meanings are not fixed by the essence of being itself, is not every definition persuasive? To address the problem, we refer to Douglas Walton’s impressive intellectual heritage—specifically on the argumentative potential of definition. In finding some non-persuasive definitions, we show not every definition is persuasive. The persuasiveness (...) lies not in syntactic or semantic properties, but the context. We present this pragmatic account and provide rules for analysing and evaluating persuasive definition—a promising direction for further research. (shrink)

The classification of a state of affairs under a legal category can be considered as a kind of con- densed decision that can be made explicit, analyzed, and assessed us- ing argumentation schemes. In this paper, the controversial conflict of opinions concerning the nature of “marriage” in Obergefell v. Hodges is analyzed pointing out the dialecti- cal strategies used for addressing the interpretive doubts. The dispute about the same-sex couples’ right to marry hides a much deeper disa- greement not only (...) about what mar- riage is, but more importantly about the dialectical rules for defining it. This paper examines how ethically significant assumptions and values are embedded not only in environmental policies but also in the language of the environmental sciences. It shows, based on three case studies associated with contemporary pollution research, how the choice of scientific categories and terms can have at least four ethically significant effects: influencing the future course of scientific research; altering public awareness or attention to environmental phenomena; affecting the attitudes or behavior of key decision makers; and changing the burdens (...) of proof required for taking action in response to environmental concerns. The paper argues that deliberative forums, research-ethics training, and conceptual work by environmental philosophers could all promote more ethically sensitive responses to these features of scientific language. The aim of the article is to defi ne a certain type of argumentation, which has been scarcely described so far in either Polish or foreign literature in the fi eld of argumentation theory, and thus to systematize the problems of research on semantic procedures in argumentation. The analysis of the ways in which a modifi cation of meaning can affect the power of arguments inclines to distinguish a new type of argumentation - semantic argumentation. The concepts of persuasive defi (...) nition and classifi cation as well as methods of their application in the formulation of an argument will also be analyzed. The defi nition of semantic argumentation proposed here may give rise to some problems, typical when introducing a new concept, which is why the second part of the article is devoted to the issues related to the proposed shape of the defi nition. The defi nition is necessary for further research on semantic argumentation, its typology and for the assessment of its correctness. (shrink)
