Many think that a specific aspect of phenomenal consciousness—valenced or affective experience—is essential to consciousness’s moral significance (valence sentientism). They hold that valenced experience is necessary for well-being, or moral status, or psychological intrinsic value (or all three). Some think that phenomenal consciousness generally is necessary for non-derivative moral significance (broad sentientism). Few think that consciousness is unnecessary for moral significance (non-necessitarianism). In this paper, I consider the prospects for these views. I first consider the prospects for valence sentientism in (...) light of Vulcans, beings who are conscious but without affect or valence of any sort. I think Vulcans pressure us to accept broad sentientism. But I argue that a consideration of explanations for broad sentientism opens up possible explanations for non-necessitarianism about the moral significance of consciousness. That is, once one leans away from valence sentientism because of Vulcans, one should feel pressure to accept a view on which consciousness is not necessary for well-being, moral status, or psychological intrinsic value. Most philosophers think that phenomenal consciousness underlies, or at any rate makes a large contribution, to moral considerability. This paper argues that many such accounts invoke question-begging arguments. Moreover, they’re unable to explain apparent differences in moral status across and within different species. In the light of these problems, I argue that we ought to take very seriously a view according to which moral considerability is grounded in functional properties. In this paper, we outline how one might conduct a comprehensive ethical evaluation of human brain organoid transplantation in animals. Thus far, ethical concerns regarding this type of research have been assumed to be similar to those associated with other transplants of human cells in animals, and have therefore not received significant attention. The focus has been only on the welfare, moral status, or mental capacities of the host animal. However, the transplantation of human brain organoids introduces several new ethical (...) issues. Many of these are related to uncertainty regarding whether or not brain organoids might be conscious. While these concerns might not be immediately relevant, they warrant closer scrutiny. We discuss how various ethical issues are relevant to different stages of human brain organoid transplantation and can guide the ethical evaluation of research. Our examination would broaden the horizons of the debate on the transplantation of brain organoids. (shrink)

Advances in research on human cerebral organoids (HCOs) call for a critical review of current research policies. A challenge for the evaluation of necessary research regulations lies in the severe uncertainty about future trajectories the currently very rudimentary stages of neural cell cultures might take as the technology progresses. To gain insights into organotypic cultures, ethicists, legal scholars, and neuroscientists rely on resemblances to the human brain. They refer to similarities in structural or functional terms that have been established in (...) scientific practice to validate organotypic cultures as models for brain research. In ethical discourse, however, such similarities are also used to justify assumptions about the potential risk to cause harm to HCOs. Ethicists assume that as the technology advances, organotypic cultures will increasingly resemble the human brain, raising more complex ethical issues. I argue that such reasoning is not justified given the heterogeneity of HCOs that have been modified to enable scientists to pursue their research goals. I then discuss the implications this line of thought has for advocates of the precautionary principle, focussing on those suggestions which propose adopting research regulations to the presence of bodily warning signs deemed worthy of protection. In doing so, I illustrate that the prevalent assumptions on similarity in ethical discourse ultimately risk disproportionately restricting research. I conclude that given the severe uncertainty about the technology’s future development, ethical discourse might benefit from narrowing the time frame for anticipation. (shrink)

Folk psychology's usefulness extends beyond its role in explaining and predicting behavior, i.e., beyond the intentional stance. In this paper, I critically examine the concept of phenomenal stance. According to this idea, attributions of phenomenal mental states impact laypeople's perception of moral patiency. The more phenomenal states we ascribe to others, the more we care about their well-being. The perception of moral patients—those affected by moral actions—is hypothesized to diverge from the perception of moral agents, those who perform moral actions. (...) Despite its appeal, especially considering its exploration of the established relationship between folk psychology and moral cognition, the idea of the phenomenal stance faces significant challenges. It relies on laypeople recognizing the phenomenality of experience, yet experimental philosophy of consciousness suggests that there is no folk concept of phenomenal consciousness. Moreover, proponents of the phenomenal stance often conflate phenomenal states with emotional states despite the existence of both non-emotional conscious states and, arguably, non-conscious emotional states. Additionally, attributions of conscious mental states impact the perception of both moral agency and patiency. I report on experimental results indicating that some of these attributions lower the perceived moral patiency. Besides providing reasons to reject the idea of the phenomenal stance, I argue that the perception of moral patiency is guided by attributions of affective states (affects, emotions, moods). I call such attributions the affective stance and explore this concept’s relationship with empathy and other psychological concepts. (shrink)

An ethical and legal framework is needed to regulate the rapidly developing human brain organoid research field properly. However, considering the legal issues involved in human brain organoid research remains underdeveloped and scattered. This article reviews the legal issues of human brain organoid research, grouping them into the following five broad themes: (1) consciousness, (2) legal status, (3) consent, (4) ownership, and (5) transplantation. The issues in each topic include both the urgent (e.g., appropriate forms of consent) and the speculative (...) (e.g., protection of conscious human brain organoids). Therefore, we have attempted to be as explicit as possible about the timescale within which each issue will be realized and to prioritize each. Examining these issues has revealed legal issues specific to human brain organoid research and issues common to research in other fields. Further discussion of human brain organoid research from a legal perspective is needed in the future, considering discussions in related fields. (shrink)

Intuitively, there is a close link between moral status and phenomenal consciousness. Taking the link seriously can serve as the basis of a proposal that appears to have a surprising number of theoretical benefits. This proposal is the moral option, according to which moral status is partly determinative of phenomenal consciousness, and phenomenal consciousness is sufficient for possession of a moral property I refer to as “moral status.” I argue for this view on the basis of its ability to shed (...) light on the distribution problem of determining which systems are phenomenally conscious. I explicate it by drawing on a theory of attributions of phenomenal consciousness, and considering its relationship to positions on the metaphysics of consciousness. I defend it against a series of objections, including three based on previous theories of the link between phenomenal consciousness and moral status. The moral option should, in my view, be a serious contender among theories of phenomenal consciousness. (shrink)

Welfare subjectivists face a dilemma. On the one hand, traditional subjectivist theories—such as the desire-fulfillment theory—are too permissive to account for the well-being of typical mature human beings. On the other hand, more “refined” theories—such as the life-satisfaction theory—are too restrictive to account for the well-being of various welfare subjects, including newborns, those with profound cognitive impairments, or non-human animals. This paper examines a class of welfare subjectivism that addresses this dilemma with sensitivity to the diversity in welfare subjects. First, (...) the most-sophisticated-attitude view (MSA) is introduced. MSA holds that an object, $$x$$ x, is good for a subject, $$S$$ S, in proportion to the strength of $$S$$ S ’s pro-attitude towards $$x$$ x if and only if the pro-attitude at issue is $$S$$ S ’s most sophisticated type. Typically, the well-being of typical mature human beings is assessed in terms of one’s authentic whole-life satisfaction, whereas that of human newborns is assessed in terms of something less sophisticated such as pleasure. MSA offers the rationale for this difference based on an underexplored version of perfectionism: procedural perfectionism. Next, provided that MSA may involve an implausibly strong claim, this paper examines two moderate variations of MSA that accept the partial relevance of less sophisticated types of valenced attitude.
