Kant’s criticism of democracy has been traditionally defused with the consideration that Kant’s aversion is not to democracy per se, but to direct democracy. However, what Kant says – ‘to prevent the republican constitution from being confused with the democratic one, as commonly happens’ (ZeF, 8: 351) – appears to count not only against direct democracy, but also against conceptions of democracy closer to the ones we are accustomed to. By offering a new account of what Kant sees as the (...) real problem of democracy (direct or not), the article unpacks a lesson about the limits of democracy that has gone largely unnoticed among political theorists and Kant specialists. To address this issue, most accounts of Kant’s political philosophy concentrate on his explicitly political texts that cluster around the second and third Critiques. Although many of these interpretations illuminate different aspects of Kant’s political philosophy, they are silent with regard to a concept of publicness that is implied in (...) the first Critique. This article suggests that Kant’s critical method of metaphysics implies a disciplinary conception of publicness, which is foundational for his political philosophy. It demonstrates how this conception of publicness can be found in the Doctrine of Method of the first Critique, more specifically, in Kant’s argument that all acts of reason must be subjected to the discipline of pure reason. Kant does not completely work out his philosophical conception of enlightenment. The definition of enlightenment that he offers in his well-known essay on the topic does not seem to completely match the definition that he puts forward later in his essay on the pantheism controversy and in the third Critique. It remains unclear how the two definitions relate to each other and whether and how they rest on the same principle. The lack of clarity in Kant’s conception of enlightenment is (...) left mostly unaddressed in the secondary literature on the topic. This paper suggests that Kant’s philosophical conception of enlightenment rests on the discipline of pure reason. The self-disciplinary principle of reason, which is laid out in the Doctrine of Method of the first Critique, underlies both of Kant’s definitions of enlightenment, although he himself does not clearly demonstrate how it does so. This paper argues that Kant’s concept of ‘respect’ for the moral law has roots in Adam Smith’s concept of ‘regard’ for the general rules of conduct, which was translated as Achtung in the first German translation of the Theory of Moral Sentiments. After illustrating that Kant’s technical understanding of respect appeared relatively late in his intellectual development, I argue that Kant’s concept of respect and Smith’s concept of regard share a basic similarity: they are both a single complex phenomenon with (...) two core aspects, namely an attitude and a feeling. I then suggest that the concept of regard offered Kant a way to deal a problem concerning moral motivation that he was trying to solve at the time he likely first read Smith. I conclude by drawing some implications from the account I have offered for our understanding of Kant’s relation to Smith more generally. (shrink)

This paper reorients the problematic of political epistemology to put power at the centre of analysis, through an analysis of writings on the relationship between power and knowledge by Horkheimer, Habermas and Foucault. In their work, political epistemology was pursued analogously to the development of political economy, which explored the background conditions and assumptions of economic research. I also show that Horkheimer, Habermas and Foucault each had normative aims intended to improve both epistemology and knowing practices. Resumen En este artículo defiendo la postura según la cual el republicanismo -en comparación con otras nociones o motivos centrales- no se ha interpretado como uno de los rasgos que caracteriza a la filosofía jurídica y política de Kant como un todo. Una posible razón es que el republicanismo kantiano no ha ocupado un lugar destacado dentro de las narrativas republicanas, ya sea históricas o sistemáticas, que son más dominantes en las discusiones contemporáneas. A mi parecer, esto es así porque (...) hay características innovadoras en la empresa republicana kantiana que se encuentran en tensión con otros proyectos republicanos de otra índole. Aquí discuto algunos de los rasgos distintivos del proyecto de Kant en lo que atañe a concepciones suyas sobre el estado de derecho, la ciudadanía, la autoridad política, la libertad de expresión y el derecho internacional, con el fin de señalar que estas son parte integral de una teoría política y legal que todavía es atractiva y sugerente.In this paper, I defend the stance that republicanism -in comparison to other central notions- has not been interpreted as one of the main traits that characterize Kant’s legal and political philosophy. A plausible reason for this is that Kantian republicanism has not occupied a prominent place in the republican narratives, historiographical or systematic, that are dominant in contemporary discussions. To my mind, the reason for this is that some innovative characteristics in the Kantian republican enterprise are at odds with other republican philosophical projects. Here I discuss some distinctive traits of Kant’s project regarding his conceptions of the rule of law, citizenship, political authority, free speech, and international law with the aim of showing that they are an integral part of a political and legal theory that is still attractive and compelling. Nach einem weit verbreiteten Urteil gibt Kant der Ökonomie in seinem Werk keinen nennenswerten Raum. Die vorliegende Studie widerlegt dies, indem sie Kants Äußerungen zu ökonomischen Themen systematisiert: zur Selbstständigkeit, zum Kaufmann, zum Handel, zum Geld, zur „Staatswirthschaft" sowie zum technischen Fortschritt. Sie erschließt Kants Ökonomie aus der Ergänzung rechtlicher und ethischer Pflichten durch deren anthropologische Ausführungsbedingungen. Dabei geht sie aus von einem zeitgenössischen Verständnis der Ökonomie als Wissenschaft vom Wohlstand. Im deutschsprachigen Raum des 18. Jahrhunderts konkurrieren hier drei Paradigmen (...) miteinander: das aristotelische, das smithianische und das kameralistische. Sie identifizieren jeweils das Haus, den Markt oder den Staat als zentrale Handlungssphäre der Ökonomie. Die Studie kommt zu dem Schluss, dass Kants praktische Philosophie für Ergänzungen aus jeder dieser ökonomischen Handlungssphären offen ist, solange diese freiheitliche Prinzipien erfüllen; sie ist damit nicht, wie gelegentlich behauptet, auf eine einzige Wirtschaftsordnung festgelegt, etwa auf eine rein marktliberale. Relevant ist dies für die Kant-Forschung, für die Wirtschaftsphilosophie sowie für die Ideengeschichte. (shrink)

Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre, 1797 als erster Teil der Metaphysik der Sitten erschienen, stellen einen Beitrag zur neuzeitlichen Rechts- und Staatsphilosophie dar. Hinsichtlich der normativen Prinzipien von Recht und Staat entwickelt Kant eine erfahrungsunabhängige, insofern metaphysische Theorie. Sie beginnt mit einem angeborenen und unveräußerlichen Menschenrecht und geht dann zu den Institutionen des Eigentums und des Rechtsstaates über. Besonders aktuell ist die Formulierung eines rechts- und friedensfunktionalen Völkerrechts und eines Weltbürgerrechts. Darüber hinaus behandelt Kant auch das Ehe und Familienrecht, (...) das Verhältnis von Staat und Kirche und das Straf- und Begnadigungsrecht. Durch den thematischen Reichtum und die begriffliche Genauigkeit, vor allem jedoch durch die Radikalität seiner Fragen und die Originalität der Antworten ist Kants Rechtsdenken bis heute von hohem systematischem Rang. Die elf Beiträger dieses kooperativen Kommentars, der anlässlich des 300. El presente artículo propone pensar un modo de articulación de los dominios teórico y práctico de la filosofía crítica de Kant a partir de los diferentes tipos de operaciones sintéticas de la subjetividad (esquema, analogía y típica) que cada una de las dos primeras críticas ponen en juego. Se sostiene que el dominio teórico obtiene su caracterización a partir de las operaciones sintéticas de carácter esquemático, y que el dominio práctico la obtiene, por su parte, a partir de dos tipos (...) de operaciones sintéticas: primero, de la analogía en tanto que simulación práctica que regula el dominio teórico (KrV), y segundo, de la típica del juicio práctico en la que, por medio de síntesis de lo heterogéneo, el sujeto se abre a una determinación suprasensible que excede sus meras potencialidades naturales (KpV).
