Immanuel Kants Metaphysische Anfangsgründe der Rechtslehre, 1797 als erster Teil der Metaphysik der Sitten erschienen, stellen einen Beitrag zur neuzeitlichen Rechts- und Staatsphilosophie dar. Hinsichtlich der normativen Prinzipien von Recht und Staat entwickelt Kant eine erfahrungsunabhängige, insofern metaphysische Theorie. Sie beginnt mit einem angeborenen und unveräußerlichen Menschenrecht und geht dann zu den Institutionen des Eigentums und des Rechtsstaates über. Besonders aktuell ist die Formulierung eines rechts- und friedensfunktionalen Völkerrechts und eines Weltbürgerrechts. Darüber hinaus behandelt Kant auch das Ehe und Familienrecht, (...) das Verhältnis von Staat und Kirche und das Straf- und Begnadigungsrecht. Durch den thematischen Reichtum und die begriffliche Genauigkeit, vor allem jedoch durch die Radikalität seiner Fragen und die Originalität der Antworten ist Kants Rechtsdenken bis heute von hohem systematischem Rang. Die elf Beiträger dieses kooperativen Kommentars, der anlässlich des 300. Kant-Jubiläums in einer 3., überarbeiteten Auflage erscheint, nehmen die bleibend gültigen Provokationen der „Metaphysischen Anfangsgründe" ernst. Kant’s writings on political philosophy do not clearly and conclusively determine its place and significance in his critical philosophy. To address this issue, most accounts of Kant’s political philosophy concentrate on his explicitly political texts that cluster around the second and third Critiques. Although many of these interpretations illuminate different aspects of Kant’s political philosophy, they are silent with regard to a concept of publicness that is implied in (...) the first Critique. This article suggests that Kant’s critical method of metaphysics implies a disciplinary conception of publicness, which is foundational for his political philosophy. It demonstrates how this conception of publicness can be found in the Doctrine of Method of the first Critique, more specifically, in Kant’s argument that all acts of reason must be subjected to the discipline of pure reason. This paper argues that Kant’s concept of ‘respect’ for the moral law has roots in Adam Smith’s concept of ‘regard’ for the general rules of conduct, which was translated as Achtung in the first German translation of the Theory of Moral Sentiments. After illustrating that Kant’s technical understanding of respect appeared relatively late in his intellectual development, I argue that Kant’s concept of respect and Smith’s concept of regard share a basic similarity: they are both a single complex phenomenon with (...) two core aspects, namely an attitude and a feeling. I then suggest that the concept of regard offered Kant a way to deal a problem concerning moral motivation that he was trying to solve at the time he likely first read Smith. I conclude by drawing some implications from the account I have offered for our understanding of Kant’s relation to Smith more generally. (shrink)

Der Kommentar zur Kritik der reinen Vernunft bietet eine textnahe Erschließung der zentralen Begriffe, Thesen und Argumentationsgänge von Kants Hauptwerk auf aktuellem Forschungsstand. Es ist der erste Kommentar zur KrV, der den gesamten Text in der Fassung der ersten und zweiten Auflage gleichmäßig und lückenlos berücksichtigt. Davon profitieren vor allem die „Transzendentale Dialektik“ und die „Methodenlehre“, die in früheren Gesamtkommentaren meist nicht hinreichend berücksichtigt worden sind. Die Beiträge wurden nach einheitlichen Richtlinien verfasst, wobei unterschiedliche Herangehensweisen und Interpretationsansätze zur Geltung kommen. (...) Um dem Leser dieses Kommentars die Orientierung zu erleichtern, ist jeder Beitrag in drei bzw. vier Teile untergliedert: Der erste Teil behandelt die Stellung und Funktion des kommentierten Textabschnitts in der KrV, der zweite Teil gibt einen Überblick über Inhalt und Aufbau des Abschnitts, der dritte Teil enthält den eigentlichen Textkommentar. Wo dies sinnvoll erschien, wurden in einem vierten Teil wichtige Interpretationsfragen angesprochen. Hinweise auf weiterführende Spezialliteratur am Ende eines jeden Beitrags, eine Auswahlbibliographie zu Kant und zur Kritik der reinen Vernunft sowie ein Namen- und ein Sachregister machen den Band zu einem komfortablen Arbeitsmittel für den Benutzer. Kant’s criticism of democracy has been traditionally defused with the consideration that Kant’s aversion is not to democracy per se, but to direct democracy. However, what Kant says – ‘to prevent the republican constitution from being confused with the democratic one, as commonly happens’ (ZeF, 8: 351) – appears to count not only against direct democracy, but also against conceptions of democracy closer to the ones we are accustomed to. By offering a new account of what Kant sees as the (...) real problem of democracy (direct or not), the article unpacks a lesson about the limits of democracy that has gone largely unnoticed among political theorists and Kant specialists. Zu einer der vordringlichsten, von der Philosophie aber häufig vernachlässigten Aufgaben der Politik stellt sie bis heute den wichtigsten klassischen Text dar. Kant entfaltet in ihm die philosophischen Grundlagen für eine internationale Rechts- und Friedensgemeinschaft. Resumen En este artículo defiendo la postura según la cual el republicanismo -en comparación con otras nociones o motivos centrales- no se ha interpretado como uno de los rasgos que caracteriza a la filosofía jurídica y política de Kant como un todo. Una posible razón es que el republicanismo kantiano no ha ocupado un lugar destacado dentro de las narrativas republicanas, ya sea históricas o sistemáticas, que son más dominantes en las discusiones contemporáneas. A mi parecer, esto es así porque (...) hay características innovadoras en la empresa republicana kantiana que se encuentran en tensión con otros proyectos republicanos de otra índole. Aquí discuto algunos de los rasgos distintivos del proyecto de Kant en lo que atañe a concepciones suyas sobre el estado de derecho, la ciudadanía, la autoridad política, la libertad de expresión y el derecho internacional, con el fin de señalar que estas son parte integral de una teoría política y legal que todavía es atractiva y sugerente.In this paper, I defend the stance that republicanism -in comparison to other central notions- has not been interpreted as one of the main traits that characterize Kant’s legal and political philosophy. A plausible reason for this is that Kantian republicanism has not occupied a prominent place in the republican narratives, historiographical or systematic, that are dominant in contemporary discussions. To my mind, the reason for this is that some innovative characteristics in the Kantian republican enterprise are at odds with other republican philosophical projects. Here I discuss some distinctive traits of Kant’s project regarding his conceptions of the rule of law, citizenship, political authority, free speech, and international law with the aim of showing that they are an integral part of a political and legal theory that is still attractive and compelling. Kant does not completely work out his philosophical conception of enlightenment. The definition of enlightenment that he offers in his well-known essay on the topic does not seem to completely match the definition that he puts forward later in his essay on the pantheism controversy and in the third Critique. It remains unclear how the two definitions relate to each other and whether and how they rest on the same principle. The lack of clarity in Kant’s conception of enlightenment is (...) left mostly unaddressed in the secondary literature on the topic. This paper suggests that Kant’s philosophical conception of enlightenment rests on the discipline of pure reason. The self-disciplinary principle of reason, which is laid out in the Doctrine of Method of the first Critique, underlies both of Kant’s definitions of enlightenment, although he himself does not clearly demonstrate how it does so.
