El objetivo del artículo es analizar la relación entre el bien común y el interés público como un hecho institucional desde la teoría de John Searle, una categoría de la que debe partir el saber/hacer contable para construir una sociedad más justa e inclusiva. El interés público debe conducir al bien común; sin embargo, en el marco de la regulación contable internacional, el concepto se ha privatizado vinculándose con el interés financiero. Los resultados del trabajo indican que es necesario reconstruir (...) el vínculo entre el bien común y el interés público en contabilidad; y que son los reguladores de la contabilidad quienes deben hacer uso y servir al hecho institucional BC/IP, proponiendo objetivos financieros y no financieros, tanto para el inversor bursátil como para las partes interesadas, sobreponiendo lo que es común y público al interés particular. El pilar fundamental de la sociedad es la “confianza” y esta se favorece por la aparición de instituciones y reglas 138 vinculadas a poderes deontológicos que reducen la complejidad y conducen a la cooperación, fundamento de la construcción de la realidad social. El paradigma que orientará este trabajo es el cualitativo, utilizando el enfoque hermenéutico y la técnica de revisión sistemática de la literatura. (shrink)

Despite the expansion of the regulatory state, we continue to witness widespread unethical practices across society. This paper addresses these challenges of ethical failure, misalignment, and dissonance by developing a conceptual framework that provides an explicit basis for understanding virtuousness and the common good directed toward the goal of eudaimonia or human flourishing. While much of the literature on virtuousness has focused on the organization, this paper uses a more comprehensive understanding that also incorporates the agent and the economy examined (...) through their relational order. The common good provides direction for guiding behavior of all the various stakeholders and the context for understanding virtuousness, while it is through virtuousness that the common good is effectively realized. Virtuousness and the common good are therefore in effect ‘two sides of the same coin.’ This paper develops a virtuousness–common good conceptual framework which explores the basis for harmonizing the goals of the individual, organization, and the economy. The main question explored by the book is: How can cross-border access to human genetic resources, such as blood or DNA samples, be governed in such a way as to achieve equity for vulnerable populations in developing countries? The book situates the field of genomic and genetic research within global health and research frameworks, describing the concerns that have been raised about the potential unfairness in exchanges during recent decades. Access to and sharing in the benefits of human biological resources (...) are aspects not regulated by any international legal framework such as the Convention on Biological Diversity, which applies only to the exchange of plants, animals and microorganisms, as well as to associated traditional knowledge. Examples of genetic research perceived as exploitative are provided in order to illustrate the legal vacuum concerning the global governance of human genetic resources. The main conclusions drawn from the legal and ethical analysis are: - Benefit sharing is crucial in order to avoid the exploitation of developing countries in human genetic research. - With functioning research ethics committees, undue inducement is less of a concern in genetic research than in other areas of medical research (e.g. clinical trials). - Concerns remain over research involving indigenous populations; accordingly, recommendations are provided. In drawing these conclusions, the book addresses in detail a highly pressing topic in global bioethics and international law. In this regard, it combines bioethical arguments with jurisprudence, in particular with reference to the law of equity and the legal concepts of duress (coercion), unconscionable dealing, and undue inducement.
