In both popular and scholarly discussions, sexual consent is gaining traction as the central moral consideration in how people should treat one another in sexual encounters. However, while the concept of consent has been indispensable to oppose many forms of sexual violence, consent-based sexual ethics struggle to account for the phenomenological complexity of sexual intimacy and the social and structural pressures that often surround sexual communication and behavior. Feminist structural critique and social research on the prevalence of violation even within (...) consensual sex suggest that consent is insufficient to ground responsibility; a more fundamental orientation toward the value of sexual agency provides a better foundation for sexual ethics. Using feminist critical theory, phenomenology, and black feminist thought, this dissertation develops a socially situated and relational notion of sexual agency and diagnoses how such agency is neglected in prevailing discussions of consent in moral philosophy and legal theory. I argue that the ethical question of responsibility to another in a sexual encounter—apart from juridical considerations—should be reframed around the value of each person’s socially situated practices of agency. Preceding and extending beyond the obligation to gain valid consent for an action, responsibility demands adapting one’s intentions and behaviors in response to the wider range of another’s communicative expressions of agency. However, communicative expressions can be ambiguous or overdetermined by social context and cultural norms; they often offer only provisional traces of agency. To address this inherent uncertainty in intimacy, I propose drawing on insights from Emmanuel Levinas about the dynamic, open-ended nature of relationality, responsibility, and communication. Responsibility toward another does not depend on securing certainty about their “yes” or “no,” but requires responding continuously under conditions of uncertainty and ambiguity, adapting behaviors and intentions to make room for another’s agency despite its opacity. In recent years, an array of critical emotion theorists have emerged who call for change with respect to how emotion theory is done, how emotions are understood, and how we do emotion. In this chapter, I draw on the work that some of these authors have produced to analyze how emotional marginalization of trans and disabled identities is experienced, considering in particular how this emotional marginalization results from the long history of pathologization of trans and disabled people. The past and (...) current pathologization of trans and disabled people is produced through normative assumptions, values, and beliefs that uphold systems of normalcy, including assumptions, values, and beliefs about how we feel and express emotions. In order to examine these issues, I identify three different stages at which emotional marginalization may take place: emotion experience, emotional display, and emotion recognition. In other words, emotional marginalization of trans and disabled people can occur at any of these stages. The central concern of my chapter is thus to show how emotional marginalization, at each of these stages, affects trans and disabled people. (shrink)

It seems natural to suppose that the burgeoning field of critical phenomenology would come to bear at least some affinities or resemblances (whether implicitly or explicitly) to critical theory, insofar as both are deeply concerned with directing a rigorous critical eye towards the most pressing political, economic, cultural, and social issues of our time. Yet critical theory has also had its share of critics of phenomenology itself, not least of which was the foremost member of the first-generation Frankfurt School critical (...) theorists, Theodor W. Adorno. Adorno’s critique of phenomenology was, for historical reasons, confined to Edmund Husserl and Martin Heidegger, and might be concisely put as follows: for Adorno, classical phenomenology is insufficiently critical towards contemporary realities of oppression and domination (an insufficiency variously attributed to an alleged pernicious idealism, solipsism, methodological individualism, descriptivism, or ahistoricism in classical phenomenology). On this count, critical phenomenologists today may very well agree—at least to the point of affirming that phenomenology’s critical potential remained largely “untapped” in its classical formulations. However, in a twist of historical fate, Adorno failed to engage with a contemporaneous phenomenologist with whom he perhaps had more in common than anyone else: Emmanuel Levinas. Levinas himself was also notably critical of Husserl and Heidegger (while of course also being enormously indebted to them), for reasons not altogether dissimilar to Adorno’s. For Levinas, phenomenology had hitherto neglected the fundamental ethical or moral dimensions of experience—in particular our ethical responsibility towards the Other in the face of the manifold evils and injustices of the world. What might Adorno have thought of Levinas’s work, and Levinas of Adorno’s? What might they have learned from one another? And how might this exchange have affected the trajectories of critical theory, phenomenology, or critical phenomenology? (shrink)

This article analyses the aesthetics of silent political resistance by focusing on refugees’ silent political action. The starting point for the analysis is Jacques Rancière’s philosophy and his theorisation of the aesthetics of politics. The article enquires into the aesthetic meaning of silent refugee activism and interprets how refugees’ silent acts of resistance can constitute aesthetically effective resistance to what can be called the ‘speech system’ of statist, representative democracy. The article analyses silence as a political tactic and interprets the (...) emancipatory meaning of silent politics for refugees. It argues that refugees’ silent acts of political resistance can powerfully affect aesthetic, political subversion in prevailing legal-political contexts. (shrink)

Children ‘born of war’ refer to people of any age conceived as the result of sexual violence at the hands of armed forces or groups during war, displacement, genocide or military occupation. Due to the circumstances of their birth, children ‘born of war’ can experience social stigma, discrimination and exclusion, resulting in diminished life chances and opportunities. At the same time, children ‘born of war’ fall through the cracks of global policy frameworks. In this article, we explore the reasons for (...) this, arguing that the nature of the harm these children endure renders their status as a victim group elusive. We propose a survivor-centred approach drawing on the lived experiences of children ‘born of war’. The approach recognizes the agency of children and draws attention to their expressed desire to contribute to, and participate in, processes of social reconstruction and reconciliation. (shrink)

This essay considers what is critical in critical phenomenology, and asks what features critical and phenomenological methods share. I suggest three fundamentally significant resonances between the critical and phenomenological enterprises. First is the suggestion that critique, like phenomenology, is an attempt to move beyond a dualism of inside and outside in order to extend into outer regions of what is known. Second is the insistence that what at first appears to be a purely negative endeavor, a finding of limit, is (...) incomplete if, upon finding that limit, it comes to a stop. Just as the reduction is not a means to banish or negate the world, but rather the condition through which it can more fully emerge, critique cannot be merely a cataloguing of the limitations of the present situation. Third is the openness to the possibilities of the world, a wonder or curiosity, that is revealed through the work of description in phenomenology, or Foucault’s characterization of philosophy not as an unmasking, but a making visible of what is visible. Finally I consider critical phenomenology’s futures: How is a newly enlivened kind of scholarship emerging from these two forms of thinking, both of which have been dismissed as outmoded or irrelevant? The new work currently emerging in phenomenology, with its emphasis on its own reflexive self-consideration and decolonization, offers hope that it might yet be capacious enough to simultaneously encompass the revelation of its limitations as well as the expansion of its reach. This paper examines an application of epistemic injustice not fully explored in the literature. How does epistemic injustice function in broader contexts of relationships within countries between colonizers and colonized? More specifically, what can be learned about the ongoing structural aspects of hermeneutical injustice in Canada’s settler history of the forced assimilation of Indigenous peoples and the resultant erasing and marginalizing of Indigenous histories, languages, laws, traditions, and practices? In this paper, I use insights from Canada’s Truth and Reconciliation Commission (...) report to challenge dominant understandings of reconciliation, reciprocity, respect for agency, and the rule of law in settler nations. In its retrieval of the richness and diversity of Indigenous collective interpretive resources, both past and present, Canada’s Truth and Reconciliation Commission draws on a broad and full account of relationships that have shaped Indigenous lives and communities, non-Indigenous lives and communities, the interactions of Indigenous and non-Indigenous peoples and communities, and the relationships of all of these to and through the state. How does it feel to be in a crisis? Is the idea of the crisis itself bound to our affectivity in the sense that without the occurrence of specific emotions or a change in our affective lives at large we cannot even talk about a crisis properly speaking? In this paper, I explore these questions by analyzing the exemplary case of the corona crisis. In order to do so, I first explore the affective phenomenology of crises in general and the (...) corona crisis in particular, thereby paying attention to both individual (personal) and collective (socio-political) crises and crisis experiences. Then, I turn to the limits of the analogy between individual and collective crises. I reflect on how socio-political crises are not simply there but performed and procedurally constructed and show how, in the context of the corona pandemic, fears and hopes, feelings of solidarity and antagonistic emotions mirror political interests and values. While the phenomenological reflections in the first part help us to account for the fact that crises are not just objective facts but also subjective forms of experience, the political reflections in the second part help us to do justice to the inherently political nature of the language and experiences of (collective) crises. I conclude by pointing out a twofold relationship between (socio-political) crisis and critique. Thanks to their characteristic affective phenomenology, crises are tools of criticism; but due to their inherently political character, they also themselves have to be subjected to critique. Artikkelissa käsittelen erilaisia yksinäisyyden muotoja erityisesti koetun yksinäisyyden näkökulmasta. Tutkin yksinäisyyttä sellaisten tunteiden filosofian nykysuuntausten avulla, jotka painottavat tunteiden ja ilmapiirien vuorovaikutuksellista muodostumista. Väitän, etteivät koetun yksinäisyyden näkökulma ja tunteiden filosofinen lähestymistapa tarkoita ilmiön yhteiskunnallisten tekijöiden sivuuttamista. Koska yksinäisyyttä ei voi erottaa yhteiskunnallisesta tilanteestaan ja tavoista, joilla ihmissuhteet kulttuurisesti järjestyvät, käsittelen artikkelissa koettua yksinäisyyttä myös poliittisen filosofian konteksteissa.

This paper argue that loneliness is a public health ethics issue and maps a research agenda for bioethicists.

Using insights from two of the major proponents of the hermeneutical approach, Paul Ricoeur and Hannah Arendt—who both recognized the ethicopolitical importance of narrative and acknowledged some of the dangers associated with it—I will flesh out the worry that “narrativity” in political theory has been overly attentive to story telling and not heedful enough of story listening. More specifically, even if, as Ricoeur says, “narrative intelligence” is crucial for self-understanding, that does not mean, as he invites us to, that we (...) should always seek to develop a “narrative identity” or become, as he says, “the narrator of our own life story.” I offer that, perhaps inadvertently, such an injunction might turn out to be detrimental to the “art of listening.” This, however, must also be cultivated if we want to do justice to our narrative character and expect narrative to have the political role that both Ricoeur and Arendt envisaged. Thus, although there certainly is a “redemptive power” in narrative, when the latter is understood primarily as the act of narration or as the telling of stories, there is a danger to it as well. Such a danger, I think, intensifies at a time like ours, when, as some scholars have noted, “communicative abundance” or the “ceaseless production of redundancy” in traditional and social media has often led to the impoverishment of the public conversation. I argue that Simone de Beauvoir’s only play Les bouches inutiles reveals the centrality of failure in Beauvoir’s feminist account of political freedom. In recent years, political theorists have mobilized failure to capture the diverse ways of being and doing that stand outside of hegemonic models of political life, with some conceiving of failure as a form of negativity. Negativity, on these accounts, captures an “antisocial” form of resistance by which subjects refuse configurations of sociality in order to achieve freedom. (...) I argue, however, that this form of negativity runs counter to the collective conception of freedom in Beauvoir’s political thought. To make this case, I interpret the play as a performance manqué and demonstrate that the failures that the women encounter in Les bouches inutiles are conditional on responses from the men. This allows me to recover a conception of failure as a form of positive negativity. What Beauvoir does in her literary theory is to conceptualize that same place of negativity, to which men have consigned women, as a place from which women might disclose themselves and their unique situations. Read in this way, failure is both the foreclosure of the space of intersubjectivity between women’s appeals and men’s responses, and at the same time opens ways for women to resist those failures. I then leverage Eve Sedgwick’s theory of the periperformative to show how, by engaging in poetic practices, women re-signify the political meanings of their bodies and become free with and through others. I conclude by stepping outside of the frame of the play to evaluate its recent resignification by contemporary readers. Doing so underscores the point that resisting failure requires ongoing practices of contestation and disclosure by subjects and audiences across time to affirm the collective dimension of freedom in feminist political theory. This article develops loneliness as a political and social justice issue by illustrating the harmful personal and social consequences of the medical jurisdiction over and constitution of variations in sex characteristics. Whilst connections between loneliness, health and illness have been well established, this work customarily identifies the ways illness can lead to, or be caused by, loneliness. Instead, I provide an account of the central role of medicalisation and medical management in producing loneliness. By doing so, I underline the imperative (...) for medical practice to consider its influence upon social and personal, as well as physical, wellbeing. Drawing on stories shared through solicited diaries followed by in-depth interviews with seven people with sex variations and two parents in the UK, I show how accounts of loneliness help to illuminate the violence of abandonment, silencing and marginalisation that often goes unheard, together with hidden or normalised systems of harm. Building on concepts of ethical loneliness and ontological loneliness, I show how structural violations operate to injure trust and self-worth, leading to social unease. I argue for the importance of people with sex variations finding sites of comfort and acceptance, but note the ways that some forms of medicalisation can inhibit alliances and community formation, despite diagnoses also carrying the potential to facilitate informal support structures and collective identities. By bringing together intersex studies with discourses of loneliness, I develop a better understanding of loneliness as a product of social and systemic violence, and the ways in which medical discourses tie in with larger structures of oppression, coercion and control. This article concludes by underlining the need for structural change in our approach to and understanding of sex variations, and with a call for us to become more attentive to these stories of medical harm, to ensure that they are heard and to seek necessary justice. In this article I interpret Améry’s claims about the temporal dimension of trauma in the light of Levinas’s reflections on suffering and responses to suffering—and how both reject the temptation to generate narratives in which pain serves as a step toward transcendence and self-determination. That temptation finds support in Nietzsche’s critique of resentment, which identifies the refusal to forget as pathological, and against which Améry defends himself by demanding a substantive, intersubjective process of working-off the unjust past. I argue that (...) for Levinas and Améry, progressive narratives intensify the moral inattention that normalizes the initial infliction of suffering, and that revising how we understand time is necessary to respond ethically to trauma and human vulnerability more broadly. In light of that analysis, I consider contemporary examples of memorialization and the assumptions about time that they reveal. (shrink)
