Biobanks are increasingly being created specifically for research purposes. Concomitantly, we are seeing significant and evolving shifts in research ethics in relation to biobanking. Three discrete shifts are identified in this article. The first extends the ethical focus beyond the protection of human subjects to the promotion of broader community benefits of research utilizing biobanked resources, and an expectation that these benefits will be shared. The second involves the evolution of the traditional consent paradigm for future research uses of biobanks (...) resources that are not in contemplation at the time of donation. The third involves a move away from single project management to more dynamic governance accountability to research participants and the public. These shifts may take different local and institutional forms but share common recognizable elements. (shrink)

A growing proportion of clinical research funded by pharmaceutical companies, high-income country research agencies, and not-for-profit funders is conducted in low- and middle-income settings. Disparities in wealth and access to healthcare between the populations where new interventions are often tested and those where many of them are ultimately marketed raise concerns about exploitation. This chapter examines several ethical requirements frequently advanced as mechanisms for protecting research subjects in underserved communities from exploitation and evaluates the effectiveness of those mechanisms as responses (...) to exploitation worries. It goes on to highlight where the conceptual frameworks relied upon by research ethicists must be improved if we are to fully understand the nature of the moral claims and obligations that arise in research conducted in underserved communities. This volume focuses on dialogue and argumentation in contexts which are marked by truculence and discord. The contributors include well known argumentation scholars who discuss the issues this raises from the point of view of a variety of disciplines and points of view. Against the background of an increasing dependency of governance on specialized expertise and growing calls for citizen participation, this study discusses solutions to the tension between knowledge and democracy. It asks: Which institutions and practices add to striking a balance between knowledge-based decision-making and the involvement of the affected? Based on the social studies of science, knowledge and expertise as well as democratic theory with a focus on participation, representation and inclusion, the study first identifies quality criteria of expertise and (...) participation, and then, with reference to two quite different, up-and-coming empirical answers to the epistemic-democratic tension, spells out the conditions of realizing these criteria in practice. In focus are a) highly complex, multi-layered structures of policy deliberation and advice that combine expert panels with a range of public input channels and b) the involvement of ‘lay experts’ into policy-making through participatory knowledge practices such as ‘service user involvement’ or ‘citizen science’. The study underlines, inter alia, how claims that transcend individual viewpoints and integrate a multiplicity of experiences and concerns are of particular democratic and epistemic value; it points to the key role of organized advocacy groups when it comes to credibly combining a mandate to speak for others with useful and reliable experience-based expertise; and it illustrates the relevance of conflict-minimising institutions for the making of public policies. The increasing centrality of business firms in contemporary societies calls for a renewed attention to the democratization of these actors. This paper sheds new light on the possibility of democratizing business firms by bridging recent scholarship in two fields—deliberative democracy and business ethics. To date, deliberative democracy has largely neglected the role of business firms in democratic societies. While business ethics scholarship has given more attention to these issues, it has overlooked the possibility of deliberation within firms. As argued in (...) the paper, a combination of reforms based on the ideas of workplace deliberation and business deliberation is necessary in order to promote the prospect of deliberation in different business contexts. The paper also discusses the importance of more democratic firms for deliberative democracy at large and, in particular, for the recent debate on deliberative systems. Finally, the paper suggests new areas of investigation to better understand the prospect of democratic deliberation in business firms. (shrink)

The paper focuses on the “spillover thesis” which constitutes a pillar of much of contemporary participatory democratic theory; specifically, we assess the claim that workplace democratization leads to a higher degree of political participation amongst labourers. The paper analyses the thesis as formulated by Carole Pateman, including its later revisions triggered by ambiguous results of empirical studies aiming to (dis)prove it. The spillover thesis is then confronted with important methodological and theoretical critiques, the upshot being that in order to be (...) able to arrive at determinate conclusions, more carefully designed empirical studies are needed. Normatively speaking, however, blame can always be laid on the wider environment of market economy and/or representative democracy, to the effect that the spillover thesis is both difficult to disprove and radically subversive. Given the recent dominance of deliberative democratic theory which incorporates a strong participatory element, we finally discuss whether a recent innovation – namely, the concept of deliberative systems – could be fruitfully employed as a flexible umbrella-type framework for the spillover thesis and the participatory ideals related to it. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

The following essay begins by outlining the pragmatist link between truth claims and democratic deliberations. To this end, special attention will be paid to Jeffrey Stout’s pragmatist enfranchisement of religious citizens. Stout defends a deliberative notion of democracy that fulfills stringent criteria of inclusion and security against domination. While mitigating secular exclusivity, Stout nonetheless acknowledges the new visibility of religion in populist attempts to dominate political life through mass rule and charismatic authorities. In response, I evaluate recent innovations in deliberative (...) democratic systems theory (DDST). By adding a pragmatist inflection to DDST, I aim to apprehend the complex religious interactions between partisan interest groups as well as the trust-building capacities of minipublics. (shrink)

The following essay introduces the idea of eternal peace as Immanuel Kant conceptualised it and how it relates to the contemporary global society. Kant's political philosophy still covers a wide range of current issues. He envisioned, for example, „a center of federative union for other States to attach themselves to“ as a precondition for perpetual peace. We can ask in how far the EU can serve as such a role model. Kant firmly believes that a peace guaranteeing federation should consist (...) of republics. Looking at the present global system, can we identify these republics? Do states have the right to establish a democracy through military interventions? In spite of its consistency, unequalled depth of reasoning and its relevance to current developments, Kant's concept of eternal peace still lingers in the shadows. Politicians often prefer to make wars. Some thinkers develop their own models for a peaceful world society, others engage in hermeneutic discussions in order to clarify Kant's concept. They usually focus on one area of concern and scarcely back up their claims with empirical evidence. This paper, however, complements Kant's ideas and relates them to current social, economic, political and cultural developments. (shrink)

In an important article published in this journal, Dryzek, Bächtiger and Milewicz (2011) champion the convocation of a Deliberative Global Citizens’ Assembly (DGCA). In this article, I aim to further strengthen the case for a DGCA by addressing: (i) why a DGCA is likely to take a long-term perspective in the global interest and (ii) why it is so vital that a global institution should do so. I start by analyzing the nature of the issues requiring global policy. These issues, (...) I will argue, are typically global cooperation problems. Cooperation problems pose two major challenges. The first is to prevent freeriding – i.e. serving one’s short-term interests at the expense of the long-term global interest. The second is to align on an efficient global policy. In both respects, I will argue, a DGCA is a good candidate to yield desirable results (and is likely to do better than current supranational institutions). (shrink)
