The problem of political action has its roots, arguably, in the sixth book of the Nicomachean Ethics, where Aristotle seeks to describe an intellectual virtue – phronêsis – that is different from the faculty of theoretical reason but that is nonetheless capable of producing genuinely objective, rational knowledge, i.e., knowledge of what is true. The problem, specifically, is to understand how such a thing is possible, and much of the recent literature appears to suggest that perhaps it’s not. Since rhetoric, (...) persuasion, interest and emotion are obviously central features of political life, it may seem that some kind of non-intellectualist and non-rationalist perspective must be the way to go. I argue, nonetheless, that any such account is, and cannot but be, deeply problematic; and I defend, by way of contrast, a decidedly intellectualistic understanding of political enterprise. (shrink)

Imagine a citizen (call her Ellen) engages in conduct the state says is a crime, for example, money laundering. Imagine too that the state of which Ellen is a citizen has decided to make money laundering a crime. Does the state wrong Ellen when it punishes her for money laundering? It depends on what you think about the authority of the criminal law. Most criminal law scholars would probably say that the criminal law as such has no authority. Whatever authority (...) is has depends on how well it adheres to the demands of morality inasmuch as morality is the only authority we have. Thus if morality says that money laundering should not be a crime then the state wrongs Ellen when it punishes her. But if the criminal law as such does have authority, and if in the exercise of its authority the state has decided to make money laundering a crime, then the state does Ellen no wrong when it punishes her. Aunque el uso no problematizado en el lenguaje ordinario de los términos "consenso" y "consentimiento" sugiere que debe haber alguna comprensión compartida de su significado, no hay un acuerdo generalizado sobre el uso de estos conceptos entre los filósofos políticos. De hecho, el significado filosófico de estos conceptos sigue siendo elusivo y controvertido; tal vez precisamente a causa de su amplitud y centralidad. Teniendo en cuenta los numerosos intentos de explicar satisfactoriamente consenso y consentimiento -que con el tiempo se han (...) vuelto más sofisticados-, este artículo recoge algunos usos filosóficos fundamentales de estos dos multifacéticos conceptos y sugiere una estrategia para bosquejar un mapa que parece un rompecabezas cuyas piezas están moldeadas de tal forma que se necesita un enfoque multidisciplinario para poder identificar adecuadamente sus significados e implicaciones. Although the unproblematic use of the terms "consensus" and "consent" in ordinary language suggests that there must be some shared understanding of their meaning, there is no widespread assent on the use of these concepts among political philosophers. In fact, the philosophical meaning of these concepts remains elusive and controversial, perhaps exactly because of their extension and centrality. Taking note of the numerous attempts to provide a satisfactory account of "consensus" and "consent" - that have become increasingly sophisticated in time - this article recollects some fundamental philosophical uses of the two many-faceted concepts, and suggests a strategy for delineating a map that looks like a puzzle, whose pieces are shaped in such a way that we need a multidisciplinary approach in order to adequately identify their meanings and implications.
