In this paper we show how some reasoning, though fallacious, can appear to be attractive and useful for beings-like-us. Although they do not provide conclusive evidence to support or reject a certain claim the way scientific statements do, they tell us something interesting about how humans build up their arguments and reasons. First of all, we will consider and investigate three main types of fallacies: argumentum ad hominem , argumentum ad verecundiam , and argumentum ad populum . These three fallacies (...) are traditionally considered as examples of a broader category called ignoratio elenchi. Secondly, we show how people who commit these fallacies rely on information about other human beings in their reasoning. That is, they do not follow certain logical procedures that eventually lead them to correct conclusions. But they simply make use of others as social characters. For example, being an authority, being an expert, being part of a class, etc., become the substitutes for more direct evidence to support a certain claim or to make an argument more appealing. The Humean conception of the self consists in the belief-desire model of motivation and the utility-maximizing model of rationality. This conception has dominated Western thought in philosophy and the social sciences ever since Hobbes’ initial formulation in Leviathan and Hume’s elaboration in the Treatise of Human Nature. Bentham, Freud, Ramsey, Skinner, Allais, von Neumann and Morgenstern and others have added further refinements that have brought it to a high degree of formal sophistication. Late twentieth century moral philosophers such as Rawls, (...) Brandt, Frankfurt, Nagel and Williams have taken it for granted, and have made use of it to supply metaethical foundations for a wide variety of normative moral theories. But the Humean conception of the self also leads to seemingly insoluble problems about moral motivation, rational final ends, and moral justification. Can it be made to work? (shrink)

This is a work concerned with justification and freedom and the relationship between these. Its summational aim is to defend a transcendental argument for free will – that we could not be epistemically justified in undermining a strong notion of free will, as a strong notion of free will would be required for any such process of undermining to be itself epistemically justified. The book advances two transcendental arguments – for a deontically internalist conception of epistemic justification and the aforementioned (...) argument for a libertarian conception of free will. In defending each of these arguments, the book both defends and relies upon the principle that ‘ought’ implies ‘can’. In articulating the latter transcendental argument – for freedom – heavy reliance is made on the earlier, epistemic, work: especially on the deontological conception of rational justification (on epistemic internalism). Some think that issues to do with scientific method are last century's stale debate; Popper was an advocate of methodology, but Kuhn, Feyerabend, and others are alleged to have brought the debate about its status to an end. The papers in this volume show that issues in methodology are still very much alive. Some of the papers reinvestigate issues in the debate over methodology, while others set out new ways in which the debate has developed in the last decade. Adrian Piper argues that the Humean conception can be made to work only if it is placed in the context of a wider and genuinely universal conception of the self, whose origins are to be found in Kant’s Critique of Pure Reason. This conception comprises the basic canons of classical logic, which provide both a model of motivation and a model of rationality. These supply necessary conditions both for the coherence and integrity of the self and also for unified agency. (...) The Kantian conception solves certain intractable problems in decision theory by integrating it into classical predicate logic, and provides answers to longstanding controversies in metaethics concerning moral motivation, rational final ends, and moral justification that the Humean conception engenders. In addition, it sheds light on certain kinds of moral behavior – for example, the whistleblower – that the Humean conception is at a loss to explain. (shrink)

Neuroeconomics is a recent extension of behavioral economics which aims at uncovering the brain mechanisms and activities that mediate regular and anomalous behaviour. Gul and Pesendorfer have launched a critique against the neuroeconomic research program, based on what they argue is the incommensurability of the theoretical constructs employed by each respective discipline. To respond to their argument we envision and illustrate several "directions of instruction" between neuroscience and economics, and provide counter-examples to their critique. This disciplinary cross-talk suggests that neuroeconomics (...) may play a crucial conceptual and methodological role in fostering the unity of behavioral sciences. (shrink)

The “naturalistic turn” that has swept so many areas of philosophy over the past three decades has also had an impact in the last decade in legal philosophy. Methodological naturalists (M-naturalists) view philosophy as continuous with empirical inquiry in the sciences. Some M-naturalists want to replace conceptual and justificatory theories with empirical and descriptive theories; they take their inspiration from more-or-less Quinean arguments against conceptual analysis and foundationalist programs. Other M-naturalists retain the normative and regulative ambitions of traditional philosophy, but (...) emphasize that it is an empirical question what normative advice is actually useable and effective for creatures like us. The 20 sup > th /sup > century has been a tumultuous time in psychology -- a century in which the discipline struggled with basic questions about its intellectual identity, but nonetheless managed to achieve spectacular growth and maturation. It’s not surprising, then, that psychology has attracted sustained philosophical attention and stimulated rich philosophical debate. Some of this debate was aimed at understanding, and sometimes criticizing, the assumptions, concepts and explanatory strategies prevailing in the psychology of the time. But much (...) philosophical work has also been devoted to exploring the implications of psychological findings and theories for broader philosophical questions like: Are humans really rational animals? How malleable is human nature? and Do we have any innate knowledge or innate ideas? One particularly noteworthy fact about philosophy of psychology in the 20 sup > th /sup > century is that, in the last quarter of the century, the distinction between psychology and the philosophy of psychology began to dissolve as philosophers played an increasingly active role in articulating and testing empirical theories about the mind and psychologists became increasingly interested in the philosophical underpinnings and implications of their work. Our survey is divided into five sections, each focusing on an important theme in 20 sup > th /sup > century psychology which has been the focus of philosophical attention and has benefited from philosophical scrutiny. I argue for three central theses: ‘intuition’ is ambiguous, in material object metaphysics ‘intuition’ refers to pre-theoretical beliefs, and these pre-theoretical beliefs are generated by an innate physical reasoning system. I begin by outlining the relevant background discussions on the nature of intuitions and their role in philosophy to motivate the need for a more careful investigation of the meaning of ‘intuition’ and the role of intuitions in specific sub-disciplines of philosophy. In chapters one and two I argue that ‘intuition’ (...) is ambiguous between an inflationary and deflationary sense. In the inflationary sense, ‘intuition’ refers to a priori intellectual seemings with a special phenomenology, conceptual etiology, and modal content. In the deflationary sense, ‘intuition’ refers to beliefs or inclinations to believe. In chapter three I specifically examine the use of intuitions in material object metaphysics and conclude that in this sub-community ‘intuition’ is used in the deflationary sense to refer to pre-theoretical beliefs. Drawing from research on infant cognition, in the final chapter I argue that intuitions regarding material object metaphysics are those judgments that arise from an innate physical reasoning system. Based on this empirical observation, I argue that metaphysicians ought to give preference to abstract intuitions over intuitions regarding concrete cases because these abstract intuitions reflect the innate structure of our physical reasoning mechanisms.
