In this exploration into the close relation between terror and law, I attempt first to show that the relation between terror and law is not a simple question of relating violence to law, but to the very process of constitution making. Second, laws relating to terror may or may not find a formal place in the constitution, but this relation is essential to the working of the basic law, of the foundational concept of the rule of law. Third, intelligence gathering (...) occupies a key place in this relation, and this activity, which has no mention in the constitution almost anywhere in the world, is the fulcrum on which reasons of state stand. Fourth, intelligence is the close monitoring of human movement, of the body, of the physical activities, and in this physical form of politics we have the meeting of the body and reasoning, terror and constitution, violence and law. And finally, the article describes a specifically Indian experience; yet may have larger significance in terms of retrieving the history of constitution making. (shrink)

ZusammenfassungAnders als die weitgehend in der Geschichtsschreibung belegte psychiatrische Anstalt für Europäer und Europäerinnen mit ihrem englischen Leiter Owen Berkeley-Hill ist die weitaus größere Institution für indische Patienten und Patientinnen im nordindischen Ranchi bisher nicht untersucht worden. Im Mittelpunkt dieses Beitrags steht die Karriere des Leiters dieser Institution, Jal E. Dhunjibhoy, zu Beginn des 20. Jahrhunderts als von der britischen Kolonialregierung eine Indianisierung der medizinischen Einrichtungen angestrebt wurde. Im Gegensatz zu bisherigen Studien über intermediaries und middles konzentriert sich dieser Aufsatz (...) auf einen hochrangigen einheimischen Mitarbeiter. Die verbreitete Annahme zwangsläufiger historischer Prozesse wird dabei differenziert, eine regionale Kontextualisierung vorgenommen und die Kontinuität offener und versteckter Diskriminierung indischer Mediziner in Bezug auf Entlohnung, gesellschaftliche Stellung, fachliche Anerkennung, posthume Würdigung und historiographischer Berücksichtigung herausgearbeitet. Es wird verdeutlicht, in welcher Weise koloniale Akteure in bestehende gesellschaftliche Disparitäten und soziopolitische Prozessen verstrickt waren und wie die Karriere eines leitenden Mediziners von einer Vielzahl von außermedizinischen Zusammenhängen bestimmt wurde. Gleichzeitig wird hervorgehoben, dass ihre strukturelle Positionierung als inbetweens, Kollaborateure oder Repräsentanten einer erfolgreichen Dekolonisierung für ein nuancierteres Verständnis ihrer beruflichen und persönlichen Identitätsformierung nicht ausreicht. The development of both the modern state and modern scientific discourses in the non-Western world are closely linked together, both being the outcome of the colonial encounter. Using a Foucauldian framework of power/knowledge and his notions of ‘episteme’ and ‘governmentality’, this article explores how colonial governmentality in India produced statistical knowledge of the country thus ushering in a new social scientific discourse of ‘progress’, ‘history’, ‘economy’ and ‘society’.

We (relatively few) Western analytic philosophers who also work on classical Indian philosophy commonly encounter puzzlement or suspicion from our colleagues in Western philosophy because of our Indian interests. The ubiquity of these attitudes is itself revealing of Western conceptions of Indian philosophy, though their origins lie in cultural history often unknown to those who hold them. In the first part of this paper I relate a small but significant slice of that history before going on to distinguish and illustrate (...) three different Western conceptions of Indian philosophy associated with three different approaches to India: the magisterial, the exoticist and the curatorial. I argue that none of these three approaches gives us an adequate conception of Indian philosophy: the magisterial approach is overly dismissive, the exoticist approach misrepresents the analytical achievements of Indian philosophy, and the curatorial approach fails to take seriously Indian philosophy's concern with truth. I advocate instead a different Western approach to Indian philosophy, an approach suggested by the Indian philosophers' own discussions of the problem of truth. (shrink)

James Tully's Strange Multiplicity uses the example of indigenous minorities in the white settler colonies of North America to develop a remarkably powerful critique of liberal constitutionalism's rule of uniformity. In proclaiming the identity of all persons before the law, he insists, liberal constitutional arrangements commonly discriminate against indigenous and other minorities. While the force of this critique is undeniable, it nevertheless takes at face value one of the central claims of liberal consitutionalism, namely, its claim to be based on (...) the rule of uniformity. Examination of liberal reflections on the government of subject peoples, most of whom were regarded as being, in Mill's words, “not sufficiently advanced for representative government“, suggests a rather different picture. In place of the rule of uniformity we find a variety of alternatives but, most commonly, an insistence, first, that the government of such peoples should focus on their welfare and eventual improvement rather than on their liberty and, second, that they should be governed as far as possible through their own institutions and structures of authority. The result was a highly differentiated form of rule in which what were believed to be indigenous arrangements were adapted to the joint requirements of improvement and administrative convenience. Thus, what seems to be a powerful commitment to individual liberty on the part of liberal political reason should be seen as simply one element in a broader liberal perspective on the government of populations. At least as important in this perspective as the rule of uniformity is the presumption that some cultures are more advanced than others and a corresponding view of many cultural differences in historical and developmental terms.
