When discussing any question in which a human being has a moral claim or a moral choice to make we need to address the justification of those claims and actions. Hence one can ask the question whether we can discuss a justification of moral judgments without having any specific knowledge about any corresponding fact or if it is possible to justify a moral judgment without having that kind of knowledge. This thesis has critically assessed Rainer Forst’s justification theory in relation (...) to moral epistemology, aiming at clarifying his position on the matter. The study shows that Forst’s position is one of a cognitivist nature with a form of rational constructivism. The thesis suggests an alternative approach to Forst’s justification theory. Forst should take on an empiricist explanation when it comes to justifying moral judgements and therefore an epistemology that is not rationalism. Therefore, I suggest a form of realism when it comes to the discussion of his ontology. (shrink)

Constitutivism aims to justify substantial normative standards as constitutive of practical reason. In this way, it can defend the constructivist commitment to avoiding realism and anti-realism in normative disciplines. This metaphysical debate is the perspective from which the nature of the constitutivist justification is usually discussed. In this paper, I focus on a related, but distinct, debate. My concern will not be whether the substantial normative claims asserted by the constructivist have some elements, which are not constructed, but real, given (...) independently from us; instead, my concern will be more narrowly epistemic – whether those claims can be derived from premises, which are normatively less substantial than the normative conclusions themselves. I focus on Korsgaard’s transcendental articulation of the constitutivist argument. I conclude that more work would need to be done, in order for this argument to function as intended. (shrink)

Constructivism as a distinct metaethical position has garnered significant interest in recent years due in part to Sharon Street’s theory, Humean metaethical constructivism. According to Street’s account, practical reasons are constructed by individual valuing entities. On this view, then, whether a particular reason applies to an individual is completely contingent upon what that individual actually values. In this article I argue for the recognition of multiple sources of practical reasons and values, including both individuals and communities. The resulting view, which (...) I call layered constructivism, strengthens the constructivist project and begins to resolve some of the common critiques leveled against Street’s Humean constructivism. To begin, layered constructivism retains many of the benefits of Street’s approach, such as providing a naturalistic picture of normativity and maintaining a close tie between practical reasons and individual motivation. Moreover, the inclusion of collective sources of normativity and the importance of the resulting values for individuals is supported by recent empirical research on norms. Layered constructivism can also respond to the common concerns that Humean constructivism fails to adequately account for the immense influence our social lives have on our normative reasons and values, and that it entails an objectionable level of contingency. Finally, acknowledging the existence of differently constructed reasons helps us make sense of the pervasive human experience of navigating a variety of seemingly incommensurable normative reasons. Sharon Street’s evolutionary debunking argument—her Darwinian Dilemma—is meant to challenge value realists to reconcile the evaluative attitudes we tend to hold, shaped as they are by evolution, with the attitude-independent evaluative facts that realists posit. Ramon Das argues that Street’s argument relies on illicit metaphysical assumptions about evaluative facts, and that these assumptions beg the question against a particular form of value realism called naturalist realism. I argue that Street makes no such metaphysical assumptions, and that her argument requires no (...) particular metaphysical construal of evaluative facts to work. I further argue that any objection of the kind Das raises—those that turn on the metaphysical underpinnings of evaluative facts—is unlikely to succeed against Street’s Darwinian Dilemma. (shrink)

The question ‘Why care about being an agent?’ asks for reasons to be something that appears to be non-optional. But perhaps it is closer to the question ‘Why be moral?’; or so I shall argue. Here the constitutivist answer—that we cannot help but have this aim—seems to be the best answer available. I suggest that, regardless of whether constitutivism is true, it is an incomplete answer. I argue that we should instead answer the question by looking at our evaluative commitments (...) to the exercise of our other capacities for which being a full-blown agent is a necessary condition. Thus, the only kind of reason available is hypothetical rather than categorical. The status of this reason may seem to undermine the importance of this answer. I show, however, that it both achieves much of what we want when we cite categorical reasons and highlights why agency is valuable. (shrink)

In a methodological milieu characterized by efforts to bring the methods of philosophy closer to the methods of the sciences, one can find, with increasing regularity, meta-ethical arguments relying on scientific theory or data. The received view appears to be that, not only is it implausible to think that a scientific vindication of a non-mentalist moral semantics will be forthcoming but that evidence from a variety of sciences threatens to undermine non-mentalist views. My aim is to push back against this (...) apparent consensus. The well-established phenomenon whereby moral judgments influence our attributions of putatively purely descriptive properties has come to be known as the Knobe Effect. Joshua Knobe has attempted to explain this surprising phenomenon by arguing that our folk psychological judgments are partially constituted by moral judgments. Drawing on an argument originally offered by Moore, I argue that if some instantiation of Knobe’s explanatory strategy is accurate, we have good reason to believe that mentalist moral semantics are untenable. Para lograrlo, parte de un análisis de la formulación del objetivo general de la estrategia constitutivista, para luego rastrear sus orígenes históricos en los problemas de las fuentes de la normatividad, el constructivismo y la normatividad de las razones, posteriormente se explica el movimiento simple constitutivista y se cierra el artículo presentando las tres tesis principales que sostiene toda estrategia constitutivista.

According to a tradition going back to Socrates, one should thoroughly examine the grounds of one’s judgments before settling on what one has reason to do or believe. According to contemporary metaethical constructivism, assumed in this essay, reflective scrutiny is also central to assessing a judgment’s claim to justification. This essay argues against the injunctions to thoroughly examine oneself and seek ultimate reasons for one’s normative judgments. In other words, the essay argues against the ideal of the philosophical way of (...) life. It shows that in most cases one does not have reason to question the practical conclusion of one’s initial deliberation. It is only under very limited conditions, specified in the essay, that one is justified in engaging in further reflection. Furthermore, the essay argues that if one does go for full self-examination, the consequences are most likely to be bad for oneself, given one’s practical interests. (shrink)

In this article I press four different objections on Forst’s theory of the ‘Right to Justification’. These are (i) that the principle of justification is not well-formulated; (ii) that ‘reasonableness and reciprocity’, as these notions are used by Rawls, are not apt to support a Kantian conception of morality; (iii) that the principle of justification, as Forst understands it, gives an inadequate account of what makes actions wrong; and (iv) that, in spite of his protestations to the contrary, Forst’s account (...) veers towards a version of moral realism that isprima facieincompatible with Kantian constructivism. I then evaluate Forst’s theory in the light of a distinction made by Sharon Street between restricted and unrestricted constructivism. I show that Forst has reason to deny that it is either the one or the other, but he is not able to show that it is both or neither. I conclude that the arguments Forst advances in support of his constructivist theory of the right to justification entail that it is a metaphysical and comprehensive conception in the relevant, Rawlsian sense. Forst’s theory of the right to justification therefore fails to fulfil one of the main stated aims. (shrink)

This article critically examines Busk's Democracy in Spite of the Demos, which critiques the “categorical imperative of democracy.” Although Busk effectively challenges the commitment to value-neutral democratic procedures as the foundation for legitimate law, his alternative, curtailing powerful interests ability to manipulate voters using “socially necessary delusions,” risks establishing elite rule. This article instead proposes basic liberal rights as the normative foundation for legitimate public order and militant democracy as its most effective institutional safeguard, arguing that this combination better realizes (...) human emancipation. We argue that Reasons Fundamentalism, as defended by T.M. Scanlon, faces two important difficulties—one ontological, the other epistemological—namely theontological proliferation problemand thereliability challenge.We suggest that formal constructivism can avoid these difficulties, and that Scanlon would do well to adopt it. We also show that Scanlon’s three main objections to this view depend either on a misunderstanding of what formal constructivism is or on a question-begging argument in favour of realism.

Teleosemantic theories aspire to develop a naturalistic account of intentional agency and thought by appeal to biological teleology. In particular, most versions of teleosemantics study the emergence of intentionality in terms of biological purposes introduced by Darwinian evolution. The aim of this paper is to argue that the sorts of biological purposes identified by these evolutionary approaches do not allow for a satisfactory account of intentionality. More precisely, I claim that such biological purposes should be attributed to reproductive chains or (...) lineages, rather than to individual traits or organisms, whereas the purposes underlying intentional agency and thought are typically attributed to individuals. In the last part of the paper I suggest that related difficulties are also faced, despite appearances, by accounts of intentionality relying on alternative organizational approaches to biological teleology. In this paper, I reply to Sharon Street’s objection against quasi-realism, according to which this theory is subject to a problem of unexplained coincidence between the normative truths and our evaluative attitudes. I argue that this problem cannot be applied to quasi-realism because the necessary element for it to be applied is missing in this theory: an ontological commitment towards robust normative entities. This lack of commitment allows quasi-realists to argue for a minimalist conception of normative truths, and to escape (...) the scope of the problem of unexplained coincidence. (shrink)

Rawlsians argue for principles of justice that apply exclusively to the basic structure of society, but it can seem strange that those who accept these principles should not also regulate their choices by them. Valid moral principles should seemingly identify ideals for both institutions and individuals. What justifies this nonintuitive distinction between institutional and individual principles is not a moral division of labor but Rawls’s dual commitments to conventionalism and constructivism. Conventionalism distinguishes the relevant ideals for evaluating institutions from those (...) for evaluating actions, while constructivism explains why this distinction is morally fundamental. VE is both a eudaimonistic theory of practical reasoning and a constructivist account of the metaphysics of value. In this essay, I will explain the core of LeBar’s view and focus on two issues, one concerning VE ’s eudaimonism and the other concerning VE ’s constructivism. I will argue that, as it stands, VE does (...) not adequately address the charge of egoism, once that charge has been formulated in the strongest way. I will also argue that a substantive constructivism like VE must have considerably less explanatory power than any constructivism that appeals to a _formal_ characterization of agency. Although my remarks are largely critical, I offer them in a spirit of sympathetic engagement with LeBar’s impressive book. (shrink)

While there has been a great deal of recent interest in parallels between metaethics and metaepistemology, there has been little discussion of epistemological analogues of the open question argument. This is somewhat surprising—the general trend in recent work is in the direction of emphasizing the continuity between metaethics and metaepistemology, and to treat metanormative questions as arising in parallel in these two normative domains. And while the OQA has been subjected to a wide variety of objections, it is still influential (...) in metaethics. In this paper, I aim to show that an epistemological version of the OQA is just as promising as its moral cousin. That's not to say that I'll unqualifiedly endorse either argument. Rather, my aim is to show that there is just as strong a prima facie case for an OQA in metaepistemology as there is in metaethics—I leave open whether the ultima facie case collapses. (shrink)

This short essay offers a commentary on Chapter 11 of David Wiggins’,Ethics(2006). The essay asks how we should interpret Wiggins’ defense of ethical ‘objectivity’ given his subjectivist metaethics. An interpretation is drawn from Sharon Street's work on metaethical constructivism, of which Wiggins’ view is taken to be one variety.

Anti-realism is often claimed to be preferable to realism on epistemological grounds: while realists have difficulty explaining how we can ever know claims if we are realists about it, anti-realism faces no analogous problem. This paper focuses on anti-realism about normativity to investigate this alleged advantage to anti-realism in detail. I set up a framework in which a version of anti-realism explains a type of modal reliability that appears to be epistemologically promising, and plausibly explains the appearance of an epistemological (...) advantage to realism. But, I argue, this appearance is illusory, and on closer investigation the anti-realist view does not succeed in explaining the presence of familiar epistemological properties for normative belief like knowledge or the absence of defeat. My conclusion on the basis of this framework is that there is a tension in the anti-realist view between the urge to idealize the conditions in which normative beliefs ground normative facts, and a robust kind of reliability that normative belief can have if the anti-realist resists these idealizations. This paper discusses practical akrasia from the perspective of the sophisticated form of moral subjectivism that can be derived from Nuno Venturinha’s remarks on moral matters.

This paper interprets the relation between justice and legitimacy found in John Rawls's Political Liberalism and then applies it to the field of transitional justice. The author argues that transitional mechanisms can be better defended in terms of “legitimacy” than in “justice,” because the circumstances of transitional justice admit of reasonable disagreement over “just” public policy. In such circumstances, policy recommendations can always be construed as falling short of justice, thus raising plausible concerns over their normative justification. This paper attempts (...) to answer such concerns by justifying transitional mechanisms as morally appropriate yet less than fully just. The author explains how the concept of legitimacy facilitates such a justification and how such a justification can secure the normative grounds that are ironically threatened by investigations relying on a concept of justice. Do pharmaceutical companies have a moral obligation to expand access to investigational drugs to patients outside the clinical trial? One reason for thinking they do not is that expanded access programs might negatively affect the clinical trial process. This potential impact creates dilemmas for practitioners who nevertheless acknowledge some moral reason for expanding access. Bioethicists have explained these reasons in terms of beneficence, compassion, or a principle of rescue, but their arguments have been limited to questions of moral permissibility, leaving (...) for future research the question of whether expanded access is morally obligatory. We take up this further question and argue that pharmaceutical companies have a moral obligation to expand access. Our defense is not based on beneficence, compassion, or rescue, but instead on a reciprocal moral expectation resulting from existing social commitments that help ensure a robust pharmaceutical practice within the broader healthcare system. Our aim is to give this obligation, along with several others, a coherent and plausible structure within the wider clinical trial process so that one might better explain the sources of the dilemmas and their possible resolutions. A recurrent challenge in applied ethics concerns the development of principles that are both suitably general to cover various cases and sufficiently exact to guide behavior in particular instances. In business ethics, two central approaches—stockholder and stakeholder—often fail by one or the other requirement. The author argues that the failure is precipitated by their reliance upon “universal” theory, which views the justification of principles as both independent of their context of application and universally appropriate to all contexts. Moral realists face an epistemological challenge: they must explain why many judgments that are likely to be moral truths are those it would be evolutionarily adaptive to hold. Is it a coincidence? Do evolutionary forces track these truths?Third-factor explanationis the strategy most commonly adopted by moral realists to explain this striking correlation. In this article, I argue that it does not allow them to meet the challenge.

This monograph discusses the question of what it is to be a reason – mainly in practical ethics – and proposes an original contribution to metaethics.It critically examines theories of metaethical realism, constructivism and error theory and identifies several misunderstandings or unclarities in contemporary debates. Based on this examination, the book suggests a distinction between a conceptual question, that can be answered by pure first-personal thinking, and a material question, that targets responses to reasons as a natural phenomenon in space (...) and time and that can be answered by help of the sciences. While this book defends a sharp distinction between these approaches, it also argues that the insights gained by the distinct approaches can be fruitfully integrated into a comprehensive picture.The comprehensive picture promoted in this book, based on both philosophical analysis and resources from psychology and cognitive science, is a picture of reasons as items in a collective archive of mind – reconfiguring the “domain of reasons” as a collectively established and socially cultivated fund of considerations with normative weight. The developed Collective Archive View combines Reasons Fundamentalism as an answer to the conceptual question, with a social ontological proposal, similar to Haslanger’s critical realism, as an answer to the material question.Thereby, it introduces central ideas from the field of social metaphysics into metaethics. At the same time, it offers a way of settling some controversies within metaethics, going on between proponents of Reasons Fundamentalism and Constitutivism, realism and constructivism, as well as proponents of mind-dependence and mind-independence of normative facts. Finally, the proposal enables us to envision and conceptualize genuine normative change within a metaethical theory. (shrink)

The Aristotelian Society’s Virtual Issue is a free, online publication, made publically available on the Aristotelian Society website. Each volume is theme-based, collecting together papers from the archives of the Proceedings of the Aristotelian Society and the Proceedings of the Aristotelian Society Supplementary Volume that address the chosen theme. This year's Virtual Issue includes a selection of papers from across the Society’s fourteen decades, each accompanied by a specially commissioned present-day response. The aim of the volume is to aid reflection (...) on how to go about doing moral and political philosophy, by bringing together papers that bear on their epistemology and methodology. In some cases this involves pieces whose declared focus is on one of those areas, as is the case with Margaret MacDonald’s 1941 essay ‘The Language of Political Theory’ and Mary Midgley’s 1974 article ‘The Neutrality of the Moral Philosopher’. In other cases the editor, Ben Colburn, selected papers whose primary focus is elsewhere, but which include some interesting epistemological or methodological reflections or implications along the way. The contributions from our present-day commentators vary similarly in how far their explicit attention is methodological. Nevertheless, there is throughout a concern on how to ‘be an honest reasoner’, to borrow a phrase from the late Dudley Knowles. (shrink)
