This paper probes theories of justice underpinning the concept of equity to deconstruct the term and ascertain how best to equitably support refugee and asylum-seeking youth in U.S. schools. Building upon theories posited by John Rawls, Michael Sandel, and Amartya Sen, the paper aims to extend beyond ideal theory into a theoretical framework of equity with operationalizing potential. Recognizing refugee and asylum-seeking youth as part of the U.S. social contract and therefore bound to government support, the paper represents that equitable (...) education for these young people in our globalized world is essential from both a human rights and economic perspective. Such equitable education will only be achieved when universal minimum standards are offered to everyone and made inclusive, so that all are invited to fully participate as culturally respected learners and knowledge producers in academic spaces. A human right to freedom of religion is not equivalent to a right to tolerance. Human rights and tolerance-rules serve for different purposes and are based on different justifications. Tolerance-rules serve to protect a peaceful living together with strangers who share no common values. Human rights serve to protect every individual’s personhood. Religion can only be a matter of human rights, if and so far as it is a condition of development and maintenance of personhood. Discussion about a human right (...) to freedom of religion makes sense only if we can identify a particular scope of protection which concerns only religion and if the freedom of religion is not embraced by wider-framed freedoms. The freedom of religious thoughts and the freedom of religious speech are embraced by the general human rights to freedom of thoughts and freedom of speech. Here, there is no need for a special human right to freedom of religion. The right not to be forced to act contrary to religiously founded moral rules is embraced by the general human right to freedom of conscience. And again, there is no need for a special human right. The target of religious practices in a narrower sense is to become flexible and porous and not to resist the threats of the sacral in order to avoid the destruction of personhood. Therefore, we have to recognize a human right to freedom of religious rites. It protects only the actions of accommodation to the overwhelming power of the sacral. It does not protect, however, any action with which it is intended to rule the world or to rule over others, to organize certain practical challenges, or to discover or to maintain scientific theories or technical means. En este trabajo adoptamos una postura crítica, en primer lugar, ante un planteamiento que desde la investigación empírica pretende explicar los fines propios de la educación. Frente a éste proponemos la metodología hermenéutico-crítica para desentrañar cuáles son los fines últimos de la educación. Descubrimos que desde la metodología hermenéutico-crítica es posible enfocar adecuadamente el fin de la educación así como aportar una justificación ética solvente. Profundizando en la dimensión crítica de la hermenéutica, pero sin desvincularla de su quicio experiencial, reparamos (...) en que no basta con interpretar los valores establecidos por la sociedad, sino que es necesario ahondar en el radical ético que justifica la educación como auténtico desarrollo humano de las capacidades morales. Esta experiencia primordial de la educación que hunde sus raíces en el radical humano es una experiencia genuinamente ética. A este respecto, destacamos once claves del enfoque éticohermenéutico y sus ventajas para la determinación del enclave de la educación. (shrink)

Resumen: En este ensayo desarrollo una crítica al modelo de justicia multicultural de Will Kymlicka, con el propósito de establecer las bases para el desarrollo de un multiculturalismo crítico. El argumento se ordena de la siguiente forma. En la primera sección analizo la teoría de los derechos especiales de Kymlicka e identifico el valor liberal central al que estos responden, la autonomía individual. En la segunda sección examino el fundamento igualitarista de la suerte de su teoría de los derechos especiales. (...) En la tercera sección elaboro una crítica general a la justicia multicultural liberal desarrollando un argumento para politizar los reclamos de los pueblos indígenas para el acceso a su cultura. Argumento que el trato justo de las minorías indígenas requiere reconocer su autodeterminación política.: In this essay I develop a critique of Will Kymlicka’s model of multicultural justice, with the purpose of laying down the foundations for a critical multiculturalism. The argument is ordered in the following way. In the first section I analyse Kymlicka’s theory of special rights and identify the central liberal value to which they respond: individual autonomy. In the second section I examine the luck egalitarian foundations of Kymlicka’s theory of special rights. In the third section, I elaborate a general critique to liberal multicultural justice, developing an argument to politicize the claims of indigenous peoples to access to their culture. Basically I argue that the just treatment of indigenous minorities requires recognizing their political self-determination. (shrink)

As philosophers such as Fendler, Bauman and Young have shown, the concept of community poses significant challenges for diversity by reinforcing similarity, necessarily bracketing that which is viewed as outside, other or strange. In this paper, I interrogate the concept of community as it applies to Québec's intercultural context. I explore how intercultural dialogue, a mechanism to promote intercultural community building has, through a number of public displays of xenophobia, reinforced a discourse of intolerance in Québec's public sphere. Québec's Geography, (...) History, and Citizenship education course is aimed at creating an intercultural ‘micro-society’ in which students practice the demands of intercultural citizenship, such as dialogue. As a curricular requirement, intercultural dialogue places educators with the responsibility of perpetuating an intolerant discourse of difference. (shrink)

In view of scholarly work that has explored the socio-psycho significance of national performativity, the body and the “other,” this article critically analyses newspaper representations of the Canadian-born British tennis player Greg Rusedski. Drawing on Lacanian interpretations of the body, it illustrates how Rusedski’s media framing centered on a particular feature of his body—his “smile.” In doing so, we detail how Rusedski’s “post-imperial” Otherness—conceived as a form of “extimacy” (extimité)—complicated any clear delineation between “us” and “them,” positing instead a dialectical (...) understanding of the splits, voids and contradictions that underscore the national “us.”. I wish to carry out a philosophical inquiry into the present day intercultural public spheres. The thesis I endeavour to support is that the achievement of inclusive public spheres largely depends on one’s willingness and capacity to foster the “appreciation of diversities” by first, enhancing policies and forms of cooperation between the citizens’ emotional and motivational resources, and then enhancing their cognitive competences. More specifically, my proposal is to understand such an effort from the viewpoint of post-Weberian responsibility, that is (...) of an ethics and politics that overcome the traditional divisions between theory and practice, cognition and emotion, “Verantwortung” and “Gesinnung” , and therefore succeed in enhancing the citizens’ awareness and attitudes as – in Habermas’ words – “democratic co-legislators”. The case study of Matthew Lipman’s “Philosophy for Children/Community” succeeds precisely in highlighting these results. (shrink)
