In May 2021, Royal Dutch Shell was ordered by the Hague District Court to significantly reduce its CO2 emissions. This ruling is unprecedented in that it attributes the responsibility for mitigating climate change directly to a specific corporate emitter. Shell neither directly causes climate change alone nor can alleviate it by itself; therefore, what grounds this responsibility attribution? I maintain that this question can be answered via Young’s social connection model of responsibility for justice. I defend two claims: First, I (...) argue that the model explains Shell’s connection to climate change and that this relationship grounds Shell’s responsibility. Second, by identifying a way in which the social connection model could be applied to corporations in legal practice, I further develop Young’s model. I question Young’s distinction between political and legal responsibility for justice and propose that courts could mediate citizens’ actions regarding political responsibilities. (shrink)

ABSTRACTThe responsibility of the food and beverage industry for noncommunicable diseases is a controversial topic. Public health scholars identify the food and beverage industry as one of the main contributors to the rise of these diseases. We argue that aside from moral duties like not doing harm and respecting consumer autonomy, the food industry also has a responsibility for addressing the structural injustices involved in food-related health problems. Drawing on the work of Iris Marion Young, this article first shows how (...) food-related public health problems can be understood as structural injustices. Second, it makes clear how the industry is sustaining these health injustices, and that due to this connection, corporate actors share responsibility for addressing food-related health problems. Finally, three criteria are discussed as grounds for attributing responsibility, allowing for further specification on what taking responsibility for food-related health problems can entail in corporate practice. Referring to the phenomenon of structural injustice resulting from unintended consequences of the combination of the actions of many people, Iris Marion Young claims for a new understanding of responsibility. She proposes what she calls a social connection model of responsibility which assigns responsibility to individuals also for participating in ongoing structural and social processes. To remedy structural injustice Young claims for collective action of various actors in society and assigns different degrees of responsibility depending on the agent’s position within (...) the structural process. However, although Young mentions power, privilege, interest, and collective ability as parameters influencing the degree of an actor’s responsibility to contribute to structural change she does not elaborate which responsibilities concern which groups in society. As we will outline in our contribution, we hold the tenet of subsidiarity to be a useful supplement to the conception of Iris Marion Young which would allow for assigning such responsibilities to different layers in society. However, since the tenet of subsidiarity is only a supple principle which does not distinguish between different kinds of duties, we propose to enrich the tenet of subsidiarity by the Kantian conception of perfect and imperfect duties. In this article, we philosophically reflect on the nature of corporate governance. We raise the question whether control is still a feasible ideal of corporate governance and reflect on the implications of the epistemic insufficiency of economic institutions with regard to grand challenges like of global warming for our conceptualization of corporate governance. We first introduce the concept of corporate governance from the perspective of economics and politics. We then trace the genealogy of the concept of governance based on a (...) selective reading of Giorgio Agamben’s work, who has pointed at two interdependent paradigms of governance in the Christian tradition, and apply his categories in the context of corporate governance. We finally engage in a critical reflection on the concept of corporate governance and develop four characteristics of corporate governance that can guide future conceptual as well as empirical research in the field of corporate social responsibility of economic institutions. Today, a major technological trend is the increasing focus on the person: technical systems personalize, customize, and tailor to the person in both beneficial and troubling ways. This trend has moved beyond the realm of commerce and has become a matter of public governance, where systems for citizen risk scoring, predictive policing, and social credit scores proliferate. What these systems have in common is that they may target the person and her ethical and political dispositions, her virtues. Virtue ethics is (...) the most appropriate approach for evaluating the impacts of these new systems, which has translated in a revival of talk about virtue in technology ethics. Yet, the focus on individual dispositions has rightly been criticized for lacking a concern with the political collective and institutional structures. This paper advocates a new direction of research into civic virtue, which is situated in between personal dispositions and structures of governance. First, it surveys the discourse on virtue ethics of technology, emphasizing its neglect of the political dimension of impacts of emerging technologies. Second, it presents a pluralist conception of civic virtue that enables us to scrutinize the impact of technology on civic virtue on three different levels of reciprocal reputation building, the cultivation of internal goods, and excellence in the public sphere. Third, it illustrates the benefits of this conceptions by discussing some paradigmatic examples of emerging technologies that aim to cultivate civic virtue. (shrink)

Successful transitions to a sustainable bioeconomy require novel technologies, processes, and practices as well as a general agreement about the overarching normative direction of innovation. Both requirements necessarily involve collective action by those individuals who purchase, use, and co-produce novelties: the consumers. Based on theoretical considerations borrowed from evolutionary innovation economics and consumer social responsibility, we explore to what extent consumers’ scope of action is addressed in the scientific bioeconomy literature. We do so by systematically reviewing bioeconomy-related publications according to (...) the extent to which consumers are regarded as passive vs. active, and different domains of consumer responsibility. We find all aspects of active consumption considered to varying degrees but observe little interconnection between domains. In sum, our paper contributes to the bioeconomy literature by developing a novel coding scheme that allows us to pinpoint different aspects of consumer activity, which have been considered in a rather isolated and undifferentiated manner. Combined with our theoretical considerations, the results of our review reveal a central research gap which should be taken up in future empirical and conceptual bioeconomy research. The system-spanning nature of a sustainable bioeconomy demands an equally holistic exploration of the consumers’ prospective and shared responsibility for contributing to its coming of age, ranging from the procurement of information on bio-based products and services to their disposal. Responsible innovation (RI), also termed Responsible Research and Innovation, has emerged due to increasing concern over how to integrate ethical and societal values into research and innovation policy and governance (Von Schomberg 2013), in response to questioning of the societal role of science as well as populist resurgence in some countries (Long and Blok 2017a). Within a RI approach, innovators must consider three dimensions of responsibility, including the dimensions of (1) ‘avoiding harm’ to people and the planet, (2) ‘doing good’ (...) through the offering of innovations that foster sustainable development, and (3) the development of facilitative global governance schemes (Voegtlin and Scherer 2017). The concept of corporate citizenship as a form of corporate social responsibility theory challenged the traditionally accepted socio‐economic division of labor between government and corporations. Although the concept has been around for decades, its validity and applicability are still a matter of debate, with attention to the “chameleon” nature of the concept. Therefore, this paper defines and applies a conceptual framework to examine whether corporate social and political engagement is necessary and, if so, in what form it is beneficial for (...) both the company and society. This is the objective of the present study. The method used in this paper is critical analysis, i.e. the evaluation of arguments both pro and con, and the comparison of these arguments with empirical evidence within the defined conceptual framework. The study shows that the demand for corporate activism is contradictory, so companies need to determine whose interests they represent or balance between different expectations. In addition to analyzing and evaluating corporate activism from a specific conceptual framework, the novelty of the study lies in its differentiated approach to corporate citizenship according to the scope of the companies and in the corresponding proposal for a new socio‐economic division of labor between governments and corporations. If it can be argued that companies should engage with social justice advocacy, what factors might deter them from doing so? This question is pursued in a qualitative research study with participants from corporate and social justice organisations. Six inhibiting factors are identified: a lack of understanding of social justice concepts; fear of reputational risk; short-term profit orientation; a compliance mindset; disconnectedness from operating environment; and recognition that business purpose will determine its societal engagement. This research extends the theoretical and (...) practice boundaries of corporate social responsibility, while also advocating for an intensified engagement of management education with social justice in practice. Food-related non-communicable diseases such as obesity, type 2 diabetes and cardiovascular diseases are key threats to public health. Yet, the responsibility for food-related health harms is contested. While traditionally viewed as mainly an individual responsibility or a governmental responsibility, fingers are nowadays also pointed at the food and beverage industry, as many firms are producing and marketing unhealthy products that contribute to the rise of obesity and other food-related NCDs. Yet, does the behaviour of the industry and the impact its (...) products have on public health also give reason for moral concern? Are these firms doing anything wrong? Are there normative considerations on the basis of which it can be argued that food and beverage firms have a responsibility for public health? This thesis explores the moral grounds for firms in the food and beverage industry to address food-related public health problems, and simultaneously reflects upon what taking responsibility for these problems could entail in practice. Drawing on debates in business ethics, political philosophy, and public health ethics, it is argued that food and beverage firms have distinct responsibilities for food-related health problems, and that these responsibilities spring from considerations of _non-maleficence_, _respect for autonomy _and _justice_. The thesis makes clear how responsibility for public health can be understood as an essentially shared responsibility, and outlines what taking responsibility could entail for various firms in the food and beverage industry and makes recommendations on what kind of behaviour firms should no longer engage in.
