The paper outlines ongoing research on logic-based tools for the analysis and representation of legal contracts, of the kind frequently encountered in large-scale engineering projects and complex, long-term trading agreements. We consider both contract formation and contract performance, in each case identifying the representational issues and the prospects for providing automated support tools.

The crucial feature of obligation sentences to which the puzzles point is that such sentences, and evaluative sentences more generally, are defeasible. They may be warranted, given some information, only to be defeated by further information. A theory that recognizes this no longer needs to see conditional obligation as anything more than a simple combination of unary obligation and the conditional.

We care not only about what experiences we have, but when we have them too. However, on the B-theory of time, something’s timing isn’t an intrinsic way for that thing to be or become. Given B-theory, should we be rationally indifferent about the timing per se of an experience? In this paper, I argue that B-theorists can justify time-biased preferences for pains to be past rather than present and for pleasures to be present rather than past. In support of this (...) argument, I appeal to the doctrine of temporal parts or “four-dimensionalism” for short. When held in conjunction with a certain evaluative principle about whose experiences matter, four-dimensionalism reconciles B-theory with some time-biased preferences. (shrink)

Our preferences determine how we act and think, but exactly what the mechanics are and how they work is a central cause of concern in many disciplines. This book uses techniques from modern logics of information flow and action to develop a unified new theory of what preference is and how it changes. The theory emphasizes reasons for preference, as well as its entanglement with our beliefs. Moreover, the book provides dynamic logical systems which describe the explicit triggers driving preference (...) change, including new information, suggestions, and commands. In sum, the book creates new bridges between many fields, from philosophy and computer science to economics, linguistics, and psychology. For the experienced scholar access to a large body of recent literature is provided and the novice gets a thorough introduction to the action and techniques of dynamic logic. (shrink)

We consider an infinite hierarchy of systems of Alethic Modal Logic with so-called Levels of Perfection, and add to them suitable definitions of such interesting deontic categories as those of supererogation, offence, conditional obligation and conditional permission. We then state three problems concerning the proper characterization of the resulting logic(s) for our defined notions, and discuss two of these problems in some detail.

This paper describes and compares the first step in modern semantic theory for deontic logic which appeared in works of Stig Kanger, Jaakko Hintikka, Richard Montague and Saul Kripke in late 50s and early 60s. Moreover, some further developments as well as systematizations are also noted.

I defend the following version of the ought-implies-can principle: (OIC) by virtue of conceptual necessity, an agent at a given time has an (objective, pro tanto) obligation to do only what the agent at that time has the ability and opportunity to do. In short, obligations correspond to ability plus opportunity. My argument has three premises: (1) obligations correspond to reasons for action; (2) reasons for action correspond to potential actions; (3) potential actions correspond to ability plus opportunity. In the (...) bulk of the paper I address six objections to OIC: three objections based on putative counterexamples, and three objections based on arguments to the effect that OIC conflicts with the is/ought thesis, the possibility of hard determinism, and the denial of the Principle of Alternate Possibilities. This paper is concerned with removing the identity schema from the axiomatic basis of deontic conditionals. This is in order to allow a stipulated ideal to be contrary or opposite in nature to the fact it is predicated upon. It is desirable, or so it is argued, to retain the order-theoretic orientation of preferential semantics towards the analysis of deontic conditionals, more specifically of maximality semantics in the tradition from Bengt Hansson. So understood, the problem involves abstracting away the settledness (...) assumption that is built in to maximality semantics. This is the assumption that what is optimal given ϕ is that which all the best ϕ-states have in common, notably ϕ itself. We propose a solution based on a strict and finite preference relation over which deontic conditionals are evaluated by letting ϕ-states evolve freely, as fate or fortune would have it, into different possibly ensuing optima that may but need not be ϕ-states themselves. The result is a deontic conditional that does not have identity. This new conditional is shown to be a proper generalization of the Hansson conditional. Hansson’s conditional can be recovered in the new idiom as a special case. Indeed, the new semantics is general enough to cover several apparently very different conceptions of deontic conditionality. For instance, the input/output logic known as basic output is a sublogic of the new system. This is somewhat surprising and suggests that there may yet be unity to be had in the field of deontic logic. (shrink)

The Moral Law is fulfilled iff everything that ought to be the case is the case, and The Good is realised in a possible world w at a time t iff w is deontically accessible from w at t. In this paper, I will introduce a set of temporal modal deontic systems with propositional quantifiers that can be used to prove some interesting theorems about The Moral Law and The Good. First, I will describe a set of systems without any (...) propositional quantifiers. Then, I will show how these systems can be extended by a couple of propositional quantifiers. I will use a kind of TxW semantics to describe the systems semantically and semantic tableaux to describe them syntactically. Every system will include a constant · that stands for The Good. ‘·’ is read as ‘The Good is realised’. All systems that contain the propositional quantifiers will also include a constant '*' that stands for The Moral Law. '*' is read as ‘The Moral Law is fulfilled’. I will prove that all systems (without the propositional quantifiers) are sound and complete with respect to their semantics and that all systems (including the extended systems) are sound with respect to their semantics. It is left as an open question whether or not the extended systems are complete. (shrink)

The paper develops a set of quantified temporal alethic boulesic doxastic systems. Every system in this set consists of five parts: a ‘quantified’ part, a temporal part, a modal (alethic) part, a boulesic part and a doxastic part. There are no systems in the literature that combine all of these branches of logic. Hence, all systems in this paper are new. Every system is defined both semantically and proof-theoretically. The semantic apparatus consists of a kind of$$T \times W$$T×Wmodels, and the (...) proof-theoretical apparatus of semantic tableaux. The ‘quantified part’ of the systems includes relational predicates and the identity symbol. The quantifiers are, in effect, a kind of possibilist quantifiers that vary over every object in the domain. The tableaux rules are classical. The alethic part contains two types of modal operators for absolute and historical necessity and possibility. According to ‘boulesic logic’ (the logic of the will), ‘willing’ (‘consenting’, ‘rejecting’, ‘indifference’ and ‘non-indifference’) is a kind of modal operator. Doxastic logic is the logic of beliefs; it treats ‘believing’ (and ‘conceiving’) as a kind of modal operator. I will explore some possible relationships between these different parts, and investigate some principles that include more than one type of logical expression. I will show that every tableau system in the paper is sound and complete with respect to its semantics. Finally, I consider an example of a valid argument and an example of an invalid sentence. I show how one can use semantic tableaux to establish validity and invalidity and read off countermodels. These examples illustrate the philosophical usefulness of the systems that are introduced in this paper. (shrink)

In this paper, I will discuss some examples of the so-called contrary-to-duty paradox, a well-known puzzle in deontic logic. A contrary-to-duty obligation is an obligation telling us what ought to be the case if something forbidden is true, for example: ‘If she is guilty, she should confess’. Contrary-to-duty obligations are important in our moral and legal thinking. Therefore, we want to be able to find an adequate symbolisation of such obligations in some logical system, a task that has turned out (...) to be difficult. This is shown by the so-called contrary-to-duty paradox. I will investigate and evaluate one kind of solution to this problem that has been suggested in the literature, which I will call the ‘counterfactual solution’. I will use some recent systems that combine not only counterfactual logic and deontic logic, but also temporal logic, in my analysis of the paradox. I will argue that the counterfactual solution has many attractive features and that it can give a fairly satisfactory answer to some examples of the contrary-to-duty paradox, but that it nevertheless has some serious problems. The conclusion is that, notwithstanding the many attractive features of the solution, there seem to be other approaches to the paradox that are more promising. (shrink)

This paper reports completeness results for dyadic deontic logics in the tradition of Hansson’s systems. There are two ways to understand the core notion of best antecedent-worlds, which underpins such systems. One is in terms of maximality, and the other in terms of optimality. Depending on the choice being made, one gets different evaluation rules for the deontic modalities, but also different versions of the so-called limit assumption. Four of them are disentangled, and compared. The main observation of this paper (...) is that, even in the partial order case, the contrast between maximality and optimality is not as significant as one could expect, because the logic remains the same whatever notion of best is used. This is established by showing that, given analogous properties for the betterness relation, the same system is sound and complete with respect to its intended modelling. The chief result of this paper concerns Åqvist’s system F supplemented with the principle of cautious monotony. It is established that, under the maximality rule, F + is sound and complete with respect to the class of models in which the betterness relation is required be reflexive and smooth . From this, a number of spin-off results are obtained. First and foremost, it is shown that a similar determination result holds for optimality; that is, under the optimality rule, F + is also sound and complete with respect to the class of models in which the betterness relation is reflexive and smooth . Other spin-off results concern classes of models in which further constraints are placed on the betterness relation, like totalness and transitivity. (shrink)

In his last papers about deontic logic, von Wright sustained that there is no genuine logic of norms. We argue in this paper that this striking statement by the father of deontic logic should not be understood as a death sentence to the subject. Rather, it indicates a profound change in von Wright's understanding about the epistemic and ontological role of logic in the field of norms. Instead of a logical constructivism of deontic systems revealing a necessary structure of prescriptive (...) discourse, which marked his earlier efforts, he adopted the view that such systems should be seem as mere objects of comparison, i.e. as providing practical standards of rationality for normgiving activity. Within such view he proposed an interpretation of standard deontic logic in such a way to free deontic logicians from the philosophical difficulties related to the so-called Jørgensen's dilemma and deontic paradoxes. This effort, as we claim in the present paper, is an application of Wittgenstein's therapeutic method to dissolve philosophical difficulties caused by the use of logical tools to model relations between norms. Neste artigo fazemos uma discussão conceitual acerca da ferramenta de escolha por nós apresentada no trabalho “Solving Normative Conflicts using Preference Relations”, isto é, explicitamos a racionalidade subjacente a tal ferramenta, bem como as consequências práticas de sua aceitação.

A dynamic semantics for iffy oughts offers an attractive alternative to the folklore that Chisholm's paradox enforces an unhappy choice between the intuitive inference rules of factual and deontic detachment. The first part of the story told here shows how a dynamic theory about ifs and oughts gives rise to a nonmonotonic perspective on deontic discourse and reasoning that elegantly removes the air of paradox from Chisholm's puzzle without sacrificing any of the two detachment principles. The second part of the (...) story showcases two bonus applications of the framework suggested here: it offers a response to Forrester's gentle murder paradox and avoids Kolodny and MacFarlane's miners paradox about deontic reasoning under epistemic uncertainty. A comparison between the dynamic semantic proposal made in this paper and a more conservative approach combining a static semantics with a dynamic pragmatics is provided. (shrink)

Vít Gvoždiak published a reconciliatory analysis of Searle’s social ontology with semiotics in Gvoždiak (2012). Without prior knowledge of his paper, an analysis of the same subject appeared in Msimang (2014). Even though Searle’s social ontology is a common point of reference in the formulation of semiotics in these papers, it also serves as a point of departure in their understanding of semiotics and its development. The semiotic theory expressed in Gvoždiak (2012) is an inherently linguistic (speech act centred) theory, (...) whereas the semiotic theory presented in Msimang (2014) tends more towards a general theory of communicative systems in which social ontology, which follows from speech act theory, is an interesting part. It is my purpose in this note to contrast the two positions of semiotic theory as they appear in the aforementioned papers in reference to their appropriation of Searle’s social ontology. (shrink)
