This paper critically investigates the implementation of the UN guiding principles on business and human rights (UNGPs) into the corporate setting through the concept of ‘translation’. In the decade since the creation of the UNGPs, little academic research has focussed specifically on the corporate implementation of human rights. Drawing on qualitative case studies of two multinational corporations—an oil and gas company and a bank—this paper unpacks how human rights are translated into the corporate context. In doing so, the paper focuses (...) on the “resonance dilemma” translators encounter, the strategies used to make human rights understandable and palatable, and the difficulties that emerge from this process. We contend that the process of making human rights understandable and manageable can change their form and content, which may act as an obstacle to human rights realisation and corporate accountability for human rights. This paper puts forth a critical perspective on remedy for business-related human rights abuses. It reflects on the purpose of remedy in Business and Human Rights and argues that effective remedy should address the multiple root causes of abuses to prevent reoccurrences rather than focus on surface issues and isolated cases. To develop a theoretical framework to conceptualize preventative remedy that addresses multiple root causes, this research draws on Fraser’s radical democratic conception of justice and participatory parity. According to the (...) principle, justice is achieved through social arrangements that enable all actors to engage with one another as peers. To conceptualize effective remedy as participatory parity, the paper examines three dimensions—cultural, economic, and political—where injustices or root causes of abuses must be addressed to realize participatory parity. The paper analyzes the illustrative case of the Fair Food Program through the lens of Fraser’s framework. Analysis reveals effective enforcement as necessary to realize participatory parity and address the three dimensions of justice in the context of severe power asymmetries. In the theorized framework, remedy aims to address the multiple root causes of business-related human rights abuses toward prevention and empower rightsholders to engage meaningfully in remedial processes. Symbols can be used to mask or embellish firms’ exploitative labor practices. The present study defines exploitative firms’ abuse of symbolic management using legitimate symbolic terminologies to embellish their demanding working conditions as symbolic framing and examines it in the Japanese context. Because of strong social criticism for exploitative practices, firms are under pressure to avoid giving an exploitative impression to stakeholders, particularly job seekers in recruitment. This study argues that exploitative firms respond to these pressures by embellishing their descriptions (...) of the hard-working conditions at the firm, using certain symbolic expressions. To test this argument, this study examined recruitment advertising of 1238 Japanese firms between 2006 and 2017 and analyzed their ideal candidate profile (ICP) statement—a description of personal attributes that align with the firms’ working conditions—based on topic modeling. The results showed that exploitative firms tend to frame their working conditions in the ICP statement as ‘challenging work,’ which acknowledges the demanding work environment but frames it positively. This tendency was strengthened for firms with younger employees. The results provide the current literature with new insights regarding the dark side of symbolic management. (shrink)

Anxieties stemming from rising inequalities have led significant sections of the world’s population to reject democratic practices and place their trust in politicians with fascist tendencies who promise to wrest control of their destinies from elites. Ironically, elite interests, far from being threatened, are bolstered by the rise of fascism, as discredited democratic institutions can be dismantled with impunity. The emerging alliance between the neoliberal project and fascist politics is a phenomenon that the business and society scholarship is ill-equipped to (...) confront as it remains trapped in the same neoliberal pro-elite paradigms that neglect meaningful attention to material equality and focus instead on ensuring a minimum floor of rights required for subsistence. Neglecting the concentration of wealth among the elite, particularly in countries with historic legacies of inequalities based on race, caste, ethnicity, and religion, creates ideal conditions for the eruption of fascisms premised upon programmatic denial of the full range of civil rights to one or more sections of the population, so that even the floor minimum becomes impossible to achieve for all. This paper argues that corporate collusions with fascism can be challenged only by a commitment to redistribution of wealth and creating critical citizens and by generating knowledge that can question authority: in other words, scholarship must become a subversive activity.
