Event of Signature formulates a new philosophical problem which focuses on the handwritten signature as sign of legal identification. Author Michaela Fišerová works with three metaphysical expectations, which are shared in discourses of graphology and forensic analysis. The first expectation tends to reveal the signer's soul: a handwritten signature "naturally" mirrors the unique psychological qualities of the signer. The second expectation tends to guarantee the originality of the signer's trace: a handwritten signature proves physical contact between the signed document and (...) the writing tool "authentically" moved by the signer's hand. The third expectation tends to recognize the signer's legal identity: a handwritten signature is expected to reproduce the signer's personal style, which enables identification by legal authorities. In a methodologically inventive and semiotically-based dialogue with Derrida's deconstruction, Fišerová situates this triple expectation in the interval between life and law. Challenging coverage of this topic finally shows that none of the metaphysical expectations will ever be fulfilled in the event of manual signing. Legal uses of handwritten signature are characterized by the complex aporia of repeating the unrepeatable. (shrink)

In the essay ‘To Speculate – On “Freud’”, which is published in The Postcards: From Socrates to Freud and Beyond (1980) and draws upon the last part of his unedited lecture course on La Vie la mort (taught in 1975), Jacques Derrida engages a close reading of Sigmund Freud's Beyond the Pleasure Principle. This article focuses on the deconstruction of the Freudian concept of drive (Trieb) that Derrida unfolds across his reading. It traces the analysis of the movement of autotelicity (...) (auto-télie) that, according to Derrida, underpins the drive's relation to itself, and argues that the French philosopher interprets a specific drive evoked (but not thematized) by Freud, the drive to power (Bemächtigungstrieb), as the figure of the deconstruction of that autotelicity. Furthermore, the article suggests that the implications of this argument extend beyond Derrida's early reading of Freud, since they cast a new light on the argument for replacing the concept of sovereignty with that of the drive to power, which Derrida elaborates in his late political analyses. This paper intends to verify the extent and effectiveness of the transforming appropriation of the Derridean concept of ‘differance’ by Stiegler with respect to the problems that, according to Stiegler, make this creative critical operation necessary; in particular with respect to the most recent question concerning the possibility of thinking about and putting into practice a ‘neganthropological différance’ capable of facing the ecological crisis that today seems to threaten the very existence of life on earth. The paper goes back to (...) Technics and Time 1. to analyze the distinction between ‘vital difference’ and ‘noetic difference’ that constitutes the condition of possibility of the ‘neganthropological différance.’ In this perspective, the distinction proposed by Stiegler seems to re-propose the hierarchically oriented oppositional structure that characterizes metaphysical thought and in particular the opposition between man and animal, attributing to the human being the ability to free himself from the constraints of his biological-natural condition. Finally, the paper attempts to account for the repercussions of this approach on the very possibility of an effective response to the ecological crisis, concluding with a provocation regarding the role that theory can and must play with regard to such an urgent and far-reaching problem. This article focuses on Jacques Derrida’s deconstructive re-elaboration of the tradition of mechanicism, from the Cartesian animal–machine to contemporary scientism. It shows that Derrida does not counter this tradition by resorting to the metaphysical presupposition of Freedom – as sovereign independence from the machine – which secures the traditional oppositions of Man and the Machine and of the biological and the psychical. Rather, since his interpretation of the cybernetic concept of programme, he had been concerned with a conception of machines (...) that takes account of their hypercomplexity – that is, of the semiotic and grammatological element implicit in them. According to Derrida, this element provides us with the analogical and general code of the biological and the cultural and thus with the protocol for telling a nonhumanist and differential history of life. In particular, this article explains that the grammatological conception of the cybernetic programme undergirds the re-elaboration of the relation between the biological and the psychical as well as of the Cartesian legacy underpinning the modern thought of the Animal, which Derrida develops in his unpublished seminar La Vie la mort and in his late essays on animality, respectively. In Of Grammatology, Derrida discusses Leroi-Gourhan in relating différance to memory, the ‘program’, and the history of life. In Technics and Time, 1, Stiegler argues that Derrida failed to draw all the philosophical implications of linking différance to the questions of life and retention. Derrida returned to the life sciences in 1975, in a seminar not published in its entirety until 2019. There, Derrida attempts to deconstruct the geneticist François Jacob's account of the ‘logic of life’, but Derrida's analysis of (...) different kinds of memory and programs seems confused, suggesting that the Derridean text remains haunted by the deficiencies of his earlier reading of Leroi-Gourhan. Later in the seminar, Derrida shows foresight concerning the problems arising from seeing the genetic molecule as akin to a computer program, despite Jacob making this link via Schrödinger and Wiener's discussions of negentropy. When Derrida turns to a reading of Freud and libidinal energy, however, he ‘assumes’ a reading of Laplanche but ignores the latter's critique of Freud's own preoccupations with the second law of thermodynamics. The limitations of Derrida's attempts to bring deconstruction together with scientific understanding expose the need for the kind of ‘organological’ and ‘neganthropological’ approach that Stiegler will ultimately pursue. Derrida’s recently published Life Death seminars have again highlighted the importance of values within the ongoing philosophical conversation about overcoming metaphysics. The seminars further indirectly raise a matter of great importance for constitutional theory. Values have become central to constitutional discourse since the mid-twentieth century despite critique due to their supposedly subjective nature, the potential conflict between them, and the legal uncertainty that they bring about. This essay enquires into the origin, logic, structure, and operation of (constitutional) values. It does (...) so through a close reading of the texts of Heidegger and Derrida in which Nietzsche’s call for a revaluation of values takes on a central role, along with a reflection on the relation between life and Being, as well as between life and death. A close reading of these texts in turn makes possible an unorthodox reading of Schmitt’s newly translated text on constitutional values in The Tyranny of Values, which finally opens the possibility of a move beyond such values and thus beyond metaphysics.
