Global capitalism is a transnational “operational space” which is produced by the practices of states, policy- and issue-specific government networks, and private organizations such as transnational corporations, global law firms, and standard-setting agencies. This “operational space,” which I call the transnational constellation, works through and beyond distinct spatial settings, endowing them with a global financial capitalistic logic and limiting the scope of democratic self-determination. In the second section, I analyze political protest against this transnational constellation in terms of democratic theory. (...) For Hannah Arendt, the federal system is an effective mode of organizing different sources of power while avoiding sovereign politics. This article aims to contribute two specific claims to the burgeoning scholarship on Arendt's international federalism. First, Arendt's international thoughts call for balancing two demands: the domestic need for human greatness and flourishing and the international demand for regulation and cooperation. Second, her reflections on council-based federalism offer a nuanced position that views the dual elements of equality in politics (intra-state (...) and interstate equality) as neither contradictory nor reconciliatory but rather as ideal types along a continuum. This study shows that, through the unique form of federalism emphasizing the need to balance two demands of free politics with a clear acknowledgement of its precariousness, Arendt's thinking adds much-needed sensitivity to international discourse. For a long time, one of the most important tasks for education in liberal democracies has been to foster the next generation in core democratic values in order to prepare them for future political responsibilities. In spite of this, general trust in the liberal democratic system is in rapid decline. In this paper, the tension between the ambitions of liberal-democratic educational systems and contemporary challenges to central democratic ideas is approached by reconsidering Hannah Arendt’s critique of political education. This will (...) be done informed by her analysis of the tension between the concepts of state and nation. By showing how education, depending on its role as a tool of the state or the nation, may be a fundamental requirement for the establishment of a common world or the most effective tool for its destruction, the paper argues for the need to understand Arendt’s educational thinking in light of her wider political analysis. Rather than downplaying the provocative aspects of her critique, the paper argues for the need to use it as a starting point for thinking again how education may become an emancipatory undertaking capable of disarming contemporary threats to human plurality and freedom. International relations (IR) scholars have increasingly integrated Hannah Arendt into their works. Her fierce critique of the conventional ideas of politics driven by rulership, enforcement, and violence has a particular resonance for theorists seeking to critically revisit the basic assumptions of IR scholarship. Arendt’s thinking, however, contains complexity and nuance that need careful treatment when extended beyond domestic politics. In particular, Arendt’s vision of free politics—characterized by the dualistic emphasis on agonistic action and institutional stability—raises two crucial issues that need (...) further elaboration for IR research that appropriates her thinking. One involves the orientation of her international thoughts. Although Arendt shows “idealistic” aspirations for authentic politics practiced by diverse equals in an institutionally articulated space of freedom, she never loses interest in the extant situation of “non-idealistic” politics. Engaging with Arendt’s theory orientation requires a careful analysis of difficult topics, such as her distinctive conception of the political and her critiques of the nation-state and international law. The other topic that needs clarification when Arendt’s thoughts are applied to IR involves specific ways of associating different sites of power. A close examination of Arendt’s council-based federalism reveals her distinctive idea of international politics, based on her acute awareness of the fundamental complexity that lies in power association and state agency. Bringing IR topics like state agency into conversation with her works generates illuminating questions for Arendt scholarship. Likewise, the ongoing debate on agonistic and institutional features of Arendt’s thoughts can provide crucial insights into critical studies of international politics. (shrink)

Partindo da desintegração europeia no início do século XX e do surgimento do outlaw contemporâneo, o refugiado, refletiremos sobre o sentido do princípio da legalidade, sua relação, em Arendt, com a plural condição humana e o mundo comum. Mostraremos como estão contidos, na obra mencionada, elementos (...) para uma articulação inicial entre a ideia do direito como “direito a ter direitos” e uma teoria da cidadania na pensadora judia-alemã. ABSTRACT This article aims to relate the thesis of the centrality of the outlaw to think of Law, in Hannah Arendt with her understanding of Law as "right to have rights" drafted in Origins of totalitarianism. Starting from the European disintegration in the early twentieth century and the emergence of the contemporary outlaw, the refugee, we will reflect on the meaning of the principle of legality, its relationship, in Arendt, with a plural human condition and the common world. We will show how there are elements contained, in the work mentioned, for an initial articulation between an idea of law as "right to have rights" and a theory of citizenship in the Jewish-German thinker. Hannah Arendt was fearful not only of a populist President speaking in the name of the people and unbound by legality. She was also concerned that popular support could be harnessed by those responsible for limiting it. In other words, she was fearful of the American Supreme Court relying on popular support. This is the meaning of her obscure depiction of the American Supreme Court as “the true seat of authority in the American Republic” but unfit to power. I argue (...) that Arendt's characterization of authority as requiring “neither coercion nor persuasion” means that the Court's source of legitimacy is expertise rather than public support. Yet the current dominant understanding among American Justices as well as scholars is that public support is the source of the Court's authority. In Arendt's mind, such an understanding means that the Court has become the seat of power. The corruption of the Court's authority and constitutional law as a language of expertise capable of resisting public opinion will inevitably follow. (shrink)

Zusammenfasung: In diesem Artikel fokussiere ich auf die Kluft zwischen dem Begriff des „Menschen“, der den Menschenrechten zugrunde liegt, und dem Konzept der universellen Rechtspersönlichkeit, das ich im Hinblick auf die mediterranen Flüchtlingsbewegungen untersuche. In Anlehnung an Arendts berühmtes Diktum vom „Recht, Rechte zu haben“ analysiere ich die Spannung zwischen den souveränen Rechten von Staaten und den Rechtsansprüchen von Migrant*innen, was wiederum auf das hinweist, was ich als „Grenzen der Menschenrechte“ bezeichne: Sie beziehen sich auf die Begrenztheit der Menschenrechte angesichts (...) der staatlichen Souveränität und sind in der Grenzkontrollpolitik der einzelnen Staaten und ihrer Grenzbehörden verkörpert. Wie ich unter Bezugnahme auf den Fall Hirsi vorschlage, sollte die Rechtspersönlichkeit von Migrant*innen jenseits territorialer Grenzen gedacht werden, während staatliche Funktionen, wie die Kontrolle der Staatsgrenzen, im Lichte der Menschenrechtsnormen überdacht werden müssen. The present article discusses the “peace versus justice” dilemma in international criminal justice through the lenses of the respective legal theories of Judith Shklar and Hannah Arendt—two thinkers who have recently been described as theorists of international criminal law. The article claims that in interventions carried out by the International Criminal Court, there is an ever-present potentiality for the “peace versus justice” dilemma to occur. Unfortunately, there is no abstract solution to this problem, insofar as ICC interventions will in some (...) cases be conducive while in others, they will be deleterious to peace. If a tension between peace and justice arises in a particular case, the article asserts, the former must be prioritised over the latter. Such a prioritisation, however, requires a vision of the ICC as a flexible actor of world politics which is situated at the intersection of law, ethics and politics, rather than a strictly legalistic view of the court. Ultimately, then, the present article seeks to probe whether the legal and political theories of Shklar and Arendt—in isolation, but ultimately also in combination—support such a flexible vision of the ICC.
