  • Democracy unbound? Non-linear politics and the politicization of everyday life.David Chandler - 2014 - European Journal of Social Theory 17 (1):42-59.
In liberal modernity, the democratic collective will of society was understood to emerge through the public and deliberative freedoms of associational life. Today, however, democratic discourse is much more focused on the formation of plural and diverse publics in the private and social sphere. In these ‘non-linear’ approaches, democracy is no longer seen to operate to constitute a collective will standing above society but as a mechanism to distribute power more evenly through the social empowerment of individuals and communities as (...)

This work studies the issue of political representation from the perspective of a specific legal culture, the exercise of political rights in the context of the occidental democratic system, a concept that has undergone a profound evolution to the present day. The essential aspects for an analysis of this progression are voting, decision making, and the relationship between representatives and their constituents. Overall, the phenomena making up the crisis of representation have been explained as a result of changes that have (...)

  • A Libertarian Defense of Title II of the 1964 Civil Rights Act.William Kline - 2022 - Journal of Business Ethics 185 (1):75-87.
Twice in the _Journal of Business Ethics_, Walter Block provides a libertarian argument that The Civil Rights Act of 1964 is unjust because it is a violation of a business’s property rights and therefore ought to be repealed. No libertarian reply to Block has ever been given, creating the mistaken impression that his argument is the true representation of libertarian theory with regards to civil rights. This paper focuses on Title II and argues that both Block, and this prevailing opinion (...)

  • The International Rule of Law and the Idea of Normative Authority.Kostiantyn Gorobets - 2020 - Hague Journal on the Rule of Law 12 (2):227-249.
Domestic and international jurisprudence exist and develop as two ‘pocket universes’ in a sense that they belong to the same fabric of reality, but at the same time many concepts shift their meaning when moved from one pocket to another. This is of a paramount importance for the idea of the rule of law, which in domestic setting was forged in the flame of civil wars and struggles against the rulers. This history and such struggles are something international law has (...)

  • Market Fashioning.Patrik Aspers, Petter Bengtsson & Alexander Dobeson - 2020 - Theory and Society 49 (3):417-438.
How do markets come about? This article offers a first systematic analysis of three different ideal types of market fashioning: mutual adjustment, organization, and fields. Although aspects of these are identifiable in most empirical markets, these three ideal types provide analytic tools for students of real markets and marketplaces. After going through this comprehensive literature, it is argued that mutual adjustment, which refers to non-planned processes, is affinity with markets in which products are differentiated, for example, producer markets. Organization refers (...)
