In Fallacies and Judgments of Reasonableness, Frans H. van Eemeren, Bart Garssen and Bert Meuffels report on their systematic empirical research of the conventional validity of the pragma-dialectical discussion rules. The experimental studies they carried out during more than ten years start from the pragma-dialectical theory of argumentation developed at the University of Amsterdam, their home university. In these studies they test methodically the intersubjective acceptability of the rules for critical discussion proposed in this theory by confronting ordinary arguers who (...) have not received any special education in argumentation and fallacies with discussion fragments containing both fallacious and non-fallacious argumentative moves. The research covers a wide range of informal fallacies. In this way, the authors create a basis for comparing the theoretical reasonableness conception of pragma-dialectics with the norms for judging argumentative moves prevailing in argumentative practice. Fallacies and Judgments of Reasonableness provides a unique insight into the relationship between theoretical and practical conceptions of reasonableness, supported by extensive empirical material gained by means of sophisticated experimental research. This article addresses the relationship between understanding and believing from the cognitive perspective of information-processing. I promote, within the scope of the Critical Discourse Analysis agenda, the relevance of an account of belief-fixation sustained by a combination of argumentative and cognitive insights. To this end, I first argue that discursive strategies fulfilling legitimization purposes, such as evidentials, tap into the same cognitive mechanisms as arguments. I then proceed to examine the idea that the most effective arguments are the ones that (...) manage to obscure or make irrelevant counter-evidence and propose, from a cognitive pragmatic perspective, a formulation of rhetorical effectiveness as a constraint on information-selection taking place at the interpretation stage and decisively influencing the evaluation stage responsible for belief-fixation. ABSTRACT The logic of humor has been acknowledged as an essential dimension of every joke. However, what is the logic of jokes, exactly? The modern theories of humor maintain that jokes are characterized by their own logic, dubbed “pseudo,” “playful,” or “local,” which has been the object of frequent criticisms. This article intends to address the limitations of the current perspectives on the logic of jokes by proposing a rhetorical approach to humorous texts. Building on the traditional development of Aristotle’s (...) almost neglected view of jokes as surprising enthymemes, the former are analyzed as rhetorical arguments. Like enthymemes, jokes are characterized by natural inferences that can be represented as topics, and quasi-formalized in argumentation theory as argumentation schemes. Like rhetorical arguments, jokes express a reason in support of different types of conclusions and proceed from distinct kinds of reasoning and semantic relations. (shrink)

Článek se věnuje argumentu kluzkého svahu a otázce, jak jej identifikovat a hodnotit. Argument kluzkého svahu je využíván v rámci praktického uvažování a v dialogu, svou strukturou odpovídá negativnímu argumentu z důsledku, má v zásadě defeasibilní povahu a je často účinný při snaze přenést důkazní břemeno na stranu oponenta. Hodnocení argumentu kluzkého svahu je založeno na kontextu dialogu spíše než na hodnocení jeho deduktivní či induktivní správnosti.V příspěvku jsou představeny čtyři typy argumentu. Zaprvé argument kluzkého svahu typu sorites, jehož označení (...) odkazuje k paradoxu sorites neboli paradoxu hromady. Argument kluzkého svahu typu sorites je ve své podstatě kombinací argumentu ad absurdum a sofismatu polyzeteseos. Zadruhé kauzální argument kluzkého svahu, který se zakládá na předpovědi série událostí. Tento typ argumentu je často označován jako teorie domina či dominový efekt. Nicméně, ať už jej pojmenujeme jakkoli, zásadní pro jeho identifikaci, analýzu a hodnocení je fakt, že se jedná o předpověď budoucího stavu věcí. Předpověď více či méně pravděpodobnou, zakládající se na slabých či silných předpokladech. Zatřetí precedentální argument kluzkého svahu, který se objevuje v diskuzích o možnosti změny současného pravidla či platné normy. Argumenty založené na precedentu obecně souvisí s usuzováním na základě konkrétního případu. Precedentální argument kluzkého svahu využívá podobnosti mezi případy, a je tedy založen na analogii. A posledním, čtvrtým typem argumentu kluzkého svahu, kterému se příspěvek věnuje, je tzv. plný argument kluzkého svahu či kombinovaný argument kluzkého svahu. (shrink)

In this article the author develops a framework for a pragma-dialectical reconstruction of teleological argumentation in a legal context. Ideas taken from legal theory are integrated in a pragma-dialectical model for analyzing and evaluating argumentation, thus providing a more systematic and elaborate framework for assessing the quality of teleological arguments in a legal context. Teleological argumentation in a legal context is approached as a specific form of pragmatic argumentation. The legal criteria that are relevant for the evaluation of teleological argumentation (...) are discussed and translated in terms of critical questions that are relevant for the evaluation of the various forms of teleological argumentation. The article examines the use and evaluation of the argument from consequences, its historical origins since Aristotle through Blaise Pascal, David Hume until the inclusion of this argument into the textbooks of modern logic. The article also recapitulates current evaluation of this argument by Douglas Walton and along with Walton presents its two variants and criteria for evaluating their validity.
