Das vorliegende Buch präsentiert eine phänomenologische Analyse der verschiedenen Formen zwischenmenschlicher Gewalt und ihrer oft unterbelichteten Beziehungen. Auf der Grundlage einer Transformation der Phänomenologie und im Rekurs auf den aktuellen Diskurs der Gewaltforschung entwickelt es einen methodologischen Rahmen für eine nicht-reduktive Analyse von Gewalt, der in angewandten phänomenologischen Fallstudien erprobt wird. -/- Gewalt war bislang vorwiegend in den Human und den Sozialwissenschaften ein zentrales Thema, wurde aber nur allzu selten zum Gegenstand genuin philosophischer Reflexion. Um dieses Desiderat aufzugreifen und die (...) Bedeutung philosophischer Reflexion für den Diskurs über Gewalt zu demonstrieren, entwickelt das vorliegende Buch einen phänomenologischen Ansatz zur Analyse zwischenmenschlicher Gewalt. Seine Intention besteht darin, ein Korrektiv zu den konventionellen, allzu einseitig verfahrenden instrumentalistischen, essentialistischen oder funktionalistischen Erklärungen von Gewalt vorzulegen. -/- Im Anschluss an eine kritische Reflexion auf zentrale Aporien des Gewaltdiskurses, denen es sich zu stellen gilt, integriert der Autor relevante Theoreme klassischer Phänomenologie mit neueren Ansätzen in einen umfassenden Analyserahmen. In drei „Fallstudien“ wird dieser Rahmen in konkreten Phänomenanalysen angewandt und der ihm zugrunde liegende weite Gewaltbegriff auf die Probe gestellt. Das Buch schließt mit einem Entwurf einer „relationalen Phänomenologie“, die es erlaubt, die vielfach unterbelichteten bzw. ausgeblendeten Beziehungen zwischen den verschiedenen Formen von Gewalt ins Auge zu fassen. This paper explores the concept of myth in two books written by Kōsaka Masaaki, The Historical World and Philosophy of the Nation. In both, myth appears as a central moment in the transition from primitive to modern societies. The role of myth is closely related to Kōsaka’s notion of nature, since one goal of his reflection is to show how history is supported by the “substratum” of nature. In this sense, he also distinguishes between the natural and historical aspects of (...) nations. After analyzing the subcategories of primordial nature, environmental nature, and historical nature, the paper shows how these layers are articulated by myth. Authority, in the contractual form of potlatch, signalizes the moment of transition to the true self-determination of nations. Miki Kiyoshi was one author who pointed out the problematic aspects of Kōsaka’s theory of nation. A comparison with Miki’s thought uncovers how authority is the main characteristic of Kōsaka’s view of myth. The paper finishes by investigating where this authority comes from. Since it cannot come from nature alone, it should also come from the past character of myth itself, which is an expression of what Kōsaka terms “the eternal now”. (shrink)

This contribution focuses on strategic ineffability in Plato. Strategic ineffability serves different purposes. In Plato, it is mainly used to express a religious feeling of dependence and to emphasize the remoteness of the divine. However, its meaning is not only religious. It is also part of a complex narrative device that often resorts to irony in order to de-emphasize the most arduous and controversial metaphysical speculations. Whereas topoi of affected modesty and unspeakability may only play an aesthetic role, strategic ineffability (...) has to do with relevant communication: it is a way to share with (and induce in) other people feelings, goals and morally relevant beliefs, without entailing any accurate conceptual content. Knowledge is not the primary goal here. The paper argues that Plato, Plotinus and other ancient philosophers used the notion of divine ineffability strategically to share beliefs with their selected audiences and lead their disciples to spiritual change. Critics of Western medicine have long heralded a “new paradigm” opposed to the reigning materialistic worldview of biomedical science and allopathy. This new paradigm has undergone several name changes (e.g., holistic, alternative, complementary, integrative) and presumably advances a radically new worldview. On closer inspection, it looks more like the opposite pole of the same dualistic worldview and not a radical break with the past. A truly new paradigm prepared to jettison tacit conceptual assumptions would have significant implications for medical research, (...) provided that institutional and professional constraints not inhibit the studies to follow. A research agenda is proposed comprising possible jumping-off points for investigators comfortable with working around the reigning assumptions both of current medical thinking and of a rapidly institutionalizing integrative-medicine worldview. These include proposed medical research on spirituality, alien abductions, hierophanies, thought forms, placebo pharmacology, radionics, arcane medical wisdom, prenatal ensoulment, and musical genetics. Gender greatly impacts access to opportunities, potential, and success in corporate leadership roles. We begin with a general presentation of why such discussion is necessary for basic considerations of justice and fairness in gender equality and how the issues we raise must impact any ethical perspective on gender in the corporate workplace. We continue with a breakdown of the central categories affecting the success of women in corporate leadership roles. The first of these includes gender-influenced behavioral factors, such as the (...) requirements and expectations of gendered verbal and nonverbal communication styles as well as appearance. We move on to address the impact of family on corporate leadership opportunities and success, discussing the asymmetrical evaluation of an individual’s potential, authority, and competence based on gender stereotypes of familial obligations and expectations. Finally, we address how gender impacts access to networking and sponsorship opportunities and the long-term effects of systematic limitations on women’s inclusion in the upper echelons of corporate leadership. We conclude with a summary of the questions and issues raised by our discussion and direct individuals to consider how different ethical systems and moral requirements might influence their interpretations of gender and leadership in the corporate workplace. In this article, I engage with Derrida’s deconstructive reading of theories of performativity in order to analyse Max Weber’s sovereignty–legitimacy paradigm. First, I highlight an essential articulation between legitimacy and sovereign ipseity (understood, beyond the sole example of State sovereignty, as the autopositioned power-to-be-oneself). Second, I identify a more originary force of legitimation, which remains foreign to the order of performative ipseity because it is the condition for both its position and its deconstruction. This suggests an essential fallibility of the (...) performative, which implies a ‘mystical’ legitimacy and a paradoxical, divisible and self-differential representation of sovereignty. The structural differentiality of legitimacy and sovereignty signifies an irreducible coloniality of law and language, but also suggests the possibility of an unconditional resistance located in the radical interpretability of the law, beyond determined representations of powers, dominations, sovereignties or resistances. This reflection is triggered by a reading of Cynthia Weber’s theory of ‘performative states’, describing sovereignty under the form of an impossible ontology, which leads me to elaborate the notion of legitimation-to-come as a non-ontological ‘concept’: this notion of unconditional legitimacy, beyond sovereignty, binds beliefs and phantasms to the unpresentable force of the event. Pursuing the efforts of scholars such as Rob Walker and Cynthia Weber, I sketch the implications of this archi-performative legitimacy regarding the methodological protocols of International Relations and sociology, in view of elucidating the persistent ontological presuppositions of these disciplines. This paper argues that social inequality is possibly the core topic of any critical theory in the social sciences – for epistemological as well as ethical reasons. As the social scientist is part of the scientific object, namely society, the project of science is interdependent with its object. For this reason, the structure of society itself influences the shape of social science. At the same time, the processes and results of the scientific project have an impact on society. Science changes (...) its own object. Epistemological issues are therefore tied to the ethical questions about the social organization of the scientific project, access to science, the structure of society and inequality. If access to science is unequal and if science contributes to inequality, this has to be legitimized scientifically. (shrink)

El presente artículo comienza reconstruyendo las razones por las cuales las teorías modernas se concentran en la ciudadanía como una garantía muy importante de legitimidad -arguyendo que la ciudadanía está intrínsecamente ligada a una forma republicana de orden político. La segunda parte del artículo muestra que, bajo las actuales condiciones de la globalización, la ciudadanía crea o mantiene un orden transnacional multinivel que impide que otras personas y políticas puedan realizar una ciudadanía (completa), y que incluso contribuyen a violaciones directas (...) de exigencias legítimas por parte de no-ciudadanos. La tercera parte discute críticamente las propuestas de Archibugi, Owen y Baubóck acerca de cómo repensar la ciudadanía transnacional o formas equivalentes de participación y control. En la parte final, el artículo aboga por una conexión entre la concepción de la ciudadanía constelación y una forma específica de democracia transnacional. Tal conexión permitiría a la ciudadanía seguir siendo el factor clave para la legitimidad. This article starts by reconstructing the reasons for the modern focus on citi-zenship as a major guarantee for legitimacy - arguing that citizenship is intricately linked to a republican form of political order. In its second part this paper shows that under the current conditions of globalization citizenships creates or maintains a transnational multi-level order which prevents other persons and polities from realizing (full) citizenship, and even contributes to direct violations of legitimate claims of non-citizens. The third part of the article critically discusses proposals by Archibugi, Owen and Baubóck, how to rethink transnational citizenship or equivalent forms of participation and control. And in its final part it advocates linking the conception of constellational citizenship to a specific form of trans-national democracy. With such a link citizenship could continue to be the key factor for legitimacy. (shrink)

The wantok system in the Solomon Islands and the Melanesian countries more broadly, strongly links to the practices of group identity and belonging, reciprocity, and caring for one’s relatives. It is a term used to express patterns of relationships that link people in families, tribes, islands, provinces, nationality and even more superficially at greater Melanesian sub-regional aggregates. Various aspects of the wantok system are called different names by distinct language groups in Papua New Guinea, Solomon Islands and Vanuatu. Nevertheless, the (...) word wantok originates from the English words ‘one talk’, which literally means in Melanesian pidgin, speakers of the same language. (shrink)

This is a translation of the afterword of Legality and Legitimacy, rewritten by Carl Schmitt in 1958 for his collection Verfassungsrechtliche Aufsätze aus den Jahren 1924–1954. In the afterword, Schmitt once again describes the situation in Germany in the early 1930’s, and argues against the influential German lawyers who rejected his interpretation of the Weimar Constitution. He rejects the wide-spread opinion that he wanted a state of emergency in Germany to be introduced, and insists that this book was his final (...) attempt to rescue the presidential republic of Weimar Germany. Schmitt then demonstrates the weakness of legal positivism and specifically stops at the several key points in his argument. First, according to Schmitt, the positivists did not know that legality, an unopposed form of the manifestation of legitimacy, had originally been an essential part of Western rationalism. Second, it is necessary to distinguish between the law and the sanctions because of their different legal statuses. This distinguishing is important because the legislative state was gradually becoming the administrative state. As a result, the governing institutions are more powerful than the parliamentary laws. Any parliamentary decision providing executive bodies relevant authority cannot be executed without an effective parliamentary majority. Thirdly, Schmitt explores the question of the so-called “premiums” for the legal possession of power. The afterword concludes with a brief overview of the situation at the end of the January 1933. In his classical paper C. Wright Mills suggests a novel view of the motives within the framework of sociology of knowledge. Contrasting an approach of sociology of knowledge to subjectivistic understanding of the motives as outer manifestation of the inner elements, Mills locates a particular types of action within typical frames of normative actions and socially situated clusters of motive. Motives is something that is imputed and avowed by actors, therefore it is necessary to consider, first, how different motives are (...) assigned by different actors to themselves and others in certain social and historical situations, and second, how different vocabularies of motive conflict with each other and replace each other over time. In this case motives are not a manifestations of some inner impulses but a justifications of the behavior. (shrink)

La finalidad de este artículo es mostrar la originalidad de la categoría lógica de "historicidad" propuesta por Max Weber, sugiriendo que en sus obras sobre la metodología de las ciencias histórico-sociales se puede encontrar una estimulante y precursora contribución al análisis de algunos problemas lógicos y formales referentes a la relación entre el conocimiento humano y el caos de la realidad (lo que podríamos llamar, ante litteram, "ciencia del caos"). Particularmente, considerando que en Weber el conocimiento científico no encuentra en (...) el mundo natural "hechos" a los cuales agarrarse sino un caos de acontecimientos únicos e infinitamente divisibles, el análisis se concentra en los siguientes aspectos: (a) la separación de la imputación causal de la noción de una ley (natural) necesaria; (b) la importancia atribuida a los "juicios de probabilidad" con diferentes grados de certeza; (c) la irreductibilidad de los acontecimientos individuales a modelos, leyes y tipos-(ideales) científicos; (d) los efectos asociados a la diferenciación del punto de vista de un observador científico. This paper aims at revealing the originality of Max Weber's conception of the logical category of "historicity", suggesting that in his writings on the methodology of the social sciences we can find a stimulating and forerunner contribution to the analysis of some logical and formal problems concerning the relationship between human knowledge and the chaos of reality (what we might call, antelitteram, "science of chaos"). In particular, considering that in Weber's conception scientific knowledge finds no facts "to grasp" in the natural world, but rather a chaos ofunique and infinitely divisible events, the analysis will be focused on the following aspects: (a) Weber's separation of causal imputation from the notion of necessary (natural) law; (b) the importance attached to "probability judgments" with different degrees of certainty; (c) the proclaimed irreducibility of individual events to scientific models, laws, and (ideal)-types; (d) the effects imputed to the differentiation of the point of view of a scientific observer. This article intends to compare the pure We-relationship in Schütz to what happens between us in Waldenfels. Schütz criticizes Weber’s basic methodological concepts: behavior and rationalism. For Schütz it is impossible through rational observance on relational behavior to guarantee the objectivism of sociology as a science. Schütz tries to prove that only a sociological theory that shows the different realms/worlds from which the interpretation of a product is built, with its obvious limitation of grasping the real meaning, while also clarifying (...) the deep relationship with others, can in fact illustrate its relative anonymity or concreteness. This task involves a sense of searching for concreteness instead of taking for granted its objectiveness. For Waldenfels, the pure We-relationship is too fixed in the subjectivity that is based on one-sided understanding, and decreases possibilities of the event occurring between us. For Schütz, one deals with an eternal paradox of interpretation that will not make us acquainted completely with the other’s mind. The lack of fissure in the We-relationship does not leave space for the possibilities of what happens between us, in other words, the meaning is arrested in subjectivity in an attempt to make meaning as concrete as possible. Waldenfels will not say that the meaning in its integrality can be found, but he will open ways, which lead to a threshold where/elsewhere one will find fissures, new possibilities that first penetrate the body and after can take place in attitudes towards the other. This article deals with the first part of beginning teachers, as actors of education in the school environment. Discipline plays a role in the procedural and personal control activities beginning teacher. Defining discipline is based on the concept of power and power elements, combined with the perception of educational situations in the school setting themselves actors - teachers. The second part introduces to some selected discourses indicators and outlines opportunities for further work with the concepts of discipline.
