  1. Law & Bioethics: From Values to Violence.Susan M. Wolf - 2004 - Journal of Law, Medicine and Ethics 32 (2):293-306.
Debate over the relationship of law and bioethics is growing - what the relationship has been and what it should be in the future. While George Annas has praised law and rights-talk for creating modern bioethics, Carl Schneider has instead blamed law for hijacking bioethics and stunting moral reflection. Indeed, as modern bioethics approaches the 40-year mark, historians of bioethics are presenting divergent accounts. This article explores solidarity as an ethical concept underpinning rules in the global health context. Second, it considers the manifestation of solidarity in two international regulatory instruments. It concludes that, although solidarity is represented in these instruments, it is often incidental. This fact, their emphasis on other values and their internal weaknesses diminishes the (...)

  • Use and abuse of empirical knowledge in contemporary bioethics.Jan Helge Solbakk - 2004 - Medicine, Health Care and Philosophy 7 (1):5-16.
In 1997 a debate broke out about the ethical acceptability of using placebo as a comparative alternative to establishe effective treatment in trials conducted in developing countries for the purpose of preventing perinatal HIV-transmission. The debate has now been going on for more than five years. In spite of extensive and numerous attempts at resolving the controversy, the case seems far from being settled. The aim of this paper is to provide an updated account of the debate, by identifying empirical (...)
