In democratic theory, “legitimacy” refers to the set of conditions that must be in place in order for the claims to authority of somebody to be deemed appropriate, and for their claims to compliance to be warranted. Though criteria of legitimacy have been elaborated in the context of democratic states, there is no reason for them not to be drawn up, with appropriate amendments, for other kinds of authority structures. This paper examines the claims to authority made over researchers by (...) international bodies governing research ethics, who exercise their authority by the research ethics guidelines they produce (including recent revisions to the Declaration of Helsinki and CIOMS Guidelines). We argue that discussions of such bodies and sets of guidelines often elide questions of justification and questions of legitimacy, and that the grounds that might allow us to mount a strong case for the latter are at present sorely underdeveloped. During the 1960s and 1970s, institutionalists and behavioralists in the discipline of political science argued over the legitimacy of the institutional approach to political inquiry. In the discipline of philosophy, a similar debate concerning institutions has never taken place. Yet, a growing number of philosophers are now working out the institutional implications of political ideas in what has become known as “non-ideal theory.” My thesis is two-fold: (1) pragmatism and institutionalism are compatible and (2) non-ideal theorists, following the example of (...) pragmatists, can avoid a similar debate as took place between institutionalists and behavioralists by divulging their assumptions about institutions. The paper's aim is to tackle some significant challenges faced by democratic theory in plurinational societies. Claims to recognition challenge the assumption of a ‘people speaking in one voice’ and therefore, some basic tenets of liberal democracy. In a context where one cannot assume anymore a homogeneous demos, it is tempting to believe that there may be an independent, yet democratic, principle that may help us to solve the problem of the ‘constitution of the demos.’ Goodin argues that the all-affected (...) interests principle is in fact the best principle of inclusion in democratic decision-making. Yet I argue that the all-affected interests principle is not really useful, at least as a starting point. But if this is so, and if the picture underlying modern democratic theory is seriously undermined by claims to recognition, how are the communities to which self-rule necessarily relates to be bounded? Abstract: The emergence of cross-border communities and transnational associations requires new ways of thinking about the norms involved in democracy in a globalized world. Given the significance of human rights fulfillment, including social and economic rights, I argue here for giving weight to the claims of political communities while also recognizing the need for input by distant others into the decisions of global governance institutions that affect them. I develop two criteria for addressing the scope of democratization in transnational contexts— (...) common activities and impact on basic human rights —and argue for their compatibility. I then consider some practical implications for institutional transformation and design, including new forms of transnational representation. (shrink)

Abstract: In this essay a set of principles is defended that yields a determinate allocation of sovereign competences across a global system of territorially nested jurisdictions. All local sovereign competences are constrained by a universal, justiciable human rights regime that also incorporates a conception of cross-border distributive justice and regulates the competence to control immigration for a given territory. Subject to human rights constraints, sovereign competences are allocated according to a conception of global democracy. The proposed allocation scheme can accommodate (...) substantial local autonomy while at the same time ensuring that everyone has a voice in the political decisions that affect his or her interests. The relevant class of affected interests is fully specified. Relevant affects are of two kinds: those that impose norms of governance on individuals, and those that impose external costs on them. Central planners and citizens, conservatives and reformers, 19th-century liberal statisticians and today's advocates of sustainable development all draw on statistics for the elaboration and communication of political visions. Yet, this striking phenomenon has so far largely escaped the attention of political philosophers in the English-speaking world. As politics has come to be informed and shaped by statistics, there is a need to scrutinize omnipresent statistical accounts for their political vision. Taking as its political vision the idea of society as a (...) fair system of co-operation, this thesis offers a series of essays towards a political philosophy of statistics. To this end, the thesis retrieves the statistical macro-scopic point of view in the vision of co-operation as spelled out by John Rawls and contrasts this uptake of statistics with the one in Martin Heidegger's phenomenology of everydayness. The goal is to make explicit the implicit role of statistics in the philosophical reflection of these thinkers. This thesis then argues for the place of statistics in a system of co-operation in terms of accountability institutions. It also engages the contemporary political issue of sustainable development, which has seen the rapid development and use of statistics. It argues that the Index for Sustainable Development is not a measure of sustainable development, but rather a debunking index. As such, it is a stepping stone for more systematic accounts, such as the eco-space proposal. For these proposals to make a positive contribution to sustainable development, they must be situated within a vision of large-scale political society. (shrink)
