  1. Quotas: Enabling Conscientious Objection to Coexist with Abortion Access.Daniel Rodger & Bruce P. Blackshaw - 2020 - Health Care Analysis 29 (2):154-169.
The debate regarding the role of conscientious objection in healthcare has been protracted, with increasing demands for curbs on conscientious objection. There is a growing body of evidence that indicates that in some cases, high rates of conscientious objection can affect access to legal medical services such as abortion—a major concern of critics of conscientious objection. Moreover, few solutions have been put forward that aim to satisfy both this concern and that of defenders of conscientious objection—being expected to participate in (...)

  • Beyond Duty: Medical “Heroes” and the COVID-19 Pandemic.Wendy Lipworth - 2020 - Journal of Bioethical Inquiry 17 (4):723-730.
When infectious disease outbreaks strike, health facilities acquire labels such as “war zones” and “battlefields” and healthcare professionals become “heroes” on the “front line.” But unlike soldiers, healthcare professionals often take on these dangerous roles without any prior intention or explicit expectation that their work will place them in grave personal danger. This inevitably raises questions about their role-related obligations and whether they should be free to choose not to endanger themselves. In this article, I argue that it is helpful (...)

  • Physician–Patient Relationship, Assisted Suicide and the Italian Constitutional Court.E. Turillazzi, A. Maiese, P. Frati, M. Scopetti & M. Di Paolo - 2021 - Journal of Bioethical Inquiry 18 (4):671-681.
In 2017, Italy passed a law that provides for a systematic discipline on informed consent, advance directives, and advance care planning. It ranges from decisions contextual to clinical necessity through the tool of consent/refusal to decisions anticipating future events through the tools of shared care planning and advance directives. Nothing is said in the law regarding the issue of physician assisted suicide. Following the DJ Fabo case, the Italian Constitutional Court declared the constitutional illegitimacy of article 580 of the criminal (...)

  • Conscientious objection and the referral requirement as morally permissible moral mistakes.Nathan Emmerich - 2023 - Journal of Medical Ethics 49 (3):189-195.
Some contributions to the current literature on conscience objection in healthcare posit the notion that the requirement to refer patients to a non-objecting provider is a morally questionable undertaking in need of explanation. The issue is that providing a referral renders those who conscientiously object to being involved in a particular intervention complicit in its provision. This essay seeks to engage with such claims and argues that referrals can be construed in terms of what Harman calls morally permissible moral mistakes. (...)

  • “I haven’t had to bare my soul but now I kind of have to”: describing how voluntary assisted dying conscientious objectors anticipated approaching conversations with patients in Victoria, Australia.Louise Anne Keogh & Casey Michelle Haining - 2021 - BMC Medical Ethics 22 (1):1-12.
BackgroundDealing with end of life is challenging for patients and health professionals alike. The situation becomes even more challenging when a patient requests a legally permitted medical service that a health professional is unable to provide due to a conflict of conscience. Such a scenario arises when Victorian health professionals, with a conscientious objection (CO) to voluntary assisted dying (VAD), are presented with patients who request VAD or merely ask about VAD. The Voluntary Assisted Dying Act 2017 (Vic) recognizes the (...)
