“Bodily autonomy” has received significant attention in bioethics, medical ethics, and medical law in terms of the general inviolability of a patient’s bodily sovereignty and the rights of patients to make choices (e.g., reproductive choices) that concern their own body. However, the role of the body in terms of how it can or does contribute to a patient’s capacity for, or exercises of their autonomy in clinical decision-making situations has not been explicitly addressed. The approach to autonomy in this paper (...) is aligned with traditional theories that conceive autonomy in terms of an individual’s capacities for, and exercises of rational reflection. However, at the same time, this paper extends these accounts by arguing that autonomy is, in part, embodied. Specifically, by drawing on phenomenological conceptions of the experience of autonomy, we argue that, in principle, the body is a necessary component of the capacity for autonomy. Secondly, through the presentation of two different cases, we highlight ways in which a patient’s body can contribute to the autonomy of treatment choices. Ultimately, we hope to encourage others to explore additional conditions under which a concept of embodied autonomy should be employed in medical decision making, how its underlying principles might be operationalised in clinical situations, and its consequences for approaches to patient autonomy in healthcare practice, policy, and law. What I intend to demonstrate in this paper is that Heidegger pretends to immunize his philosophy from any possibility of refutation. The thesis that I argue is that precisely because the ontological cannot be corroborated by the empirical realm and, on the other hand, does not provide a foundation for what he considers the a priori, the German philosopher shields his philosophy from any kind of reply: the ontological cannot be corroborated by beings and, at the same time, it can (...) only be reached by a “leap”. The question is: on what is the a priori founded? how to establish the validity or legitimacy of a horizon? There seems to be no answer. (shrink)

In the following I show that Hubert Dreyfus’ account of skill rests on a misguided interpretation of Martin Heidegger’s work on understanding in Being and Time. Dreyfus separates understanding according to the analytic philosophical concept pair, so called ‘know-how’ and ‘knowledge-that’, that corresponds for him to the pragmatist differentiation between skillful acting and theoretical conceptual thinking. Contrary to that, Heidegger argues that only one form of understanding exists that is neither captured by ‘know-how’, ‘knowledge-that’ or a combination of both. Instead (...) of presupposing two radically different ways to engage with the world, one practical-agential, the other theoretical-conceptual, Heidegger shows that all genuine forms of comportments rest on the same form of understanding that exhibits the highest degree of intelligibility when we deal with the world ordinarily. The Heideggerian account therefore comes without the many dichotomies so often criticized in the literature on skill and understanding, and offers a radically different view of world disclosure and of what we do when we ‘theorize’. ABSTRACT Testimony from victims of gendered violence is often wrongly disbelieved. This paper explores a way to address this problem by developing a phenomenological approach to testimony. Guided by the concept of ‘disclosedness’, a tripartite analysis of testimony as an affective, embodied, communicative act is developed. Affect indicates how scepticism may arise through the social moods that often attune agents to victims’ testimony. The embodiment of meaning suggests testimony should not be approached as an assertion, but as a process of (...) ‘articulating an understanding’. This account is deepened in the discussion of testimony as a communicative act. It is argued that testimony must be considered as a relational whole, and thus our aim in receiving victims’ testimony should be to honour the relational conditions under which the truth of testimony can be heard. Approaching testimony as the collaborative process of enabling an understanding to be articulated can enhance our conception of gendered violence, whilst also better serving the victims of gendered violence by helping to overcome the lack of trust and excessive scepticism with which victims’ testimony is often met. Existentialist philosophy offers an understanding of how trying to eliminate ambiguities that inevitably mark the human condition only seemingly leads to freedom. This existentialist outlook can also serve to shed light on how democratic politics may similarly show tendencies which aim at overcoming immanent tensions. Such tendencies in democratic politics can be clarified using Sartre’s notion of ignorance – and truth as its counterpart. His concept of ignorance goes beyond merely facts or knowledge and refers to a mode of being. (...) It expresses a subject’s desire to avoid, rather than confront, resistances stemming from the world. Based on a distinction of different forms in which this orientation can manifest itself, this article shows how democratic politics, too, can be threatened by ignorance as a way of doing politics. This ignorance comes in different guises which all express a desire to eliminate tensions that democratic politics cannot overcome without undermining itself. (shrink)

In this paper, we pose a speculative encounter between Heidegger and the Chinese Song Dynasty landscape painter Xia Gui. Our intention is to reassess Heidegger’s theory of the fourfold. By placing the concept in a cross-cultural context, we argue that Heidegger was essentially correct in that the world is structured as a fold between interrelated elements. At the same time, we challenge the quantity and quality of the folded elements. If one turns to the work of Xia Gui in conjunction (...) with relevant Daoist texts, what one finds is a threefold structure to the world, composed of earth, sky, and mortals without Heidegger’s emphasis on divinities. In conclusion, we suggest that studying the folding structure of the world ought to be done through cultural comparisons of philosophical and aesthetic traditions in order to understand the potentiality for worldhood as an xfold. The paper works out an account of the piety proper to philosophical thought. The investigation proceeds as a critical interpretation of three enigmatic claims made by Martin Heidegger about ‘the piety of thinking,’ but the paper is not simply exegetical; the interpretive work is constantly in service of an attempt to think through the phenomenon independently. Plato’s Euthyphro and Nietzsche’s critique of scientific piety both hover in the background of Heidegger’s pronouncements, and they are given special attention here. Through the (...) investigation, philosophical piety is shown to be a virtuous capacity to respond with fitting submission to the truth as what is insurmountably prior to us. To respond fittingly is, at least, to deal well with sameness and difference, which in the case of piety means to recognize two features of our situation: that philosophical questioning necessarily arises out of a fundamental listening, or affirmation, and that we always belong to being but only ever across a gap. The philosopher Martin Heidegger argued that the truthful life was at risk of being lost in Western technological culture in the name of increasing control, efficiency, and agility. As the risk is actualised, so the human essence as truth maker is obscured and life itself feels poorer. This thesis draws on Heideggerian philosophy to demonstrate the loss in two dominant styles of contemporary strategic management: the world-picturing and, more recent, agile style. It builds a theory of post-agile strategic practice, which (...) I call adaptive, to address this loss. Consistent with Heideggerian philosophy, I utilise a transformative disclosure methodology and a literary, paradigmatic case reading method to address the questions: Why is agile strategic management so unsatisfying? How do Heideggerian scholars shed light on this dissatisfaction? How do Heideggerians understand the emerging style and what strategic management practices can I propose for the future? After introducing agile strategic management and the impoverishment of life that it fosters, I set out how Heidegger’s philosophy of truth, thinking, and the sacred both sheds light on the problem and suggests a remedy for it. I closely read paradigmatic texts of the world-picturing and agile strategic management styles to demonstrate how business strategy theorisation lines up with extraordinary closeness to Heidegger’s philosophical assessment. I then analyse three Heideggerian prototypes for an adaptive style of strategy practice, concentrating on one paradigmatic text to identify their principal weakness: the omission of the sacred. I illustrate and contrast paradigmatic cases of both the agile and adaptive styles drawn from the beer industry and draw on the adaptive case to construct a theory of adaptive strategy practice, which addresses the problem of the loss of truth, suggesting pedagogical and strategic management practices. I conclude by summarising its findings and contributions, noting some limitations and connections to other studies and suggesting further lines of research. (shrink)

This paper argues that Tugendhat's critique of Heidegger's existential conception of truth as disclosedness is usually misunderstood. The main claim of this paper is that Tugendhat insists against Heidegger on certain conventional features of truth such as conformity of the law of non-contradiction, not because he adheres to an ideal of truth as correctness; rather, he proposes an alternative existential conception of truth in terms of an active, critical or self-critical, engagement with untruth. Various recent objections to Tugendhat's critique of (...) Heidegger are discussed against the background of his alternative and are rejected. The paper concludes by outlining several challenges to Tugendhat's alternative existential conception of truth. (shrink)

The hermeneutical tradition represented by Yorck, Heidegger, and Gadamer has distrusted Dilthey as suffering from the two sins of modernism: scientific “positivism” and individualistic and aesthetic “romanticism.” On the one hand, Dilthey’s epistemology is deemed scientistic in accepting the priority of the empirical, the ontic, and consequently scientific inquiry into the physical, biological, and human worlds; on the other hand, his personalist ethos and Goethean humanism, and his pluralistic life- and worldview philosophy are considered excessively aesthetic, culturally liberal, relativistic, and (...) subjective. This essay involves two tasks in response to this negative evaluation of Dilthey that has shaped our current understanding of his philosophical project; first, an interpretation of the issues at stake in Heidegger’s reception of and struggles with Dilthey. These issues touch upon language, historicity, and the nature of hermeneutics. Second, by pursuing this task in light of Guignon’s interpretation of Dilthey and Heidegger, I hope to question and challenge the “overcoming” of Dilthey’s epistemic and life-philosophical hermeneutics in the “ontological” or “philosophical” hermeneutics of Heidegger. At the core of Heidegger's philosophy, there lies this nagging question: what is the link between language and being? Using a famous formulation by Heidegger as a guide (‘When we go to the well, when we go through the woods, we are always already going through the word “well”, through the word “woods”’), the analysis focuses on the connection Heidegger establishes between being (what woods and well ‘are’), understanding (something is understood ‘as’ woods or well), and temporality (human understanding of (...) woods and well has changed since ancient Greek times, for example). Language is both what grants things their way to matter to us and thus to ‘be’ for us to the extent that we understand them, but language is also linked to a ‘happening’ (Geschehen) or an event so that things are not bound to their Geek being or current being: things ‘become being’ (seiend werden). Language is both the means for things to materialize in historical times: ‘being woods’ or ‘being a well,’ as well as a testimony to their entry into being. This is why language in its poetic use can make beings ‘more being’ (seiender). (shrink)

Catharine MacKinnon’s feminist work on sexual abuse and violence has had a major impact on law and on policy in the United States and internationally. However, her complex theoretical writings, which are a foundation of that work, have yet to be adequately appreciated by philosophy, especially continental philosophy, that tradition with which she identifies her project. I explain her project in continental terms, especially Heidegger’s thought, so that we may better grasp the philosophical nature and significance of her work. In (...) doing so, I also open paths by which those within the continental tradition may make it more relevant to the pressing real-world problems that MacKinnon uniquely illuminates, especially pornography, prostitution, and other practices significantly constituted by sexual abuse and violence.
