Though responses to Stout's book, "Democracy and Tradition," have touched on his discussion of rights, none has comprehensively examined his position on the subject. Having endorsed several objections Stout raises against some influential views on democracy and rights, this article proceeds to criticize Stout's description and theoretical account of the natural and human rights traditions. The central argument is that Stout cannot successfully both affirm the traditions and adhere to his account.

The hypothesis that democracies rarely fight each other is well-supported for the contemporary era. Yet evidence for it in another era of many democracies—Greece in the fifth century BCE—is weak at best. This article considers several reasons why the experience of the two eras may differ. It shows that the causal reasoning of the contemporary democratic peace depends on key assumptions about how institutions constrain leaders that did not apply well in ancient polities. The compatibility between Western democracy and other cultures, and the desirability of democracy, are two important problems in democratic theory. Following an insight from John Rawls’s later philosophy, and using some key passages in Mencius, I will show the compatibility between a ‘thin’ version of liberal democracy and Confucianism. Moreover, elaborating on Mencius’s ideas of the responsibility of government for the physical and moral well-being of the people, the respectability of the government and the ruling elite, and the competence-based limited (...) political participation, I shall explore the Mencian criticisms of some ‘thick’ democratic ideas. Through the discussion in this paper, I hope to show the relevance of Confucianism to contemporary political philosophy and society. (shrink)

Advocates of political liberalism hold it as a superior alternative to perfectionism on the grounds that it avoids superfluous and/or controversial claims in favor of a maximally-inclusive approach undergirded by a "free-standing" justification for the ideology. These assertions prove difficult to defend: political interpretations of liberalism tend to be implicitly ethnocentric; they often rely upon a number of controversial, and even empirically falsified, assumptions about rationality--and in many ways prove more parochial than their perfectionist cousins. It is possible to reform (...) political liberalism to address these challenges, but generally at the expense of the supposed normative force and universality of the liberal project. However, this para-liberal approach is much better in keeping with contemporary findings in sociology, psychology and cognitive science--and can much more effectively accommodate the illiberal challenge. By revisiting late-Weimar debates between Carl Schmitt and two left-wing critics, Otto Kirchheimer and Franz L Neumann, we can shed light on the surprising alliance of populist politics with key tenets of economic liberalism, an alliance that vividly manifests itself in the political figure and retrograde policies of Donald Trump. In the process, we can begin to fill a striking lacuna in recent scholarly literature on populism, namely its failure to pay proper attention to matters of political economy. We can (...) also perhaps begin to make sense of the roots of Trump’s assault on the US federal state: formal law and its organizational basis, modern bureaucracy, represent potential restraints on the alliance of populism with neoliberalism. John Rawls claims that “benevolent absolutisms” honor human rights without honoring political participation rights. Critics argue that he is mistaken. One objection appeals to the instrumental value of political participation rights. This objection holds that without political participation rights, individuals cannot secure the content of their rights against encroachment. Given this, individuals without political participation rights cannot be said to have rights at all. Here, I evaluate this instrumental objection. I identify three ways of relating political participation rights to human (...) rights and show that one makes sense of Rawls’s claim. I then defend this view from instrumental objections. This has implications beyond the realm of Rawls scholarship. Many societies are not democratic and are not democratizing. We must determine whether any of these societies can secure at least the content of human rights and, if so, what shape their social and political institutions must take to do so. (shrink)

This paper examines the Obama Administration’s approach to democracy promotion in Egypt. After a brief discussion of the motivation for promoting democracy, this essay compares the Obama Administration to its predecessor and analyzes the changes that were spurred by the Arab Awakening. Did the Obama Administration, during and after the 2011 Revolution, fully support democratic change in Egypt not only with rhetoric but also with the financial and programmatic support necessary to help a transitioning country? Did the Obama Administration offer (...) a consistent message on the importance of democratic policies? Or did the administration allow other policy objectives to trump democratic efforts? This paper explores the language, policies, and funding employed by the Obama Administration in Egypt to see what the impact has been. (shrink)

The end of the Cold War brought about a new wave of proliferation of market economy and democracy. Both are spreading through purposeful efforts of Western exporters and Eastern importers as well as by way of example. These generally positive processes are not, however, without considerable negative side effects and setbacks. The article considers three pairs of dialectical contradictions: parallel democratization and introduction of free markets, democratization and liberalism, and democratization and nationalism. Naïve, hypocritical, and pragmatic approaches to democracy promotion, (...) as well as factors facilitating or hindering democratization (sometimes making it impossible) of specific societies, are analyzed. One of the central problems is the question of absolute or relative (contingent on time, space, and other factors) universality of democracy. The article concludes that democracy has to be mainly demand-driven, not supply-induced. It also considers to what extent external efforts can compensate for the weaknesses of domestic facilitators and what happens when there are attempts to export democracy to societies that are not ready for that. Poder-se-ia afirmar que os valores e ideais da modernidade conduzem à constituição das instituições do Estado Democrático de Direito. Trata-se de um longo e intrincado processo de feitura cujo resultado pode ser rastreado a partir de um complexo conjunto de visões teóricas e compromissos institucionais: princípios dos liberalismos político e filosófico, constitucionalismo e democracia deliberativa. Tal percurso revela-se acidentado, no entanto há uma presença constante entre os críticos da modernidade. Trata-se da perspectiva antiliberal de algumas posições conservadoras. Contemporaneamente, o quadro (...) das democracias ocidentais permite-nos rastrear as dimensões dessa críticatanto no que diz respeito às instituições representativas, quanto àinterpretação do papel e escopo de atuação do Direito no controle dos atos do Executivo. This article examines the impact of a pandemic on democratic societies. The central research question is the extent to which a pandemic can alter the trajectory of social and ethical democratic development nationally and internationally. Therefore, the article examines contemporary controversies in democratic society in the aftermath of a pandemic. The leading hypothesis is that the pandemic should reinforce the need for social solidarity, but it is unclear what political form this need will take: populism or deliberative/nonconsensual democracy.

One of the most problematic aspects of the ‘Harvard School’ of liberal international theory is its failure to fulfil its own methodological ideals. Although Harvard School liberals subscribe to a nomothetic model of explanation, in practice they employ their theories as heuristic resources. Given this practice, we should expect them neither to develop candidate causal generalizations nor to be value-neutral: their explanatory insights are underpinned by value-laden choices about which questions to address and what concepts to employ. A key question (...) for liberal theorists, therefore, is how a theory may be simultaneously explanatory and value-oriented. The difficulties inherent in resolving this problem are manifested in Ikenberry's writing: whilst his work on constitutionalism in international politics partially fulfils the requirements of a more satisfactory liberal explanatory theory, his recent attempts to develop prescriptions for US foreign policy reproduce, in a new form, key failings of Harvard School realism. This paper explores the issue of democracy and the role of the democratic classroom in the development of society in general, and the way in which educators understand and deal with diversity in particular. The first part of the paper explores different meanings of democracy and how they can be manifested in the classroom. We argue that the idea of a ‘democratic classroom’ is far too broad a category; democracy is defined in action and can have realist or pragmatic characteristics, (...) elitist or pluralist roots. The realist form of social education was championed by political scientist Charles Merriam, while a social educative process more dependent on pragmatic problem solving was pursued by educational philosopher John Dewey and those who followed in his theoretical wake. The history of democracy in the United States, and the battles of how to import different meanings of democracy into the classroom over the course of the 20th century is explored, suggesting that the educational establishment has a tendency to adopt more realist/elitist forms of civic education. We present five ‘democratic’ classrooms with different characteristics to illustrate the different characteristics social education can exhibit. In the second part of the paper we discuss the relationship between different types of democratic classrooms and issues of race/ethnicity/culture. (shrink)

Participation in deliberation in stable democracies produces effects which are beneficial for democracy, while the results of deliberative innovations in non-democracies are more ambiguous. This article contributes to the debate about the effects of participatory democratic innovations on attitudes, related to democratic commitments, political capacities and political participation, in the increasingly ubiquitous hybrid regimes. We present the evidence collected from the participants before and after deliberative mini publics (DMPs), held in Serbia in 2020. Serbia is an exemplary case of a (...) recent wave of autocratization, which had led to it becoming a hybrid regime, and it had no track record of deliberative innovations. When conducting the mini publics, we introduced an innovation in the standard design, by including active citizens - representatives of local initiatives or social movements particularly interested in the issue of DMPs. We could not find evidence that the democratic innovation affected attitudes of participants regarding democratic commitments, political capacities and political participation. However, we did find that participants of the DMPs became less satisfied with the functioning of the democracy on the local level. We argue that the anti-democratic wider context of hybrid regimes can produce adverse effects when introducing participatory democratic innovations, at least when it comes to this specific dimension of political participation. We conclude with the suggestions for further research, and a call for consideration of the wider political context when designing democratic interventions in hybrid regimes. (shrink)

A worrying trend of autocratization that has been spreading globally in recent years, has thrust forward a new wave of appeals for deliberative and participatory democracy as a remedy for the crisis. With a few exceptions, the majority of participatory and deliberative institutions were implemented in stable democracies. The efforts to institutionalize participatory and deliberative models are almost completely absent in Serbia and other Western Balkan countries. Yet, there has been a trend of citizen mobilization in the form of social (...) movements and local civic initiatives, which are both a symptom of unresponsive and quite openly authoritarian institutions, as well as a potential pathway to democratization. The pace and scope of these developments in the undemocratic societies of the Western Balkan region, in terms of both bottom up and top-down democratic experimentation, call for a better understanding of their internal dynamics, and their social and political impact. Responding to this need, the articles in the special issue focus on social movement mobilizations and deliberative experimentation. To begin with, our introductory article focuses particularly on understanding the possible role deliberative institutions could have in hybrid regimes. It looks at the first two cases of deliberative mini publics (DMPs) ever organized in Serbia, analyzing their rationale, specific design, implementation, as well as considering the possible role deliberative institutions could play in the hybrid regime of Serbia. Our starting point is the idea that different models of citizenship entail different ethos that define the ideal citizen, which in turn presuppose different emotions. We examine four models of citizenship: classic liberal, civic republican, deliberative democratic, and radical democratic. We suggest that their ideal citizens will be guided, respectively, by love of law, love of community or of country, love of truth and of justice, and love of the groups one belongs to and of power. Other political emotions ―such (...) as anger― and emotional processes ―such as empathy― are also directed towards different objects and actors in different ways, as channeled differentially by those forms of love. The purpose of this study is to classify and explain democracies in the 47 Muslim countries between the years 1998 and 2008 by using liberties and elections as independent variables. Specifically focusing on the context of the Muslim world, this study examines the performance of civil liberties and elections, variation of democracy practised the most, the elections, civil liberties and democratic transitions and patterns that followed. Based on the quantitative data primarily collected from Freedom House, this study demonstrates the following (...) aggregate findings: first, the “not free not fair” elections, the “limited” civil liberties and the “Illiberal Partial Democracy” were the dominant feature of elections, civil liberties and democracy practised in the Muslim world; second, a total of 413 Muslim regimes out of 470 remained the same as their democratic origin points, without any transitions to a better or worse level of democracy, throughout these 10 years; and third, a slow, yet steady positive transition of both elections and civil liberties occurred in the Muslim world with changes in the nature of elections becoming much more progressive compared to the civil liberties’ transitions.
