In chapter five of Wise Choices, Apt Feelings Allan Gibbard develops what he calls a ‘normative logic’ intended to solve some problems that face an expressivist theory of norms like his. The first is “the problem of embedding: The analysis applies to simple contexts, in which it is simply asserted or denied that such-and-such is rational. It says nothing about more complex normative assertions.”1 That is the problem with which I will be concerned. Though he doesn’t list it as one (...) of the problems to be solved, Gibbard’s devices also explain what it means to say that a certain normative argument is ‘valid’, that one normative statement follows from some others. Both of these questions arise because of the ways we ordinarily think and speak, ways which on a simplistic version of expressivism appear not to make any sense. An expressivist committed to making sense of the way we ordinarily think and speak in normative language owes some account of embeddings and of logic. Gibbard’s device seems to me the clearest and most systematic of any expressivist attempt to meet these challenges. (shrink)

The sentence ‘x is square’ might have had different truth conditions from those it in fact has. It might have had no truth conditions at all. Its having truth conditions and its having the ones it has rest on empirical facts about our use of ‘x is square’. What empirical facts? Any answer that goes into detail is inevitably highly controversial, but we think that there is a rough answer that is, by philosophers’ standards, relatively uncontroversial. It goes back to (...) Locke 1689 and beyond, and is best known to contemporary philosophers through the work of Grice 1957 and Lewis 1969. It is that we (usually implicitly) agreed, as a matter of contingent fact, to use ‘x is square’ as a way of conveying our taking it to be the case that x is square. (shrink)

Feinberg is one of the leading philosophers of law of the last forty years. This volume collects recent articles, both published and unpublished, on what he terms "basic questions" about the law, particularly in regard to the relationship to morality. Accessibly and elegantly written, this volume's audience will reflect the diverse nature of Feinberg's own interests: scholars in philosophy of law, legal theory, and ethical and moral theory.

Expressivists hold that ethical sentences express attitudes. We argue that it is very hard for expressivists to give an account of the relevant sense of 'express' which has some plausibility and also delivers the kind of noncognitivist account of ethical sentences they affirm. Our argument draws on Locke's point that words are voluntary signs.

It is sometimes suggested that expressivism in meta-ethics is to be criticized on grounds which do not themselves concern meta-ethics in particular, but which rather concern philosophy of language more generally. Frank Jackson and Philip Pettit (1998; see also Jackson and Pettit 1999, and Jackson 2001) have recently advanced a novel version of such an argument. They begin by noting that expressivism in its central form makes two claims—that ethical sentences are not truth evaluable, and that to assert an ethical (...) sentence is to express one’s desires or feelings rather than to report a fact. They then argue that, given some plausible premises in the philosophy of language emanating mainly from Locke, the two central claims of expressivism are contradictory: when combined with the plausible premises, they say, the second claim refutes the first. The purpose of this paper is to formulate Jackson and Pettit’s Lockean argument, and to suggest that it fails. (shrink)
