"Political Ideas in the Twentieth Century", Historical Inevitability", "Two Concepts of Liberty", "John Stuart Mill and the Ends of Life". These four essays deal with the various aspects of individual liberty, including the distinction between positive and negative liberty and the necessity of rejecting determinism if we wish to keep hold of the notions of human responsibility and freedom.

This article presents a critique of Philip Pettit’s concept of ‘freedom as non-domination’ and provides an alternative theory of both domination and republican political freedom. I argue that Pettit’s neo-republican concept of domination is insufficient to confront modern forms of domination and that this hampers his concept of republican freedom and its political relevance under the conditions of modernity. Whereas the neo-republican account of domination is defined by ‘arbitrary interference’, modern forms of domination, I argue, are characterized by routinization and (...) systemic forms of control and subordination. In the end, the neo-republican account of domination is more appropriate for 17th- and 18th-century social institutions rather than those that persist under modernity. In its place, I propose a more dynamic concept of domination and rework the concept of freedom in order to place the republican tradition within the context of modernity itself. I argue that the core insight of republicanism is its emphasis on the arrangement and reformation of social institutions to enhance social freedom. From this, I argue that republicanism can take its place as a more attractive alternative to liberal theory. (shrink)

There are a range of ethical issues that confront physicians in times of war, as well as some of the uses of physicians during wars. This book presents a theoretical apparatus which undergirds those debates, namely by casting physicians as being confronted with dual-loyalties during times of war. While this theoretical apparatus has already been developed in other contexts, it has not been specifically brought to bear on the ethical conflicts that attain in wars. Arguably, wars thrust physicians into ethical (...) conflicts insofar as these wars create a tension between a physician's obligation to heal and an obligation to serve some other good (e.g., military chain of command, national security, the greater good, etc.). Alternatively, we can debate whether this conception is appropriate. For example, one could argue that that non-medical duties cannot attach to physicians (e.g., due to nonoverlapping spheres of justice), thus abrogating the dual-loyalty challenge. Or else one could argue that these medically-trained personnel do not act qua physicians at all (but rather partisan advocates) and therefore duties that would otherwise attach to physicians do not attach here. In the first part of this book, these issues are debated. In the second part of the book, the dual-loyalities frame is used to explore various substantive debates that obtain when the military makes use of physicians. Physician involvement in torture is a heated topic, and certainly the most visible element of the debate. Also, however, we could use the dual-loyalties framework to explore issues in other arenas, such as: development of chemical and biological weapons, medical neutrality/battlefield triage, and so on. In each of these cases, the same tensions arguably exist: physicians have duties both to their patients and elsewhere (which, depending on the details of the view, could be any of the above-mentioned ends). This case study explores ethical issues with Canada’s immigration policy and the requirement of mandatory HIV testing of prospective immigrants. Attention is directed to the official immigration medical examination because it is a key site within the immigration system. The following four issues are raised: the differences in official and experiential knowledge claims about what activities occur in the IME when an applicant is diagnosed with HIV; the exceptional treatment of HIV within the Canadian immigration program; the discursive organization of (...) the HIV testing policy; and, the inadequacies with how specific practices are enacted in the processing of immigration applications made by people living with HIV.
