Ido Geiger's paper ‘What it is the Use of the Universal Law Formula of the Categorical Imperative?’ is part of a growing trend in Kant scholarship, which stresses the significance of the rational competence of ordinary human beings. I argue that this approach needs to take into account that the common agent is an active reasoner who has the means to find out what she ought to do. The purpose of my paper is to show how universality already figures in (...) the active reasoning of pre-theoretical agents in the form of a common universalization test. I present textual evidence for this test, and argue that this conception does not present pre-theoretical moral cognition in an overly intellectualistic or mechanistic way. Finally, I discuss how, on the pre-theoretical level, universalization relates to humanity or a rational agent's special status. Universalization is present to common agents in the form of procedures or questions that we ask ourselves, humanity as an awareness of certain particularly blatant violat.. (shrink)

This paper develops an interpretation of the relationship between Kant's various formulations of the categorical imperative in the Groundwork that steers a middle course between the formal and substantive poles of the interpretive spectrum, represented by John Rawls and Barbara Herman, respectively. Accepting and rejecting key aspects of both Rawls's and Herman's interpretations, I argue that the first formulation, understood correctly, does suffice to determine all Kantian moral duties, but only if duties are regarded as situation-specific rather than standing obligations. I also argue, however, that the second and third formulations provide information that is necessary for understanding and applying the first formulation to determine one's duty correctly, and that the formulations are in a sense equivalent even though each plays a distinctive and important role. Kant's conception of moral agency is often charged with attributing no role to feelings. I suggest that respect is the effective force driving moral action. I then argue that four additional types of rational feelings are necessary conditions of moral agency: The affective inner life of moral agents deliberating how to act and reflecting on their deeds is rich and complex . To act morally we must turn our affective moral perception towards the ends of moral action: the welfare of (...) others ; and our own moral being . Feelings shape our particular moral acts . I tentatively suggest that the diversity of moral feelings might be as great as the range of our duties. (shrink)

Martin Sticker's discussion of the common moral agent contains much that I find insightful, true and significant. As a response to his paper, I focus on two important issues that nevertheless separate us: Sticker claims that knowing our duty can be mere passive awareness and that it indeed is passive as awareness of the special status of humanity. I deny that knowing our duty is ever passive. He further claims that the common universalization test is the paradigmatic way active agents (...) acquire moral knowledge. I argue that Sticker appears to construe universalization as a formal test that presupposes no moral knowledge and that so construed the test cannot serve for acquiring moral knowledge. (shrink)

Kant’s Categorical Imperative (CI) is to be taken as a necessary and sufficient condition for any action that is permissible, i. e. not prohibited. The class of permissible actions contains actions which are allowed as well as those which are morally required. If to perform an action and to abstain from this action can be taken to be ‘practical opposites’, then an action that is morally required for, a duty, is an action whose practical opposite is prohibited, and vice versa. The class of actions which are merely allowed (neither prohibited nor morally required for) contains all and only those actions who together with their practical opposites belong to the class of permissible (not prohibited) actions.
