Many poor and oppressed people wish to leave their countries of origin in the third world to come to affluent Western societies. This essay argues that there is little justification for keeping them out. The essay draws on three contemporary approaches to political theory - the Rawlsian,the Nozickean, and the utilitarian - to construct arguments for open borders. The fact that all three theories converge upon the same results on this issue, despite their significant disagreements on others, strengthens the case (...) for open borders and reveals its roots in our deep commitment to respect all human beings as free and equal moral persons. Nationalism is often dismissed today as an irrational political creed with disastrous consequences. Yet most people regard their national identity as a significant aspect of themselves, see themselves as having special obligations to their compatriots, and value their nation's political independence. This book defends these beliefs, and shows that nationality, defined in these terms, serves valuable goals, including social justice, democracy, and the protection of culture. National identities need not be illiberal, and they do not exclude other sources of personal (...) identity, such as ethnicity or religion. An ethics that gives weight to special relationships is more effective in motivating people to pursue justice and other values because it connects peoples’ duties to their identity; but this is consistent with recognizing some universal values, such as human rights. There are strong reasons for making the boundaries of states and nations coincide wherever possible, but in other cases, nations can achieve forms of self‐determination that fall short of full sovereignty. Multicultural arguments in favour of identity politics and special rights for minority groups ignore the benefits that such groups derive from participating in a shared national identity and the kind of democratic politics that such an identity makes possible. Although national identities are often said to be in decline in an increasingly globalized world, they serve such important purposes that our aim should be to rebuild them in a form that makes them more accessible to excluded cultural minorities. This volume provides an up-to-date overview of the emerging debates over the role of language rights and linguistic diversity within political theory. Thirteen chapters, written by many of the leading theorists in the field, identify the challenges and opportunities that linguistic diversity raises for contemporary societies.

This paper subjects to critical analysis four common arguments in the sociopolitical theory literature supporting the cultural nationalist thesis that liberal democracy is viable only against the background of a single national public culture: the arguments that (1) social integration in a liberal democracy requires shared norms and beliefs (Schnapper); (2) the levels of trust that democratic politics requires can be attained only among conationals (Miller); (3) democratic deliberation requires communicational transparency, possible in turn only within a shared national public (...) culture (Miller, Barry); and (4) the economic viability of specifically industrialized liberal democracies requires a single national culture (Gellner). I argue that all four arguments fail: At best, a shared cultural nation may reduce some of the costs liberal democratic societies must incur; at worst, cultural nationalist policies ironically undermine social integration. The failure of these cultural nationalist arguments clears the way for a normative theory of liberal democracy in multinational and postnational contexts. (shrink)

This paper considers normative questions about the integration of legally resident immigrants into contemporary liberal democratic states. First, I ask to what extent immigrants should enjoy the same rights as citizens and on what terms they should have access to citizenship itself. I defend two general principles: (1) differential treatment requires justi.cation; (2) the longer immigrants have lived in the receiving society, the stronger their claim to equal rights and eventually to full citizenship. Second, I explore additional forms of economic, (...) cultural, social, and political integration. I argue that the integration of immigrants depends upon a process of mutual, but asymmetrical adaptation and that it is precisely because the immigrants have to adapt more that the receiving society bears a greater responsibility to take steps to promote equality between the immigrants and the existing population. In this essay, I develop a critique of the linguistic territoriality principle, which states that, for reasons related to the value of language identity, language groups should be territorially accommodated. While I acknowledge the desirability of implementing a linguistic territoriality principle in some specific cases, I claim that this principle is in general inappropriate for the 'post-Westphalian' linguistic world in which we live. I identify, analyze and reject two distinct justifications for the linguistic territoriality principle: the Linguistic Context justification and (...) the Language Survival justification. Finally, I argue for different means of giving political recognition to the fact that most people value their language as an importance source of identity. This alternative theory sets out to officially recognize multiple languages in a given territory. (shrink)

Michael Walzer has argued that `distributive justice presupposes a bounded world', but what counts as a relevant boundary? The article criticizes two arguments holding that boundaries should not count at all: a negative argument that there is no relevant difference between human relationships within and across state borders and a positive argument that principles of justice must, as a matter of logic, be universal in scope. It then examines three rival accounts of the bounded scope of distributive justice : the (...) cooperative practice view, the political coercion view, and the common identity view. Although each has plausible arguments to support it, none turns out to give necessary and sufficient conditions for principles of distributive justice to apply. Importantly, however, the idea of social justice has emerged within political units that to a large extent combine the three features in question. To the extent that this overlap breaks down, we will need to develop new theories of transnational justice. (shrink)
