Many anticosmopolitan Rawlsians argue that since the primary subject of justice is society's basic structure, and since there is no global basic structure, the scope of justice is domestic. This paper challenges the anticosmopolitan basic structure argument by distinguishing three interpretations of what Rawls meant by the basic structure and its relation to justice, corresponding to the cooperation, pervasive impact, and coercion theories of distributive justice. On the cooperation theory, it is true that there is no global basic structure, but (...) the basic structure turns out to be only an instrumental condition for realizing justice, and not an existence condition that must be met before demands of justice arise. On the pervasive impact and coercion theories, the basic structure is indeed an existence condition, but there exists a global basic structure. The upshot is that on any plausible interpretation of Rawls's account of the basic structure, Rawlsian justice is global in scope. (shrink)

The world is full of situations of asymmetric bilingualism: the members of one linguistic group learn the language of another without the latter reciprocating. In such a situation, the cost of learning is borne by one group, whereas the benefit is enjoyed by both. This paper first argues that, in the absence of any cost-sharing device, such situations are unjust. Next, it critically examines four potential criteria of linguistic justice, each of which offers a distinct answer to the question of (...) how to allocate between two linguistic groups the cost of one of them learning a second language. Criteria suggested by Church and King, Jonathan Pool and David Gauthier are spelled out and rejected in favour of a criterion of equal ratios of benefit to cost. Lastly, the paper sketches some policy implications concerning what is owed by English natives to the rest of mankind as a result of English being adopted as a worldwide lingua franca. Language use is a public good. Those using a common language receive benefits that are non-excludable and non-rival. And as more people speak the same language, the greater these benefits are. Sometimes individuals make a conscious decision to learn a language other than their native language in order to receive these benefits, and thereby incur costs. This paper is an attempt to determine how we should share the costs among all beneficiaries. I argue against Van Parijs’s proposal for this, and (...) instead argue that an approach found in the work of Gauthier is preferable. A general lesson to be drawn from this paper is that the correct principle for distributing the costs of public goods will depend on whether we think the good in question is required by justice or not. Where Van Parijs went wrong, I claim, was in thinking that a cross-border common language is required by justice. (shrink)

I offer a new account of fair-play obligations for non-excludable benefits received from the state. Firstly, I argue that non-acceptance of these benefits frees recipients of fairness obligations only when a counterfactual condition is met; i.e. when non-acceptance would hold up in the closest possible world in which recipients do not hold motivationally-biased beliefs triggered by a desire to free-ride. Secondly, I argue that because of common mechanisms of self-deception there will be recipients who reject these benefits without meeting the (...) counterfactual condition. For this reason, I suggest that those who reject non-excludable benefits provided by the state have a duty to support their rejection with adequate reasons. Failing that, they can be permissibly treated as if they had fair-play obligations (although in fact they might not have them). Thus, I claim that there is a distinction, largely unappreciated, between the question of whether we have a duty of fairness to obey the law and the question of whether we can be permissibly treated as if we had one.
