Most people assume that, even though some degenerative or criminal behavior may be caused by influences beyond our control, ordinary human actions are not similarly generated, but rather are freely chosen, and we can be praiseworthy or blameworthy for them. A less popular and more radical claim is that factors beyond our control produce all of the actions we perform. It is this hard determinist stance that Derk Pereboom articulates in Living Without Free Will. Pereboom argues that our best scientific (...) theories have the consequence that factors beyond our control produce all of the actions we perform, and that because of this, we are not morally responsible for any of them. He seeks to defend the view that morality, meaning and value remain intact even if we are not morally responsible, and furthermore, that adopting this perspective would provide significant benefit for our lives. How can we motivate ourselves to do what we think we ought? How can we deliberate about personal values and priorities? Bennett Helm argues that standard philosophical answers to these questions presuppose a sharp distinction between cognition and conation that undermines an adequate understanding of values and their connection to motivation and deliberation. Rejecting this distinction, Helm argues that emotions are fundamental to any account of value and motivation, and he develops a detailed alternative theory both of emotions, desires and (...) evaluative judgements and of their rational interconnections. The result is an innovative theory of practical rationality and of how we can control not only what we do but also what we value and who we are as persons. (shrink)

At first glance, love seems to be a psychological state for which there are normative reasons: a state that, if all goes well, is an appropriate or fitting response to something independent of itself. Love for one’s parent, child, or friend is fitting, one wants to say, if anything is. On reflection, however, it is elusive what reasons for love might be. It is natural to assume that they would be nonrelational features of the person one loves, something about her (...) in her own right. According to the “quality theory,” for example, reasons for love are the beloved’s personal attributes, such as her wit and beauty. In J. David Velleman’s provocative and ingeniously argued proposal, the reason for love is the beloved’s bare Kantian personhood, her capacity for rational choice and valuation.1 But no such nonrelational feature works. To appreciate just one difficulty, observe that whatever nonrelational feature one selects as the reason for love will be one that another person could, or actually does, possess. The claim that nonrelational features are reasons for love implies, absurdly, that insofar as one’s love for Jane is responsive to its reasons, it will accept any relevantly similar person as a replacement. A philosophical analysis is developed of the following questions: when, if ever, should hatred be overcome by sympathy or compassion? What are forgiveness and mercy and to what degree do they require - both conceptually and morally - the overcoming of certain passions and the motivation by other passions? If forgiveness and mercy (...) indeed are moral virtues, what role, if any, should they play in the law? (shrink)

It is often called “the problem of free will and determinism,” as if the only thing that might challenge free will is determinism and as if determinism is obviously a problem. The traditional debates about free will have proceeded accordingly. Typically, incompatibilists about free will and determinism suggest that their position is intuitive or commonsensical, such that compatibilists have the burden of showing how, despite appearances, the problem of determinism is not really a problem. Compatibilists, in turn, tend to proceed (...) as if showing that determinism is not a problem thereby shows that we have free will, as if determinism is the only thing that might threaten free will. In this chapter, I reject both of these elements of the traditional debate; the question of whether we have free will should neither begin nor end with the so-called problem of determinism. I present and discuss evidence from a variety of studies that suggests that incompatibilism is not particularly intuitive. Most people do not have to be talked out of incompatibilism but rather talked into it. This provides some reasons—though certainly not decisive reasons—to think that compatibilism is true. I conclude by pointing out that, even if compatibilism were true, it would not dissolve the problem of free will, because there are problems other than determinism that need to be confronted—namely, challenges to free will suggested by current and “future science,” including neuroscience and psychology. The threats to free will suggested by these sciences are distinct from the traditional threat of determinism, and they are the ones that “ordinary persons” find intuitively threatening to free will. In fact, I will argue that the reason incompatibilism about free will and determinism appears to be intuitive is that determinism is often and easily misunderstood to involve these distinct threats to free will—threats that suggest that our rational, conscious mental activity is bypassed in the process of our making decisions and coming to act. It’s an undeniable fact about our moral lives that we are partial towards certain people and projects. Despite this, it has traditionally been very hard to justify partiality. In this paper I defend a novel partialist theory. The context of the paper is the debate between three different views of how partiality is justified. According to the first view, partiality is justified by facts about our ground projects. According to the second view, partiality is justified by facts about our relationships (...) with the things that we are partial towards. And according to the third view, partiality is justified by facts about the things that we are partial towards. I argue that all three views contain part of the truth. We can see this by adopting a more sophisticated view of the weight of reasons. Once we do this, it will be clear that both facts about individuals and facts about relationships play a role in explaining why we often have stronger reason to act well towards those things we are partial towards. Further, I argue, facts about projects help explain why facts about relationships play the role that they do in determining the strength of our reasons. (shrink)

In his work on internality, identification, and caring, Harry Frankfurt attempts to delineate the organization of agency peculiar to human beings, while avoiding the traditional overintellectualized emphasis on the human capacity to reason about action. The focal point of Frankfurt’s alternative picture is our capacity to make our own motivation the object of reflection. Building upon the observation that marginal agents (such as young children and Alzheimer’s patients) are capable of caring, I show that neither caring nor internality need to (...) depend on the phenomena of reflectiveness. I develop alternative interlocking accounts of caring and internality that are independent of both reflectiveness and evaluation, but that can still do justice to the central role of carings in the organization of agency characteristic of human persons. In his seminal essay “Freedom and Resentment,” Strawson drew attention to the role of such emotions as resentment, moral indignation, and guilt in our moral and personal lives. According to Strawson, these reactive attitudes are at once constitutive of moral blame and inseparable from ordinary interpersonal relationships. On this basis, he concluded that relinquishing moral blame isn’t a real possibility for us, given our commitment to personal relationships. If well founded, this conclusion puts the traditional free-will debate in a new (...) light. In particular, in so far as incompatibilists believe that we can or should forgo moral blame if determinism is true, their stance may seem out of touch with our emotional reality. Here I examine Strawson’s claim that the reactive attitudes are inseparable from ordinary interpersonal relationships. Strawson says surprisingly little to support this intriguing claim, and thus far no argument for it has emerged in the literature. My aim is to remedy this. Specifically, I set out an argument for a suitably formulated version of the inseparability claim, an argument that appeals to the relationship between the reactive attitudes and other elements of our emotional lives. I then show how this argument helps to answer an important recent challenge to Strawson’s position. If I am right, there is good reason to doubt that the reforms envisaged by some incompatibilists, reforms to our blame-related practices, are a real possibility for us. (shrink)

What is it to "value" something, in the semi-technical sense of the term that Gary Watson establishes? I argue that valuing something consists in caring about it. Caring involves not only emotional dispositions of the sort that Agnieszka Jaworska has elaborated, but also a distinctive cognitive disposition – namely, a (defeasible) disposition to believe the object cared about to be a source of agent-relative reasons for action and for emotion. Understood in this way, an agent's carings have a stronger claim (...) to "speak for" her as her values than do other attitudes that have been proposed for this role. In particular, an agent's carings establish more robust psychological continuities and cross-temporal connections than do self-governing policies of the sort that Michael Bratman has described; and they forge diachronic coherence not just in her deliberation and action, as self-governing policies do, but also in her cognitive and emotional life. An agent's carings thus help to constitute her identity as a temporally persisting subject . Self-governing policies are at best ersatz -values, which an agent may choose to adopt when she finds that her proper values – her cares – leave her course underdetermined. (shrink)

It has become common to take reasons to form a basic normative category that is not amenable to non-circular analysis. This paper offers a novel characterization of reasons in terms of how we ought or it would be good for us to think in response to our awareness of facts, and thus rejects such Reason Primitivism. Briefly, for r to be a normative reason for A to φ is for it to be the case that A ought to conduct her (...) φ-relevant thinking in a φ-friendly manner, given her awareness of r. In mechanistic terms, this is to say that the psychological mechanisms responsible for A’s potentially φ-ing ought to be causally influenced in the direction of φ-ing by her awareness of r. For r to be an evaluative reason for A to φ is for it to be the case that it is desirable for A to conduct her φ-relevant thinking in a more or less φ-friendly manner, given her awareness of r. What someone ought to do or what it is desirable for someone to do is in turn to be understood in terms of fittingness of different positive or negative reactions. Linking the favoring relation between a fact and an action or belief explicitly with fittingness of attitudes towards the subject reveals the sense in which reasons are normative or evaluative. The paper also responds to six potential challenges to the view and argues it has certain advantages over competing reductionist proposals. (shrink)

According to legal expressivism, neither crime nor punishment consists merely in intentionally imposing some kind of harm on another. Crime and punishment also have an expressive aspect. They are what they are in part because they enact attitudes toward others—in the case of crime, some kind of disrespect, at least, and in the case of punishment, society’s condemnation or reprobation. Punishment is justified, at least in part, because (and when) it uniquely expresses fitting condemnation or other retributive attitude. What makes (...) retributive attitudes fitting is that they protect the victim’s status as inviolable. Hate or bias crimes dramatize the expressive aspect of crime, as they are often designed to send a message to the victim’s group and society at large. Treating the enactment of contempt and denigration toward a historically underprivileged group as an aggravating factor in sentencing may be an appropriate way to counter this message, as it reaffirms and indeed realizes the fundamental equality and inviolability of all members of a democratic community.
