New social movements of the post-war era have brought to prominence the idea that identity can be a crucial focus for political struggle. Linked to an increasing recognition that social theory itself must put the politics of identity on center stage, this volume impels social theorists not only to make sense of the "world out there", but also to make sense of differences within the discourse of theory.

Groups around the world are increasingly successful in maintaining or winning autonomy. However, what happens to individuals within the groups who find that their group discriminates against them? This volume brings together sixteen distinguished scholars who examine the balance between group autonomy and individual rights in relation to conflicts involving gender, religion, culture, and indigenous rights in the national and international sphere.

The West has created categories of property, including intellectual property, which divides peoples and things according to the same colonizing discourses of possessive individualism that historically disentitled and disenfranchised Native peoples in North America. These categories are often presented as one or both of neutral and natural, and often racialized. The commodification and removal of land from people’s social relations which inform Western valuations of cultural value and human beings living in communities represents only one particular, partial way of categorizing (...) the world. Legal and cultural manifestations of authorship, culture, and property are contingent upon Enlightenment and Romantic notions built upon a colonial foundation. I will argue that the law rips apart what First Nations peoples view as integrally and relationally joined, but traditional Western understandings of culture, identity, and property are provoked, challenged, and undermined by the concept of Aboriginal Title in a fashion that is both necessary and long overdue. Although the universal human rights paradigm has been problematic for women and indigenous peoples, both groups have made advances by framing their demands within a human rights perspective. Indigenous women, however, have frequently found themselves marginalized by women’s movements and indigenous movements alike, particularly when they make demands for rights as indigenous women—not just as members of one group or the other. This article takes the case of Mapuche women in Chile to examine the politics of gender and human rights (...) for indigenous women. Their efforts to articulate their concerns, vis-à-vis Mapuche men, nonindigenous women, and the state, have entailed assertions of their own version of women’s rights, one that responds specifically to their reality as Mapuche women. Within Western political philosophy, the rights of groups has often been neglected or addressed in only the narrowest fashion. Focusing solely on whether rights are exercised by individuals or groups misses what lies at the heart of ethnocultural conflict, leaving the crucial question unanswered: can the familiar system of common citizenship rights within liberal democracies sufficiently accommodate the legitimate interests of ethnic citizens? Specifically, how does membership in an ethnic group differ from other groups, such as professional, lifestyle, or advocacy (...) groups? How important is ethnicity to personal identity and self-respect, and does accommodating these interests require more than standard citizenship rights? Crucially, what forms of ethnocultural accommodations are consistent with democratic equality, individual freedom, and political stability?
