Though the revised edition of A Theory of Justice, published in 1999, is the definitive statement of Rawls's view, so much of the extensive literature on Rawls's theory refers to the first edition.

One of the most noteworthy features of David Gauthier's rational choice, contractarian theory of morality is its appeal to self-interested rationality. This appeal, however, will undoubtedly be the source of much controversy and criticism. For while self-interestedness is characteristic of much human behavior, it is not characteristic of all such behavior, much less of that which is most admirable. Yet contractarian ethics appears to assume that humans are entirely self-interested. It is not usually thought a virtue of a theory that (...) its assumptions are literally false. This book, which was completed just before Jean Hampton’s untimely death in April 1996, is an admirable hybrid. Although it successfully achieves its stated purpose of “acquaint[ing] the student of political philosophy both with [its] questions and with the various answers to them proposed by philosophers since the ancient Greeks”, it is, at the same time, quite an original work—one that can be read with real profit by professional philosophers as well as students.

Law is the expression of public reason. I want to explicate and justify this assertion, which lies at the core of a normative theory of law. Primarily, I want to focus on the concept of public reason, showing what it is, relating it to private or individual reason, and finding its rationale in that relation. I shall then argue that public reason exhausts the normative space where law may be found. Appealing to public reason, I shall show that the authority (...) that law claims over the judgments and actions of citizens must ultimately be grounded in their own rationality. (shrink)
