On Human Conduct is composed of three connected essays. Each has its own concern: the first with theoretical understanding, and with human conduct in general; the second with an ideal mode of human relationship which the author has called civil association; and the third with that ambiguous, historic association commonly called a modern European state. Running through the work is Professor Oakshott's belief in philosophical reflection as an adventure: the adventure of one who seeks to understand in other terms what (...) he already understands, and where the understanding is sought is a disclosure of the conditions of the understanding enjoyed and not a substitute for it. Übereinstimmend mit Körner versteht der Autor unter 'praktischer Philosophie' die Gesamtheit der handlungsbezogenen Disziplinen. 'Handlung' ist informationsgelenktes Verhalten eines Subjektes. Der Handlungsbegriff wird durch den handlungsbestimmenden Informationsverarbeitungsprozeß charakterisiert. Handlungstheoretische Analysen erfordern eine erkenntnismäßig differenzierte Semantik. Der Begriff der Handlung setzt die Existenz von Handlungsspielräumen voraus. Der Autor kritisiert die Unterscheidung von kognitivem und präskriptivem Sollen und zeigt, daß Normsätze einer gegebenen Bedeutung in verschiedenen pragmatischen Funktionen verwendet werden können. Es werden die Begriffe 'Normenlogik' und 'deontische Logik' einander gegenübergestellt. Die Standardsysteme (...) der deontischen Logik sind keine geeignete Basis für die normativen Disziplinen. Der Autor fordert die Ausarbeitung einer genuinen Normenlogik, in der Sollsätzen eine primäre und Darfsätzen nur eine sekundäre Rolle zukommt. (shrink)

. The author conceives rules as action‐determining ideas. They are general and of hypothetical form, and they are of three semantic types: descriptive, technological, and normative rules. The most important categorisation of normative rules is the distinction between rules of behaviour and power‐conferring rules. Both kinds of rules are necessary to establish institutions. Principles are a special kind of normative rules. The social existence of normative rules is connected with their institutionalisation as frames for action. A restatement of an institutionalist theory of law is attempted with particular reference to legal reasoning and legal rights. Use is made of Ota Weinberger's concept of “practical information”, focusing on both its momentary and diachronic aspects. Momentary practical information corresponds to the need to know which conduct is required of us at a given moment. The diachronic practical information becomes relevant whenever we wish to stabilize the practical information and to reduce the likelihood of change regarding our ways of (...) acting. Furthermore, the momentary information is given sense only against the background of the diachronic one. Among the different types of diachronic practical information particular importance is ascribed to legal “institutions” such as contracts and rights. Legal “institutions” are conceived as founded on various sets of rules. Rules may then increase the number of facts in the world: those special kinds of facts which are represented by social phenomena. (shrink)
