According to van Eemeren, argumentation theory is a hybrid discipline, because it requires a multidisciplinary, if not interdisciplinary approach, combining descriptive and normative insights. During the past thirty years the pragma-dialectical theorizing has developed in various steps from designing an abstract ideal model for critical discussion to examining strategic manoeuvring in the various argumentative activity types in which argumentative discourse manifests itself in argumentative reality. The response to the theoretical proposals that have been made includes, next to approval, also various kinds of criticisms. This paper explores the nature and thrust of these criticisms. In doing so, a distinction is made between criticisms concerning the (...) dialectical and the pragmatic dimensions of pragma-dialectics, the scope of the theory, the rhetorical dimension and moral quality, the treatment of the fallacies, and the epistemic dimension. Over the past decade, the ideal model of shared decision-making has been increasingly promoted as the preferred standard of doctor-patient communication in medical consultation. The model advocates a treatment decision-making process in which the doctor and his patient are considered coequal partners that carefully negotiate the treatment options available in order to ultimately reach a treatment decision that is mutually shared. Thereby, the model notably leaves room for—and stimulates—argumentative discussions to arise in the context of medical consultation. A paradigm example (...) of a discussion that often emerges between doctors and their patients concerns antibiotics as a method of treatment for what is presumed to be a viral infection. Whereas the doctor will generally not encourage treatment with antibiotics, patients oftentimes prefer the medicine to other methods of treatment. In this paper, two cases of such antibiotic-related discussions in consultation are studied using insights gained in the extended pragma-dialectical theory to argumentation. It is examined how patient and physician maneuver strategically in order to maintain a balance between dialectical reasonableness and rhetorical effectiveness, as well as an equilibrium between patient participation and evidence-based medication, while arguing a case for and against antibiotics respectively. In this contribution, I will develop a comprehensive tool for the reconstruction and evaluation of argumentation from expert opinion. This is done by analyzing and then combining two dialectical accounts of this type of argumentation. Walton’s account of the ‘appeal to expert opinion’ provides a number of useful, but fairly unsystematic suggestions for critical questions pertaining to argumentation from expert opinion. The pragma-dialectical account of ‘argumentation from authority’ offers a clear and systematic, but fairly general framework for the reconstruction and (...) evaluation of this type of argumentation. This volume gives a theoretical account of the problem of analyzing and evaluating argumentative discourse. After placing argumentation in a communicative perspective, and then discussing the fallacies that occur when certain rules of communication are violated, the authors offer an alternative to both the linguistically-inspired descriptive and logically-inspired normative approaches to argumentation. The authors characterize argumentation as a complex speech act in a critical discussion aimed at resolving a difference of opinion. The various stages of a critical discussion are outlined, (...) and the communicative and interactional aspects of the speech acts performed in resolving a simple or complex dispute are discussed. After dealing with crucial aspects of analysis and linking the evaluation of argumentative discourse to the analysis, the authors identify the fallacies that can occur at various stages of discussion. Their general aim is to elucidate their own pragma- dialectical perspective on the analysis and evaluation of argumentative discourse, bringing together pragmatic insight concerning speech acts and dialectical insight concerning critical discussion. The introduction of the concept of strategic maneuvering into the pragma-dialectical theory makes it possible to formulate testable hypotheses regarding the persuasiveness of argumentative moves that are made in argumentative discourse. After summarizing the standard pragma-dialectical approach to argumentation, van Eemeren, Garssen, and Meuffels explain what the extension of the pragma-dialectical approach with strategic maneuvering involves and discuss the fallacies in terms of the extended pragma-dialectical approach as derailments of strategic maneuvering. Then they give an empirical interpretation of the extended (...) pragma-dialectical model in which they report the testing of three hypotheses which formulate preliminary conditions for effectiveness research within the framework of the extended pragma-dialectical theory and the results of the tests they consecutively carried out. Starting from a concept of reasonableness as well-consideredness, it is discussed in what way science could serve as a model for reasonable argumentation. It turns out that in order to be reasonable two requirements have to be fulfilled. The argumentation should comply with rules which are both problem-valid and intersubjectively valid. Geometrical and anthropological perspectives don't meet these criteria, but a critical perspective does. It is explained that a pragma-dialectical approach to argumentation which agrees with this critical perspective is indeed (...) problem-valid and that strong pragmatic and utilitarian arguments can be given for its intersubjective validity. Thus, conventional validity is promoted for a code of conduct for discussants who want to resolve their disputes reasonably by way of a critical discussion. (shrink)

The main finding of a comprehensive empirical research project on the intersubjective acceptability of the pragma-dialectical discussion rules (Van Eemeren, Garssen & Meuffels, 2009) is that ordinary language users judge discussion moves that are considered fallacious from an argumentation-theoretical perspective as unreasonable. In light of this finding it is remarkable that in everyday argumentative discourse fallacies occur regularly and seem many times not to be noticed by the participants in the discourse. This also goes for the abusive argumentum ad hominem. (...) While abusive ad hominem attacks are judged to be very unreasonable discussion moves when the unreasonableness of clear cases of this fallacy is rated in experiments, in real life this fallacy remains undetected more often than not. In this paper it is argued that this paradox can be explained by analysing abusive ad hominem attacks as a mode of strategic manoeuvring which takes on a reasonable appearance in real life situations when it mimics, as it often does, legitimate critical reactions to authority argumentation. The hypothesis that abusive fallacies are seen as less unreasonable when they are presented as if they are critical questions pertaining to the argument scheme for authority argumentation than when they are clear cases was tested systematically in two experiments. This paper focuses on argumentation in a specific institutional context: debate in the European Parliament. A parliamentary debate is a distinct argumentative activity type. In the pragma-dialectical approach, argumentative activity types are defined as conventionalized argumentative practices in which the possibilities for strategic manoeuvring are predetermined. What are the characteristics of the activity type of a debate in European Parliament that predetermine the possibilities for strategic manoeuvring? What kind of constraints and opportunities for strategic manoeuvring can be distinguished?
