Many people think that promiscuity is morally acceptable, but rape and pedophilia are heinous. I argue, however, that the view of sexual ethics that underlies an acceptance of promiscuity is inconsistent with regarding (1) rape as worse than other forms of coercion or assault, or (2) (many) sex acts with willing children as wrong at all. And the view of sexual ethics that would fully explain the wrong of rape and pedophilia would also rule out promiscuity. I intend this argument (...) neither as a case against promiscuity nor as either a mitigation of rape or a partial defense of pedophilia. My purpose is to highlight an inconsistency in many people's judgements. Whether one avoids the inconsistency by extending or limiting the range of practices one condemns, will depend on which underlying view of the ethics of sex one accepts. (shrink)

The liberal view that valid consent is sufficient for a sex act to be morally legitimate is challenged by three major philosophies of sex: the Catholic view of sex as ordained for procreation and properly confined to marriage, the romantic view of sex as bound up with love, and the radical feminist analysis of sex in our society as part and parcel of the domination of women by men. I argue that none of these lines of argument is convincing, and that consent remains the touchstone of morally permissible sex – although, dmittedly, it may not be very helpful in discussing ideals of human sexuality. An influential view of sexual morality claims that participant consent is sufficient for the moral permissibility of a sexual act. I argue that the complex and frequently dark nature of sexual desire precludes this, because some sexual desire has a character such that it should not be gratified, even if this were consented to. I illustrate this with a discussion of a famous literary character, the Vicomte de Valmont, and draw on Kant's anthropology to illuminate the nature of such desire, (...) before offering an account of its psychological roots. First, I will provide an overview of the debate about whether or not acts of supererogation exist. Next, I will investigate the issue of how to define the supererogatory. Recent philosophical writing on sexual desire divides broadly into two camps. Reductionists take sexual desire to aim at an essentially physical bodily pleasure, whereas intentionalist accounts take a focus upon the reciprocal interaction of the mental states of the partners to be crucial for understanding the phenomenon. I argue that the apparent plausibility of reductionism rests upon the flawed assumption that sexual pleasure has the same uniform bodily character in all sexual encounters, which rests in turn upon flawed assumptions in (...) the philosophy of mind. Drawing on an Aristotelian understanding of persons as essentially embodied minds, I outline an alternative account of sexual desire, showing how the nature of the sexual pleasure we take in the body of another can be transformed by the significance the person or situation has for us. I proceed to show that my account of sexual desire is able to accommodate the entire range of sexual phenomena, including those that seem to undermine standard intentionalist accounts as well as those that reductionists have difficulty in fully explaining. Finally I make some brief remarks about the implications of my account of sexual desire for sexual morality, suggesting some reasons why it casts doubt on the view that universal participant consent is sufficient for a sexual act to be morally unproblematic. The topic of self-interest raises large and intractable philosophical questions–most obviously, the question “In what does self-interest consist?” The concept, as opposed to the content of self-interest, however, seems clear enough. Self-interest is interest in one's own good. To act self-interestedly is to act on the motive of advancing one's own good. Whether what one does actually is in one's self-interest depends on whether it actually does advance, or at least, minimize the decline of, one's own good. Though it may (...) be difficult to tell whether a person is motivated by self-interest in a particular instance, and difficult also to determine whether a given act or decision really is in one's self-interest, the meaning of the claims in question seems unproblematic. My main concern in this essay is to make a point about the content of self-interest. Specifically I shall put forward the view that meaningfulness, in a sense I shall elaborate, is an important element of a good life. It follows, then, that it is part of an enlightened self-interest that one wants to secure meaning in one's life, or, at any rate, to allow and promote meaningful activity within it. Accepting this substantial conception of self-interest, however, carries with it a curious consequence: the concept of self-interest which formerly seemed so clear begins to grow fuzzy. Fortunately, it comes to seem less important as well. In Reasons and Persons, Derek Parfit distinguishes three sorts of theories about self-interest–hedonistic theories, preference theories, and what he calls “objective-list theories." This article has two broad purposes. First, as a political philosopher who has been interested in the concepts of coercion and exploitation, I want to consider just what the analysis of the concept of consent can bring to the question, what sexually motivated behavior should be prohibited through the criminal law? Put simply, I shall argue that conceptual analysis will be of little help. Second, and with somewhat fewer professional credentials, I shall offer some thoughts about the substantive question itself. Among other things, I will argue that it is a mistake to think that sexual crimes are about violence rather than sex and that we need to understand just why the violation of sexual autonomy is a serious wrong. I shall also argue that the principle that “no means no” does not tell us when “yes means yes,” and that it is the latter question that poses the most interesting theoretical difficulties about coercion, misrepresentation, and competence. In addition, I shall make some brief remarks concerning two questions about consent and sexual relations that lie beyond the criminal law: What “consent compromising behaviors” should be regarded as indecent, although not criminal?
