A new formulation of the Fine-Tuning Argument (FTA) for the existence of God is offered, which avoids a number of commonly raised objections. I argue that we can and should focus on the fundamental constants and initial conditions of the universe, and show how physics itself provides the probabilities that are needed by the argument. I explain how this formulation avoids a number of common objections, specifically the possibility of deeper physical laws, the multiverse, normalisability, whether God would fine-tune at (...) all, whether the universe is too fine-tuned, and whether the likelihood of God creating a life-permitting universe is inscrutable. After briefly outlining the fine-tuning argument (FTA), I explain how it relies crucially on the claim that it is not improbable that God would design a fine-tuned universe. Against this premise stands the divine psychology objection: the contention that the probability that God would design a fine-tuned universe is inscrutable. I explore three strategies for meeting this objection: (i) denying that the FTA requires any claims about divine psychology in the first place, (ii) defining the motivation and intention to design (...) a fine-tuned universe into the theistic hypothesis, and (iii) providing arguments that the relevant probability is not terribly low. While I reject the first two, I conclude, in line with the third, that considerations about life's objective value establish that it is not absurdly improbable that God would design a fine-tuned universe, whether one regards the FTA as an inference merely to a cosmic designer, or to theism proper. According to the Fine-Tuning Argument, the existence of life in our universe confirms the Multiverse Hypothesis. A standard objection to FTA is that it violates the Requirement of Total Evidence. I argue that RTE should be rejected in favor of the Predesignation Requirement, according to which, in assessing the outcome of a probabilistic process, we should only use evidence characterizable in a manner available before observing the outcome. This produces the right verdicts in some simple cases in which RTE leads (...) us astray, and, when applied to FTA, it shows that our evidence does confirm HM. (shrink)

This paper defends a novel sceptical response to the fine-tuning argument for the existence of God (FTA). According to this response, even if FTA can establish, what I call, the confirmation proposition: ‘fine-tuning confirms the God hypothesis’, there is no reason to think that a strengthening of FTA can establish the evidence-favouring proposition: ‘fine-tuning favours the God hypothesis over its competitors’. My argument is that, any criteria for the explanation of fine-tuning that permit us to take the God hypothesis seriously (...) ought to make us sceptical that fine-tuning favours the God hypothesis over its competitors. As taking the God hypothesis seriously requires us to give a fair hearing to all sorts of non-theistic explanations, including the so-called weird sorts of atheism. (shrink)

The Fine-Tuning Argument (FTA) is an argument put forward by proponents of theism, in which they attempt to make a case from Bayesian inference, that the [apparently] fine tuned constants of our universe is more likely given a theistic hypothesis, than a naturalistic one. Some naturalists argue that this is not the case given the Multiverse (MV) hypothesis (that our universe is one of a plurality in a broader multiverse). The MV hypothesis is rejected by theists who argue it commits (...) what Ian Hacking (1987) referred to as “the Inverse Gambler’s Fallacy”. In this paper I will attempt to demonstrate [what I perceive as] the errors in logic made by theists first in positing that a life-permitting universe (LPU) is improbable under the naturalistic-single-universe (NSU) hypothesis, and subsequently the errors in arguing that the MV hypothesis commits what Ian Hacking (1987) referred to as “the Inverse Gambler’s Fallacy”. First, I will attempt to demonstrate why an LPU is not improbable under the NSU. Second, I will attempt to demonstrate that if we ascribe a probability value to our LPU, we can directly infer either an MV or the existence of “Deeper Laws” (Barnes, 2020) from that probability value. A version of the Fine-tuning Argument (FTA) considered in a previous essay is replaced by an improved version, which is then refuted.Advocates of FTA must proclaim that there is no world ensemble, that a great many alternatives to the physical constants of our universe are physically possible and roughly equal in probability to them, and that alternate hypothetical worlds are all, or almost all, uninteresting in comparison to our universe. Risk assessment is one of the prerequisites for understanding its causes and possible consequences. We base our risk assessment on the principles described in the European standard EN 31000 - Risk Management Process. This standard comprehensively describes the continuous activities that are necessary in managing risks and minimizing their possible adverse effects on the operation of the system under investigation. In this activity, it is necessary to first identify the existing risks, then analyze and evaluate the identified risks. In the (...) analysis of existing risks, it is possible to use both qualitative and quantitative analytical methods, or combine them. We use qualitative methods in cases where we do not have a sufficient amount of input information, these are more subjective. Quantitative methods are more accurate, but also more demanding on input information and time. The choice of a suitable analytical method is a basic prerequisite for knowledge of risks and their evaluation. The values of individual risks obtained in this way are the basis for determining the measures that are ecessary to minimize them, i.e., to adjust them to an acceptable level. The draft measures are always based on the value of the individual components used to calculate the risk number, as well as on the value of the asset , which needs to be protected. Appropriately chosen analytical methods are one of the basic prerequisites for the consistent application of the principles of risk management, as a continuous process aimed at increasing the overall security of the system under study. In the article, the author describes the procedures used in risk assessment, as well as specific analytical methods that can be used in working with risks. The aim of identifying risk factors is to create a list of events that could cause undesirable disruption to ongoing processes. At this stage, we define all the risks that will be subsequently analyzed and evaluated. When identifying, we can use methods such as, e.g. SWOT, PHA (Preliminary Hazard Analysis) or CA (Checklist Analysis). Methods suitable for determining the causes and creating scenarios for the course of a risk event are ETA (Event Tree Analysis) or FTA (Fault Tree Analysis). The basic analysis of the system can be performed using the FMEA method (Failure Mode and Effect Analysis), which provides a numerical risk assessment. By comparison with the numerical value of the risk that we are willing to accept, we obtain 2 groups of risks. Acceptable, which will be given regular attention and unacceptable, which we will focus on in risk management and we will try to minimize its negative affect on the functioning of the system under study. In order for the liberalization and increase of international trade, the free trade agreement is generally deemed a most useful instrumentality within the region. Under the WTO regime, we can see that a plethora of FTA arrangements are negotiated, come into the treaty laws, as well as operate to regulate the binational or tri-national trade disputes on the regional basis. As most typical and frequented in FTAs, they usually include an arbitration and binational panel procedure as a dispute settlement mechanics. (...) In many aspects, the procedures prescribed in most of FTAs could be apposite that most effectively and cheaply handle the disputes arising from the specific binational or trinational treaties. On the other hand, they could offer a chance to avoid the constitutional musters merely because diplomacy, international negotiation, ratification of treaties and approval of them traditionally fall within the powers of Congress or Executive under the separation of powers principle. This paper examined the legal issues as focused upon the NAFTA ch. 19, ch. 11 and US constitution. The chapters instituted the binational panel procedure dealing with the anti-dumping or counter measures as of subsidies, as well as legal dispute from the binational investment arrangements. From the consitutional viewpoint, we can be aware that the chapters could expressly contravene the Article III of original jurisdiction, Eleventh amendment of state sovereignty, and limitations of the treaty making powers inherent in the separation of powers principle. Given the overriding feature of such treaty clauses, the treaty should be ratified through the form of constitutional amendment, which requires a more stern step over most of the civilized constitutional states. The constitution is a supreme law in land, and represents a popular sovereignty as sheerly distinguished from the constitutional function of normal branches. When the special mechanics of dispute settlement may adopt an option of forum for escape, it is viewed that its unconstitutionality could yet be cured because the constitutional language of Article III original jurisdiction is considered mandatory or exclusive. I believe that the constitutional amendment procedure only could properly dispose such arrangements. While some areas of the presidential powers are deemed not subject to constitutional review as resorted upon the doctrine of political question or judicial self-restraint, the current jurisprudence gradually finds some limitations on the presidential power of foreign affairs including the treaty or war making provisions. As for a would-be treaty party of FTA, the constitutional issues raised in US is not entirely irrelevant to the Korean case ahead. (shrink)

The United States (U.S.) and Jordan launched negotiations for a free trade agreement in 2000.The US-JO FTA includes a preamble, nineteen articles, three annexes, joint statements, memorandums of understanding, and side letters. In addition to the interesting articles on labor and environment, the US-JO FTA provides the opportunity for Jordanian nationals to come to the U.S. to make investments and participate in trade. Under certain conditions, Jordanian nationals can enter the U.S. to render professional services. The purpose of this article (...) is to examine in detail article 8 of the US-JO FTA which relates to entry of nationals of one party into the territory of the other. The article starts by providing a brief background of the negotiation and conclusion of the US-JO FTA. Then, the article analyzes in detail the specific provision related to temporary entry of nationals. The article draws a comparison between US-JO FTA with the North American Free Trade Agreement (NAFTA) and the more recent trade agreements between the U.S., Oman, Bahrain, and Morocco. Finally, the article observes that although the US-JO FTA, like all US FTAs, is designed to permit temporary entry, without intent to establish permanent residence, of persons, the U.S. should have provided Jordan with special and differential treatment for entry of its nationals. Taking into account the special circumstances of Jordan as a developing country with low-income status, high unemployment rate, and lack of resources, movement of business visitors, investors, intra-company transferees, and professionals should have been dealt with leniency so that the FTA could generate effective and real market access. The objective of this article is to examine the implications of the intellectual property provisions in the US–Jordan Free Trade Agreement (US–JO FTA) and whether they serve as a template for other Arab countries who will be concluding free trade agreements with the USA. My claim in this article is that the intellectual property part of the US–JO FTA goes beyond the World Trade Organization Agreement and cannot form the right template for the proposed US–Middle East FTA of 2013. The (...) first section provides a brief introduction to the US–JO FTA. The second section provides a critical analysis of the FTA’s protection of trademarks, copyright and patents. The third and fourth sections discuss enforcement and implementation of the intellectual property provisions of the FTA. The final section provides a conclusion regarding the intellectual property provisions of the US–JO FTA and highlights an alternative template for the proposed US–Middle East FTA. (shrink)

This paper will attempt to offer a defence of to the Multiverse (MV) hypotheses, in the context of the theistic Fine Tuning Argument (FTA). It will be argued that theistic proponents of the FTA who argue that the MV hypothesis commits the Inverse Gambler’s Fallacy (IGF) are, themselves, guilty of moving the goalposts when it comes to assessing the validity of the MV hypothesis. The Cosmic Slot Machine analogy will be used to demonstrate how the This Universe Objection (TUO), first (...) outlined by White (2000) and further clarified by Draper et al (2007), fails to adequately account for the anthropic principle (or selection effect). The purpose of this paper is to examine the labor and environment provisions of the US-Jordan FTA.

Bu tez çalışmasının amacı altıncı sınıf Fen Bilimleri Ders kitabı öğrenme etkinliklerinin özgün sorgulama özellikleri ve öğrencilerin bilimin doğası hakkındaki görüşlerinin düzeylerini incelenmektir. Bu doğrultuda araştırmada karma yöntem ve verilerin toplanma sistematiğinden dolayı yakınsayan paralel desen kullanılmıştır. Çalışma grubunu uygun örnekleme yöntemi ile belirlenen ve 2017-2018 Eğitim-Öğretim yılında Muğla ili Milas ilçesine bağlı bir köy ortaokulunda altıncı sınıfta öğrenim gören 23 öğrenci oluşturmaktadır.
