The following Introduction briefly traces, albeit in jarring cuts, the evolution of caste question and its relationship with Indian cinema. It also tries to point out some aspects of Indian film theory, its lacunae and hopes that some of the questions raised here may give rise to future works by other (better) theorists. Pre-Independence cinema in India rarely addressed caste question, and if it did, then it was through an abstract global humanist lens. This tendency to address caste through a (...) hollow and empty shell of a theoretical model unfortunately has stuck around even in these times, and only found newer ways to reinvent itself in Neoliberal times. To understand the reason of Indian cinema’s lack of addressing caste more directly and pointedly, it has to be seen as part of a historical process. Only then can we see the history of ideology that is “outside of itself”, that is, in the material conditions that made possible Indian caste-society as well as its cine-culture. It also tries to raise questions about the film form, and its many possibilities of experimentation with the caste question (i.e. both in ideological and experiential possibilities). Lastly, it introduces some of the key works in this issue. Of course, with the hope that the readers will forgive and give respite to the many lacuna of the issue, as well as the Editor himself. During the last years of 1990s and the beginning of the millennia, North Bengal was shaken from its mundane reality right into a middle of a rebellion. With tears of history and warcries of the present, Kamtapur movement revealed itself. In this paper I have tried to locate the social, political, and ideological inclinations that are present within the movement. On one hand my paper intends to critique the presence of what can be called Kochbehar nationalism based on the memory (...) of a pre-independence princely state, on the other hand I am also critiquing the trends and aftermaths of Leftist politics that has been assimilated into the movement itself. While the presence of these two different and to an extent contradictory political thoughts are present within the movement; I have also taken up these new trends in the lights of anarchist tendencies which put more importance on quasi-separations from dominant power centres than class-determinism alone, of course followed by a goal for local empowerment. The concept of artificial intelligence is not new nor is the notion that it should be granted legal protections given its influence on human activity. What is new, on a relative scale, is the notion that artificial intelligence can possess citizenship—a concept reserved only for humans, as it presupposes the idea of possessing civil duties and protections. Where there are several decades’ worth of writing on the concept of the legal status of computational artificial artefacts in the USA and elsewhere, (...) it is surprising that law makers internationally have come to a standstill to protect our silicon brainchildren. In this essay, it will be assumed that future artificial entities, such as Sophia the Robot, will be granted citizenship on an international scale. With this assumption, an analysis of rights will be made with respect to the needs of a non-biological intelligence possessing legal and civic duties akin to those possessed by humanity today. This essay does not present a full set of rights for artificial intelligence—instead, it aims to provide international jurisprudence evidence aliunde ab extra de lege lata for any future measures made to protect non-biological intelligence. The rapid advancement of artificial intelligence systems has generated a means whereby assistive bionic prosthetics can become both more effective and practical for the patients who rely upon the use of such machines in their daily lives. However, de lege lata remains relatively unspoken as to the legal status of patients whose devices contain self-learning CIS that can interface directly with the peripheral nervous system. As a means to reconcile for this lack of legal foresight, this article approaches the (...) topic of CIS-nervous system interaction and the impacts it may have on the legal definition of “persons” under the law. While other literature of this nature centres upon notions of transhumanism or self-enhancement, the approach herein approached is designed to focus solely upon the legal nature of independent CIS actions when operating alongside human subjects. To this end, it is hoped that further discussion on the topic can be garnered outside of transhumanist discourse to expedite legal consideration for how these emerging relationships ought to be received by law-generating bodies internationally. RESUMO A alimentação é o fator que mais onera um sistema de produção animal. Assim, a utilização de diferentes estratégias de alimentação dos animais ainda é o grande desafio da nutrição animal, principalmente, levando em consideração as exigências nutricionais de diferentes categorias de ruminantes, em especial bovinos em regiões tropicais, haja vista que a sazonalidade na produção de forragens afeta diretamente a produção bovina, promovendo inadequação no atendimento das exigências nutricionais dos animais principalmente em minerais e vitaminas. Uma alimentação que (...) não atenda as exigências nutricionais dos ruminantes gera prejuízos no sistema de produção, além de, em casos mais graves, ocasionar a perda do animal. Estudos que abordam o efeito e a importância de vitaminas e minerais na nutrição bovina são escassos e necessários. Recentemente a National Research Council (NRC) apresentou novos registros das exigências nutricionais das vitaminas e minerais. Essas alterações proporcionam um impacto econômico significativo em relação à nutrição animal. Thus, the use of different animal feeding strategies is still the great challenge of animal nutrition, taking into account the nutritional requirements of different categories of ruminants, especially cattle in tropical regions, given that seasonality in forage production directly affects cattle production, promoting inadequacy in meeting the nutritional requirements of animals, mainly in minerals and vitamins. A diet that does not meet the nutritional requirements of ruminants generates losses in the production system, in addition to, in more serious cases, causing the loss of the animal. Studies that address the effect and importance of vitamins and minerals in bovine nutrition are scarce and necessary. Recently the National Research Council (NRC) presented new records of the nutritional requirements of vitamins and minerals. These changes provide a significant economic impact on animal nutrition. Jag tror att det är ett misstag att kräva av humanvetenskaperna (d.v.s. humaniora, samhälls- och beteendevetenskaperna) att de imiterar naturvetenskapernas forskningsmetodik. Humanvetenskaperna studerar meningsfulla fenomen vilkas natur är på ett grundläggande sätt annorlunda än de blott fysiska fenomen som naturvetenskapen studerar. Den största skillnaden är att meningsfulla fenomen inte uppenbarligen är lagbundna på samma sätt som fysiska fenomen och uppvisar därför inte samma regelbundenhet och förutsägbarhet som fysiska fenomen. För att studera meningsfulla fenomen krävs därför andra forskningsmetoder. Trots att humanvetenskaperna (...) studerar fenomen som inte är lagbundna och är på ett visst sätt subjektiva, så vill jag mena att de studerar objektivt verkliga fenomen och kan få giltig kunskap om dem. Att subjektiva fenomen också kan vara objektivt verkliga kan låta märkligt för vissa läsare, varför jag rundar av med en diskussion om vad det egentligen innebär för något att vara objektivt verkligt. Enligt den definition jag föreslår så framstår att meningsfulla fenomen, också de som kallas ”sociala konstruktioner”, kan förstås som objektivt verkliga företeelser trots att de på ett betydelsefullt sätt också är subjektiva. In this article, we analyze how the checks-and-balances principle in the Finnish Constitution regarding the declaration of the state of emergency. We first discuss the basic principles of the separation of powers and checks and balances, and explicate how these principles are relevant to declaring a state of emergency (section 2). We then move on to analysing the Finnish legal order, de lege lata, regarding the declaration of the state of emergency, both on the level of the Constitution and (...) on the level of the Emergency Powers Act (section 3). This section elaborates the role of the legislative branch in checking the executive and the authority of the executive(s) in declaring a state of emergency. By means of our theoretical discussion and legal analysis, we will evaluate critically the declaration requirement’s political entailments for the Finnish legal system and propose some changes for the future, de lege ferenda (section 4). This evaluation critically assesses the present legislation regarding the declaration and its recent practice during COVID-19 pandemic. (shrink)
