The purpose of this paper is to offer some critical remarks on the so-called pragmatist approach to the regulation of robotics. To this end, the article mainly reviews the work of Jack Balkin and Joanna Bryson, who have taken up such ap- proach with interestingly similar outcomes. Moreover, special attention will be paid to the discussion concerning the legal fiction of ‘electronic personality’. This will help shed light on the opposition between essentialist and pragmatist methodologies. After a brief introduction (...) (1.), in 2. I introduce the main points of the methodological debate which opposes pragmatism and essentialism in the regulation of robotics and I examine how legal fictions are framed from a pragmatist, functional perspective. Since this approach entails a neat separation of ontological analysis and legal rea- soning, in 3. I discuss whether considerations on robots’ essence are actually put into brackets when the pragmatist approach is endorsed. Finally, in 4. I address the problem of the social valence of legal fictions in order to suggest a possible limit of the pragmatist approach. My conclusion (5.) is that in the specific case of regulating robotics it may be very difficult to separate ontological considerations from legal reasoning—and vice versa—both on an epistemological and social level. This calls for great caution in the recourse to anthropomorphic legal fictions. (shrink)

The research behind this paper was motivated by Lyman Tower Sargent’s keynote address on Australian utopian literature, presented at the Demanding the Impossible: Utopia, Dystopia and Science Fiction conference, held at Monash University in 2007. 1 In the printed version of his paper, Sargent notes that the theme of religion “runs throughout Australian utopianism, but with extremely varied content.” 2 This is certainly true of the late Victorian era, when public discussion of issues relating to evolutionary theory and the (...) role of religion in society grew particularly intense. This paper will investigate some of the different treatments of science and religion in Australian utopian literature from 1870 to 1900. I will contend that an examination of this literature supports recent historiography, which contests the problematic science-versus-religion dichotomy that has often been used to characterise the Victorian “crisis of faith.” I will first consider the historical context of the late Victorian era and scholarly trends concerning the relationship between science and religion, before moving on to examine how some Australian utopian authors of the late nineteenth century approached the issues of science, Darwinism, eugenics, secularism, church reform, spiritualism, and agnosticism. Through a brief examination of selected contemporary utopian texts that focus on issues relating to science and religion, I intend to demonstrate the wide range of attitudes and beliefs influencing utopianism in late-nineteenth-century Australia. An orbital simulation program is described that uses a geometrical approach to emulate gravitational and atomic orbits at the Planck scale. The gravitational orbital approach divides orbiting objects into multiples of Planck mass points to form an n-body complex of discrete point-to-point orbital pairs between the objects. Each orbital pair rotates 1 Planck length per unit of Planck time in a continuous loop such that when mapped over time gravitational orbits emerge. However 1 point may contain 10^{20} or more individual (...) particles, and so to analyze individual particle-particle orbital pairing we can use atomic orbital transitions. For this, the gravitation simulation program is modified to map the orbital of an electron-proton pair (H-atom) by the addition of an alpha (fine structure constant) term. For transitions, the incoming photon is absorbed by (or ejected from) the orbital radius in discrete alpha steps (the orbital radius is assigned photon-like properties), the electron itself has a passive role in the transition process. An orbital radius variable delta; orbital radius = (2alpha + delta)*lambda(electron+proton), was selected to correlate with the Lyman series transition frequencies. A linear relationship was observed between delta and these frequencies with notably at delta = 0 (the classical Bohr model), the principal quantum number n = sqrt(2) and the transition energy = half ionization energy.
