At a House hearing on December 5, 2023, the presidents of three universities—Harvard, MIT, and the University of Pennsylvania—refused to state that certain kinds of hate speech, specifically calls for genocide of Jews, are prohibited on their campuses. The backlash against two of them, Harvard’s Claudine Gay and Penn’s Liz Magill, was swift and devastating; both of them were successfully pressured to resign. Still, while Professors Gay’s and Magill’s responses were widely criticized as tone-deaf, they were legally correct. At many (...) private, and all public, colleges and universities, even the worst hate speech is generally protected unless it is accompanied by aggressive, threatening, or violent conduct. -/- These “demotions” augur even worse consequences, including termination, for less powerful faculty who say the “wrong” thing, in particular statements in support of Trumpism, an increasingly mainstream ideology that stitches together white supremacy, misogyny, a preference for autocracy over democracy, and several phobias—homophobia, Islamophobia, transphobia, and xenophobia. The question I address in this paper is whether these consequences are constitutional at public schools. Whose right is stronger—a public-school teacher’s First Amendment right to express pro-Trumpist sentiments or a public school’s right to maintain a fair, inclusive, and welcoming learning environment? In this article, I argue that the public school has the upper hand here, that it is indeed constitutionally permitted to prohibit political hate speech that contributes to a hostile learning environment. Still, I narrowly limit this prohibition to dehumanizing speech—that is, speech explicitly suggesting that some human beings are “lesser”, intrinsically less valuable, than other human beings. -/- One objection to this position is that public schools may not prohibit any speech, no matter how dehumanizing, because such prohibition amounts to constitutionally impermissible viewpoint discrimination. I argue, however, that viewpoint discrimination is an integral part of education and therefore constitutionally permissible. Education necessarily involves promoting some values over others. These values fall into seven categories: constitutional principles, the humanist virtues, successful character traits and behaviors, knowledge and truth, art and beauty, health (both mental and physical), and social goods (such as justice, peace, and rule of law). This chapter will evaluate humor used with the specific intent to reveal glaring epistemic errors that lead to injustice; flaws in reasoning so transparent that straightforward logic, argument, and evidence seem ineffectual against them, and in some cases, just silly to think such tools would be needed. Laughter seems to be one of the only sane responses. In particular, I will assess how humor can combat conspiracy theories, propaganda, lies, and bullshit. The last one I view in Harry Frankfurt's sense (...) of a complete lack of concern for truth or reality, which I think sums up former President Donald Trump's epic lack of curiosity which has a trickle-down effect on his ardent followers. The sort of conspiracy theories I will focus on are an intermingling of propaganda, well defined and analyzed by Jason Stanley in his work How Propaganda Works, and the "new conspiracism", outlined by Muirhead and Rosenblum in A Lot of People are Saying: The New Conspiracism and The Assault on Democracy. There are perils with this potency of pugilistic comedy. It is easy to punch up, humorously fume at the foibles and fantastical blunders of a world leader who seriously considers ingesting bleach to combat the plague, who also, without irony, regales us of his capacious mnemonic prowess in recalling the following words on a cognitive test: "Person. Woman. Man. Camera. TV." The self-proclaimed "stable genius" aced it. But when Trumpism and QAnon e.g., spreads among many who are impoverished and disempowered, the very people to whom Trump and others in his powerful orbit have incessantly lied, it becomes less clear how to wield truth-and justice-seeking wit. Are consciousness-raising comedians seeking to uncover and undermine obvious and dangerous falsehoods punching in the morally correct direction, and how can we tell? (shrink)

What is the growing appeal of the “Alt-Right” (Alternative Right), a white-supremacist and anti-feminist movement, for young, primarily male, Millennials in the United States? In this chapter, I outline how the Alt-Right uses laughter in its culture industry on the internet to recruit new members to its right extremist ideas. I also explain how laughter connects Alt-Right extremism with Trumpism. Throughout the chapter, I draw on Theodor W. Adorno’s critical theorizing of laughter fabricated by the culture industry to establish (...) the theoretical framework, which I ground with in-depth interviews with Alt-Right members. (shrink)

The article discusses the future of US democracy after the end of Donald J. Trump’s scandal-ridden presidency, which culminated in a violent attempted self-coup. In contrast to many observers outside the United States who appear to assume that Joe Biden’s inauguration marks the failure of the coup attempt, I argue that this view is overly optimistic. First, Trump by no means acted alone but was supported by leading figures in the Republican Party (GOP). Second, the attack on democratic norms and (...) institutions to restore and permanently cement Republican minority rule continues to move forward. The 2022 midterm elections and the 2024 presidential election set the course on whether the United States will return to liberal democracy or degrade into Hungary-style competitive authoritarianism. While it is clear what those attracted to fascism today are against, it is less clear what they are for. Not in the sense of how they want to remake society—this is usually clear enough. What is less clear is the fundamental values that are driving their desire to create a different kind of order. Compounding this difficulty, too many liberals are stubbornly sticking to some conventional beliefs: that human nature is as liberals think it is, not something that is (...) fundamentally disputed; that facts are what liberals think they are, even if some people choose to ignore them; and that everybody is pursuing basically the same conception of the good, even if some of them are deluded as to where we are now and how to get where we want to go. -/- But this move to the right is not being driven simply by mistakes; it is a principled move, backed by a coherent, consistent, and historically well-sourced value system, even if this value system is perverse. Fascism has its own conception of the moral subject; of the need for a rigid social hierarchy of men; of the nature of individual rights; and of the importance of purity in blood, soil, and ideology. It believes in the unity of the people, the leader, and the state; it embraces very different and (to liberals) often disturbing moral ends; and it employs starkly different rules of social interaction. And it believes, in the end, that this all leads to the greatest expression of democracy ever invented. (shrink)
