Some aspects of transcendental phenomenology as principal for social investigations are considered in this article. It is demonstrated that on the basis of the objective hermeneutics of Ulrich Overman can be solved some fundamental tasks of constitutive phenomenology of naturality of Alfred Schьtz. Any action is actually a subjective process, i.e. a process that has his own agent. Accordingly to this, there is no reason at all to attribute constructed action in this sense of objective significance. Recognition of this leads (...) to relativism, and in consequence to the epistemological pessimism. Only when intersubjectivity is viewed as a universal opportunity to experience we have some hopes to be free from the risk of such relativism. (shrink)

In the article by Buravskіу O. A. «Position of the Roman Catholic Church in the Right Bank Ukraine and Belarus in the second half of the XIX century» on the basis of archival documents analysis position of the Roman Catholic Church in the Right Bank Ukraine and peculiarities of its functioning on the territories of Belarus provinces in the second half of XIX century are analyzed.

The article considers the history of implementation and evolution of Accusatory theology in the Kyiv Theological Academy. The author shows the place where the controversy with other religions and other Christian denominations took place in the curriculum of the Kyiv Theological Academy after the introduction of the Statute of the religious schools of 1808–1814 in Kyiv. The article deals with the content of the lecture courses of Archbishop Smaragd, Archimandrite Antonin, Bishop Sylvester, Philip Ternovsky, and Bishop Augustine. The author shows (...) that the Accusatory theology was not an independent academic discipline at first, but it was part of the general course of theology. For the first time, lectures on accusatory theology were given in Kyiv in 1823. On the recommendation of the Commission of theological schools, teachers of this discipline were to use the book of the German Lutheran theologian Johann Ernst Schubert «Institutionum Theologiae polemicae» during the preparation of lectures. Comparison of this book with the lectures of hieromonk Smaragd shows that the work of the German theologian was used by the Kyiv teacher quite selectively. Next, the article shows how in the following decades the content of the course of accusatory theology varied, depending on the general situation in theological education in the Russian Empire. In particular, the changes that took place in the curriculum of the Kyiv Theological Academy in the 1840’s were characterized on the initiative of the Chief Procurator of the Holy Synod, Mykola Protasov. The author drew attention to the personal preferences of professors who found a reflection in their curriculum in Accusatory theology. In particular, Bishop Sylvester in his course substantially expanded the controversy with the latest philosophical currents that opposed Christianity. Instead, Philip Ternovsky and Bishop Augustine actively used the historical method, resulting in their courses representing the history of the controversy of the Orthodox Church with its various opponents. In the 1860’s, when a large-scale reform of theological education was being prepared in the Russian Empire, the idea of a radical revision of the accusatory theology teaching concept was heard at the Kyiv Theological Academy. At the same time, some professors even advocated the abolition of accusatory theology as an independent discipline and for joining it to the course of church history. Special attention is paid to the fact that the courses of accusatory theology in the Kyiv Theological Academy in the nineteenth century were based on typical contemporary ecclesiology and soteriology of that time. The purpose of the course was seen not in the equal dialogue with opponents, but in revealing their mistakes and attempts to convert them to the Orthodox Church. Article received 03.07.2019. Здійснено спробу з’ясувати «читацький канон» та охарактеризувати книжкову культуру православних монастирів ранньомодерного часу київської традиції на прикладі чотирьох обителей Львівської єпархії — Крехівської, Львівської Святоонуфріївської, Підгорецької та Теребовельської. Вибір цих монастирів зумовлено станом джерельної бази, а основними джерелами слугували «списки книг», що їх зазвичай подавали в інвентарних описах. Усі досліджені книжкові зібрання були невеликими за обсягом порівняно з тогочасними католицькими кляшторами, зокрема, найбільше з-поміж відомих, крехівське, налічувало лише бл. 100 томів. Lectio Orthodoxorum монахів Львівської єпархії XVII ст. — це, окрім (...) богослужбових книг, своєрідна «тріада»: святоотцівська духовно-аскетична спадщина, житійна (агіографічна) та проповідницька література. Практично немає античної спадщини — творів давньогрецьких та давньоримських авторів, на вивченні яких базувалась гуманістична система освіти, у тому числі в церковних релігійних закладах. Це опосередковано говорить або про освітній рівень ченців, або, можливо, про відсутність «практичної» потреби у такій лектурі — на відміну від обителей, при яких діяли навчальні осередки. Чи це може бути одним зі свідчень того, що для насельників досліджуваних монастирів основним залишалось молитовне життя, а не «інтелектуальна» праця? Чи такий склад і невеликі обсяги книжкових зібрань можуть виступати одним із арґументів для розгляду цих монастирів як місць, де панував lex orandi, натомість інтелектуальна діяльність, зокрема анґажованість у читання, не видавалася необхідною? Відповідь на ці питання вимагає подальших досліджень. (shrink)

Problem setting. The modern understanding of law implies the need of new methods, which could correlate theoretical models of legal regulation and changes in the sociocultural context. Reference to the theoretical opportunities of phenomenology enables, in particular, to study the nature of the legal life procedural features, and the conditions of forming the image of atemporal legal structure. Recent research and publications analysis. Currently humanitarian knowledge includes a significant number of papers, devoted to the theoretical problems of studying the phenomenon (...) of law. First of all, the authors emphasize that the field of philosophical-legal and legal studies is in the methodological crisis, determined by the uncertainty of the scientific status of the philosophy of law, one-sidedness of classical types of the law understanding, the incoherence of legal language and thinking styles etc. In addition, despite quite common use of the phenomenological methodology, the philosophy of law still lacks integrated concepts, enabling, inter alia, to find out ontological bases of legal life as a meaningful law configurate. Paper objective. The objective of the study is the analysis of the existing opinions on the problem of the process and structural nature in social cognition to explain the nature of the law process, as well as further search for the ontological grounds of legal life. Paper main body. Phenomenological methods applied in studying legal life enable to suggest that law is of process nature, which is, in turn, comparable to the process nature of sensemaking. The search for the ontological grounds of legal life implies retrospective analysis of the issues, related to the research into structural and process properties in philosophy and phenomenology of law. The study of the works by E. Husserl shows that the philosopher confirmed the inner time of consciousness, but avoided considering reality itself from the standpoint of temporality, changeability and process. E. Husserl’s followers believed that the legal meaning existed beyond the time context, but could be found within time when it was analyzed as a social phenomenon. The structural-functional approach and the systems theory show a number of difficulties, related to the conventionalism of the synchrony - diachrony dichotomy, the lack of considering the activity level of the subject of cognition, the openness of identifying the nature and mechanism of actual social changes, eclectics of cognition methods etc. The analysis of the process philosophy tradition does not reveal clear arguments for the statement of the process nature of legal life either. It is due to the fact that process ontology is theoretically supported, on the one hand, by indestructibility of duration as an immanent property of the material world and the world of consciousness, on the other – by the need of elements beyond the time. Alternative approaches to solving the problem of the ontology of social phenomena demonstrate the transition from the basic image of the structural nature to the process nature as the essential subject of practical and pure problems of social reality consciousness. They try to integrate structural and process nature as the modes of social reality ontology. The analysis of theoretical and methodological arguments for the statement of the process nature of legal life enables to confirm that process is not its absolute substance. The phenomenon of legal life also shows structural properties, which, however, exist only within the process dimension. The availability of process-structure ontological dichotomy in the descriptions of legal life is determined by the fragmentariness of social existence. Legal structure is a virtual image, which is implemented as a process in the practices carried out by the subject of law. In turn, the description of legal processes suggests the “inclusion” of intentional structures, being in charge of articulation and sustainability of their perception. Conclusions of the research. The solution to the problem of searching legal life ontological grounds consists in generating integrative experience of law description and singling out two interrelated grounds: “law-structure” and “law-process” within the integrity of legal life. The last decade of the last century and the first years of the XXI century. proved to be quite significant both in the realm of Catholic-Orthodox dialogue in the context of the ecumenical concept, as well as in the interest of theological discussion on this subject in extracurricular Catholic circles, represented by the venerable profession of Catholic universities and the Jesuit and allied Jesuits. It should be noted immediately that in these discussions, the voices of Orthodox authorities, with the exception (...) of some clergy of the Eastern Orthodox patriarchates, play a rather modest role. The Moscow Patriarchate occasionally makes ironic replies regarding some of the statements made by Vatican diplomats and, most recently, the pontiff himself. Ukrainian Orthodoxy, divided and focused on intra-Ukrainian church problems, does not respond to the innovations that emerge from Catholic-Orthodox dialogue. (shrink)

In the Nadiia Volik article «The Five decrees of the Congregation for the Doctrine of the Faith which impacted on the processes of Greek Catholic Church formation in Canada » the main documents of the Congregation for the Doctrine of the Faith which were aimed to the regulating the activities of the Greek Catholic clergy in emigration, specifically in Canada have been analyzed by the author.

The article deals with the problem of military chaplaincy service formation in the period of independence of Ukraine as one of the priority directions of relations between the state and religious organizations in Ukraine. The current state of military pastoral care is analyzed directly in the context of Catholic churches activities in Ukraine in this aspect. In particular, the institutional component of the Catholic churches is clarified, statistics demonstrating the quantitative and percentage composition of the Catholic churches in the religious (...) network of Ukraine are provided. The results of sociological surveys of the religious situation in Ukraine and the identification of religiosity of the population in the context of Catholic churches are analyzed. The opinion of the population of Ukraine regarding the trust in religious organizations, religious leaders and the military formations of Ukraine is examined. The opinion of the population on the expediency of establishing a military chaplaincy institute in Ukraine is also clarified. The organizational division of the internal structure of the Catholic churches in Ukraine is presented, and it is also clarified which structural units are responsible for coordination with the Ukrainian power structures and organization of pastoral work. Attention is drawn to the review of the cooperation of the Catholic churches in Ukraine with the military formations of Ukraine in the aspect of pastoral activity. Special attention is paid to the coverage of the various areas of pastoral work directly by the military chaplains of the Catholic churches and the coordination of this work by the relevant structural units of the Catholic churches. In particular, conferences, meetings, trainings, pilgrimages on the organization and implementation of pastoral work in the field of military chaplaincy. Also, consideration is given to the activities of the advisory body on military chaplaincy at the Ministry of Defense of Ukraine and its contribution to the establishment of the Institute of Military Chaplaincy in Ukraine. The inter-denominational cooperation of the churches in Ukraine, including the Catholic ones, was considered in establishing a military chaplaincy institution in independent Ukraine through the activities of interfaith associations. It has been found that the issue of legislative securing of the Institute of Military Chaplaincy in the Armed Forces of Ukraine remains urgent. In this regard, the legislative work in this area and the involvement of Catholic churches in Ukraine are highlighted. (shrink)

Prysukhin “The Principle of Subsidiarity: Lessons from the Social Teaching of the Catholic Church” analyzes the achievements of the Social Teaching of the Catholic Church, represented by the works of Leo XIII, Pius XI, Pius XII, John Paul II, revealing the meaningful characteristics of the concept of “the principle of subsidiarity”, its role and meaning in the system of Christian values. The principle of subsidiarity makes possible such relationships in social life, when the community of higher (...) order does not interfere in the internal life of the community of the lower order, taking over the proper functions of that function; for the common good it gives it when necessary support and assistance, thereby coordinating its interaction with other social structures. The principle of subsidiarity guides social practice to the promotion of the common good in the human community. The spread and application of the principle of subsidiarity opposes the danger of "nationalization" of society and the most terrible manifestations of collectivism, restricts the absoluteization of power, bureaucratization of state and socio-cultural structures, becoming one of the guarantors of respect for the rights and freedoms of citizens of their country.
