It reveals the original concept of nation B. Starosolskoho, which significantly differed from theories Ukrainian scientists early twentieth century. Unlike most of the theories that have been etnitsyskymy, it is a modernist. The author draws a lot of attention not only on the role of traditional factors: culture, language in nation-building, but also democracy. That is democracy, in his opinion, played a crucial role in the formation and establishment of the nation. For a long time the theory of nation by (...) V. Starosolsky has not been properly researched and assessed by scientists. First, because of the ideological taboos and later on because the studies of other authors were more popular. It should be noted that his theory of nation is very different from similar theories of early twentieth century most of which were the variations of ethnological theories. Thus, an important task of Ukrainian political science is the understanding of conceptual prospective ideas which were put forward by V. Starososlsky and have the potential for use in the formulation and implementation of national policies of modern Ukraine. Despite some efforts of the Ukrainian researchers to explore and to understand the theoretical legacy of the scientist it still remains poorly explored. The article explores the ways to solve the problem of the lack of a common interdisciplinary definition of myth at the beginning of the 21st century. The problem was actualized in the 20th century after the development of new theories that reject the enlightening stereotypes of archaic nature of myth, and instead develop the ideas about the existence of modern mythology, the inability to escape from myth and its active participation in the formation of the current worldview. A number of (...) contemporary researchers have been attempting to evade a common ultimate definition of myth in favour of forming a productive, inclusive discourse. So, there are attempts to refrain from defining myth at all, to elaborate a compromise definition, to define not a myth but a “work on myth”, to evolve a detailed but flexible definition that is open to adjustments. These investigations ground an interdisciplinary theoretical foundation that can be used for further studies of the mythic phenomena in each individual perspective, without neglecting the achievements of various discourses. It is also noticed that a common feature of contemporary efforts to define a myth is an observation that we always deal with a myth not as an isolated story but simultaneously with the diversity of its plots and manifestations. The studies focus on its multiplicity, variability, modifiability through time. The other important side of myth is significance that it produces for both universal and specific aspects of the life of social groups. If the narrative stops producing significance, it loses its mythic status and transforms into the products of the mythology of other epochs. Article received 27.08.2019. (shrink)

Розглядаються питання духовних основ права, до яких можна віднести етичні емоції. Аналізується внутрішня психологічна складова права і зовнішня соціальна складова та їх взаємодія і поєднання. Особлива увага приділяється природі етичної емоції, її ролі і значенні для права і моралі у концепції Л. Петражицького.

Проаналізовано правові принципи та механізми забезпечення сталого функціонування інституту місцевого самоврядування в Україні. Основна увага була приділена двом групам документів. По-перше, основним нормативно-правовим актам, що регулюють правовідносини у даній сфері. По-друге, стратегічним документам, які визначають напрямки та цілі розвитку місцевого самоврядування на сучасному етапі державотворення. Обґрунтовано необхідність вдосконалення існуючої системи місцевого самоврядування, зокрема її адаптації до Європейських принципів та стандартів урядування на місцевому рівні. В результаті дослідження зроблено вичерпні висновки.

The article discusses current issues essence of judicial policy and its role in modern political process on the material prosecutions of former Italian Prime Minister Silvio Berlusconi. Berlusconi revealed character of the struggle against the so-called «dictatorship of leftist judges» in Italy. Draws attention to the connection between the trials against Berlusconi’s political opponents and attempts to weaken its position and remove from all political activity, as well as unsuccessful attempts led by Berlusconi’s political forces to use legal mechanisms and (...) public outcry for protection from prosecution. The term «judicial policy» is commonly used by lawyers in a purely legal context, but we can not ignore its political meaning. In the seminal book by A. Barak «Judicial discretion» judicial politics is seen as «a set of factors that guide the judiciary when she makes the choice of the options that gives it the right». A key figure in the field of judicial politics serving judge has the authority to review the relevant legal disputes in a certain kind of justice, development and production of judicial policy on the application of regulations generalization of judicial practice and the creation of legal positions and so on. Prosecution Silvio Berlusconi give reason to consider judicial policy of Italy as an example, which confirms the high level of integrity of the judiciary in the political process. Politics judiciary, implemented including through judicial policies are not free from the influence of ideological factors, factors of political competition and more. The use of the judiciary as a tool of political influence in these conditions becomes an important factor in the creation of additional benefits to certain political forces in the fight against opponents that undermines democratic political system. У статті проаналізовано особливості формування світоглядних орієнтацій українців Закарпаття. Порушена проблема розглядається у контексті порівняння архетипів населення України. Філософська компаративістика приводить до висновку, що локальні світоглядні особливості українців-русинів, незважаючи на деякі нюанси вписуються в загальноукраїнський етнопсихологічний портрет. Варто виділити гуманістичність, демократизм кордоцентризм та ідеалізм, що означає перевагу духовного розвитку, поверхневе розуміння дійсності, відірваність від реальності. У цілому, незважаючи на різні нюанси, дослідники виділяють позитивні та негативні риси етнічного світогляду, які є спільними та типовими для всіх українців.
