The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. In this paper, we closely examine the various ways in which a multi-party argumentative discussion—argumentative polylogue—can be analyzed in a dialectical framework. Our chief concern is that while multi-party and multi-position discussions are characteristic of a large class of argumentative activities, dialectical approaches would analyze and evaluate them in terms of dyadic exchanges between two parties: pro and con. Using as an example an academic committee arguing about the researcher of the year as well as other cases from argumentation literature, (...) we scrutinize the advantages and pitfalls of applying a dialectical framework to polylogue analysis and evaluation. We recognize two basic dialectical methods: interpreting polylogues as exchanges between two main camps and splitting polylogues into a multitude of dual encounters. It is argued here that large-scale organization and networked computing enable new divisions of communicative work aimed at shaping the content, direction, and outcomes of societal conversations. The challenge for argumentation theory and practice lies in attending to these new divisions of communicative work in constituting contemporary argumentative realities. Goffman’s conceptualization of participation frameworks and production formats are applied to articulate the communicative work of organizations afforded by networked computing that invents and innovates argument in all of its senses—as product, (...) process, and procedure. Communicative work, however, may be scaffolding argumentative contexts and practices that are quite different than what has constituted past argumentative realities. The computerization of argument happens as organizations invent and innovate argument practice relative to the demands and opportunities of interorganizational communication. The cases and examples examined here suggest that argument practice is evolving around the logic of conversation and the principle of personalization. The analysis challenges argumentation theory to seriously engage with the construction of communicative contexts and the realization of ideas about disagreement management in organizational practice and information infrastructures. Directions for integrating insights from a design perspective on argument with insights from organizational and information systems theory are proposed for coming to terms with an era of large-scale organization and computerization, in particular the evolution of argument practice, the inscription of argument in the built environment, and the absorption of socio-cultural argument practices by organizations and computation. This paper offers a new way to make sense of disagreement expansion from a polylogical perspective by incorporating various places in addition to players and positions into the analysis. The concepts build on prior implicit ideas about disagreement space by suggesting how to more fully account for argumentative context, and its construction, in large-scale complex controversies. As a basis for our polylogical analysis, we use a New York Times news story reporting on an oil train explosion—a significant point in the (...) broader controversy over producing oil and gas via hydraulic fracturing. Argumentation as the public exchange of reasons is widely thought to enhance deliberative interactions that generate and justify reasonable public policies. Adopting an argumentation-theoretic perspective, we survey the norms that should govern public argumentation and address some of the complexities that scholarly treatments have identified. Our focus is on norms associated with the ideals of correctness and participation as sources of a politically legitimate deliberative outcome. In principle, both ideals are mutually coherent. If the information needed for a correct deliberative (...) outcome is distributed among agents, then maximising participation increases information diversity. But both ideals can also be in tension. If participants lack competence or are prone to biases, a correct deliberative outcome requires limiting participation. The central question for public argumentation, therefore, is how to strike a balance between both ideals. Rather than advocating a preferred normative framework, our main purpose is to illustrate the complexity of this theme. (shrink)

This study examines the mediator practices to bring the interaction back on track when the participants of dispute mediation go off-task. An existing collection of 18 transcripts from audio recordings of mediation sessions at a mediation center in the western United States serves as a source of interactional data. First, the study examines the moves mediators make to perform interventions to bring the current state of activity more in line with mediation activity. Second, it accounts for the variety of interventions (...) mediators perform using the concepts of face and facework. While several taxonomies of meta-discourse exist, none clearly explains speakers’ strategies in mediation. Mediators, however, seem to rely a lot on meta-discourse to manage the argument while preserving their neutrality. This article proposes corpus analyses to detect mediation participants’ discourse strategies and highlight the role and function of a meta-discourse element – the verb ‘to say’. This article is a first step towards the elaboration of a taxonomy for the analysis of argumentative meta-discourse and brings new insights into meta-discourse in (...) argumentative dialogues and mediation discourse in general. Compared to other domains of media discourse, economic-financial news contain a considerable amount of speech acts regarding future events, in particular predictions. This can be explained by their specific institutional context, financial markets, where investors constantly seek to single out gain opportunities and to correctly assess their risk. One of the crucial factors making economic-financial predictions worthy of being considered in investment decisions is argumentation, in particular the extent to which the predicted proposition follows from a plausible and acceptable reasoning. Starting from a corpus of 50 articles of the Italian economic-financial press, we consider the inferential dimension of prediction-oriented arguments, focusing on the locus, i.e. the ontological relation on which the connection between the argument and the predictive conclusion rests. All predictions found in the corpus were manually annotated with the software UAM Corpus Tool. For each of them we identified the source, which could be either the journalist him/herself or a third party, typically financial analysts or corporate actors. We distinguished mere predictive opinions from predictive standpoints, i.e. predictions for which the journalist advances one or more supportive arguments. For the latter category, we identified the locus referring to an adaptation of the taxonomy outlined by Rigotti. The findings highlight in particular the following three interesting aspects: in predictions, journalists reinforce their stance by plausible justifications, but weaken it at the same time by marking it as uncertain and/or by using reported speech or evidential means to reduce their responsibility for the predictive speech act; the justification of a predictive standpoint, by the journalist or by third parties, is mostly based on loci of causality, in particular on the locus from efficient cause, the locus from final cause and complex forms of causality where the involvement of rational agents is implied but defocused; moreover, journalists refer to the predictive opinions of experts or corporate insiders to activate the locus from authority, either by explicit argumentation or implicitly, by reporting speech from reliable sources. Our study suggests that the role of predictions in financial news is not so much that of giving any straightforward advice to investors, but rather that of providing chunks of sound argumentative reasoning, including both supportive evidence and rebuttals or refutatory moves, that the investor-reader might apply and combine in the highly uncertain context of financial markets. Overall, our findings shed light on how financial journalists fulfil the function of information intermediaries in finance. (shrink)

Mediation is an alternative dispute resolution process that is becoming more and more popular particularly in English-speaking countries. In contrast to traditional litigation it has not benefited from technological advances and little research has been carried out to make this increasingly widespread practice more efficient. The study of argumentation in dispute mediation hitherto has largely been concerned with theoretical insights. The development of argumentation theories linked to computational applications opens promising new horizons since computational tools could support mediators, making sessions (...) quicker and more efficient. For this, we need tools for close analysis of mediation discourse in order to explore the argumentative activity in depth, and ultimately get an accurate image of how dialogues unfold in this particular context. This paper therefore aims at laying the foundations of a theory of close analysis for discourse in dispute mediation. Theories provided by the literature serve as a basis for argumentative analyses of transcripts of mediation sessions in order to deliver a clear image of the argumentative structure. Analyses of the argumentative strategies in mediation discourse will allow for the development of a dialogue protocol that can be used to develop operational models which can be embodied in software to help make the mediation process easier and more effective. Douglas Walton has been right in calling us to attend to the pragmatics of argument. He has, however, also insisted that arguments should be understood and assessed by considering the functions they perform; and from this, I dissent. Argument has no determinable function in the sense Walton needs, and even if it did, that function would not ground norms for argumentative practice. As an alternative to a functional theory of argumentative pragmatics, I propose a design view, which draws attention to (...) the way participants strategically undertake and impose norms on themselves in order for their arguments to have force. When discussing dialogue, argumentation researchers rarely draw the distinction between the story world and interactional world. While mediators often help to shape the interactions among agonists in the emerging flow of spoken discourse, writers of postulated dialogues narrate them, constructing a story world that depicts the agonists, depicts their utterances and their circumstances. In this paper, I ask where the agonists of the dialogue model of argument interact, and I show that they often interact in the story world of postulated (...) dialogues. Postulated dialogues are story problem conversations. Common in textbooks, exams, and standardized tests, story problems create hypothetical situations to illustrate formal relationships among variables, and are designed to be read in a theoretical attitude that treats the characters, objects, and circumstances that they depict as given. When argumentation researchers examine postulated dialogues, they tend to adopt a theoretical attitude, limiting their analysis to the conversation between the agonists depicted in the story world. Reading this way makes it easier to overlook the interactional world where the writing and reading of the texts takes place, obscuring the fact that they are narrated dialogues, often written by researchers. Reading this way also makes it easier to confirm the traditional participation framework of the dialogue model of argument. (shrink)

When parties attempt to persuade their opponents of the tenability of a certain standpoint using reasons, they will often find that the circumstances of the dialogue hinder their chances of resolution. Power imbalances, cognitive biases, lack of time or hidden interests are some of the circumstances they need to face. I will label these circumstances as _suboptimal settings for argumentation_. According to the pragma-dialectical tradition, higher-order conditions for critical discussion are unfulfilled in these cases (van Eemeren, Grootendorst, Jacobs, & Jackson, (...) 1993). The main question of this paper is the following: what is the normative standard that parties in a discussion need to follow to arrive at a resolution within such circumstances? I will defend a middle-ground solution between two extreme ones. The first extreme position, the _anything-goes policy_, claims that, given that the conditions for a reasonable exchange of reasons are not satisfied, the dialogue stands outside the domain of reason, so anything goes for the parties. The second extreme position, the _business as usual policy_, claims that, since critical discussion is a normative model, the same rules should apply in suboptimal settings. Finally, the _supernormal policy_ that I defend claims that we need a more general and comprehensive norm that I refer to as a _supernorm_ to evaluate these cases. The supernormal policy divides argumentation into two stages: preparation and resolution. In the preparation stage, the parties attempt to restore or compensate for the suboptimality of the setting, while in the resolution stage, they attempt to resolve their disagreement. I contend that the moves of the preparation stage should be evaluated by using the supernorm instead of by the rules for critical discussion (van Eemeren and Grootendorst 2004 ). At this point, the paper considers theoretical insights from Gilbert ( 1995, 1997, 2002 ) and Jacobs ( 2000, 2006 ) to understand what this entails. (shrink)
